A passcode unlocks what is stored on the phone. Whether a particular request is lawful turns on the facts, so it helps to know the steps first.

This page explains what to know before you give police your phone passcode in a sex crime case in Texas. It is written for the person who was asked to unlock a phone, and for the family member, partner, or friend who is worried about them.

Why Police Ask for a Phone Passcode in a Texas Sex Crime Investigation

Police ask for a passcode because a phone often holds messages, photos, and account activity that matter in an online sex crime case.

A passcode is the code, fingerprint, or face scan that opens a phone’s contents. It is separate from the phone itself. Police can hold a phone and still be locked out of what is inside. Asking for the passcode is asking for access.

Online sex crimes often leave a digital trail. Texas law also reaches certain AI-created images of a recognizable minor under § 43.261, which applies to a person who is a minor.

For how these charges are built, see our guide to online sex crimes defense in Texas.

If police have asked you or someone you care about for a phone passcode, you don't have to decide alone. A person can agree to a search. The question then becomes whether that agreement was given freely, and by someone with authority to give it.

Texas law says consent is not effective if it is induced by force, threat, or fraud. It is also not effective if the officer knows the person giving it is not legally authorized to act for the owner. Texas Penal Code § 1.07 sets out these terms. An owner includes someone with title, possession, or a greater right to possession. So a family member’s agreement to a search of someone else’s phone raises a real question about authority.

Whether an exception applies depends on the facts of each case. Even when a warrant exists, the scope of what officers may search is a separate question to check.

Does the Fifth Amendment Protect a Phone Passcode?

Courts have not all reached the same answer about passcodes.

The main argument goes like this. Saying a passcode out loud shares something from your mind, which can count as testimony. Pressing a finger to a sensor or turning a face toward a camera may be treated differently, because it is a physical act.

Because courts have reached different results, the answer is contested and fact-dependent. Do not answer on instinct. Ask whether the officer has a warrant, and ask to speak with a lawyer. Our Texas criminal defense lawyers can review the request and the facts, then explain the privilege argument as it applies to your case.

Can Police Take My Phone If I Don’t Unlock It?

Seizure means police take and hold the device. Search means they look inside it. Refusing to unlock it does not make the phone disappear from the case.

How long a seized phone can be held, and what happens if no warrant follows, are fact-specific questions. Review them with a lawyer as soon as you can.

Unlawful Access to Stored Communications in Texas

Accessing someone else’s stored messages or phone without effective consent raises legal questions of its own.

Many families and partners look at a phone before police do. That can create a problem. Whether the access was lawful often comes down to consent and ownership.

Under § 1.07, consent must be real. It must not be induced by force, threat, or fraud. It is not effective if given by a person the actor knows is not legally authorized to act for the owner. Under § 1.07(19)(D), consent is not effective if it is given solely to detect the commission of an offense.

If you are the person who looked at the phone, speak with a lawyer before you describe how you got access.

Why Deleting Messages After Police Contact Creates Separate Risk

Deleting messages, photos, or accounts after learning of a police inquiry can create separate legal risk.

Data often survives deletion. A device, a cloud backup, or the other person’s phone may still hold the same messages. Deleting something does not take evidence out of investigators’ reach. It can raise questions of its own.

Sharing intimate images can also be a separate offense. Under Texas Penal Code § 21.16, disclosing visual material of another person’s intimate parts or sexual conduct without effective consent, with intent to harm, where at the time of the disclosure the person knows or has reason to believe the material was obtained or created under circumstances in which the depicted person had a reasonable expectation that it would remain private, and the disclosure causes harm to the depicted person and reveals that person’s identity, is a state jail felony.

Do not delete, edit, or reset anything without speaking with a lawyer first. For more detail, read our guide on deleted messages after police contact.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking to Police Before Anyone Unlocks a Phone

You can ask whether you are under arrest, whether you are free to leave, and whether a warrant exists.

Statements made during a police encounter can be used later. A short, calm request to speak with counsel first is a common protective step.

If an officer says something about the phone, a warrant, or what happens if you refuse, write it down. Include the date, the time, the officer’s name, and the exact words if you can recall them.

How silence is treated before and after arrest is covered in our guide to talking to police after an online sex crime arrest.

Talk With a Texas Sex Crime Defense Lawyer Before Anyone Unlocks the Phone

If police have asked you or someone you care about for a phone passcode, a lawyer can review the request before anything is unlocked.

You may be the person police contacted.
