Whether that address can support a charge on its own turns on the evidence in the case. An IP address is assigned to an internet connection. The provider links that connection to an account holder. It does not, by itself, show who was typing. This page explains how investigators move from an address to a device, why shared use matters, and which Texas laws are involved. A tip from an online platform, a saved chat log, or a complaint from a parent can each start the process. Investigators record the internet address and the time tied to the activity. Then they ask the internet provider for subscriber records. Those records usually name an account holder and a service address. That information may lead to a search warrant application for the home and its devices. The account holder is a starting point for investigators. It is not proof that the account holder sent any message. The Texas Attorney General’s ICAC page describes the Southern Texas task force, which covers 134 Texas counties and investigates online child exploitation. Each step in this chain produces its own records, and each record can be checked.

Why an IP Address Does Not Identify the Person Who Used the Device

One home internet connection can serve family members, roommates, guests, and workers. Wireless signals can reach devices throughout a house, so someone outside may connect too. Public and shared networks at a workplace, school, library, apartment complex, or coffee shop can create the same kind of address record for many users. Some internet providers reassign addresses over time. An address seen on one date may have belonged to another customer later. Virtual private networks (VPNs, tools that route traffic through another server) and proxies can also make activity appear to come from a different place. For these reasons, the central question in many cases is which person was using a particular device at the relevant time. Answering that question usually takes device evidence, not the address alone.

Shared Computers, User Accounts, and the Digital Records Investigators Review

A single computer can have several user profiles, and each profile can keep its own login history. Operating system and application records can show which account was signed in at a certain time. Examiners look at login and logout times, file creation and change dates, browser history, cached files, messaging app logs, and file metadata (hidden data that records when and how a file was made or changed). They build a timeline by matching these records with the times of the online activity. Gaps, overlaps, and time zone differences can change what the timeline appears to show. One device may hold activity from more than one user, so careful review often examines each account separately. Questions about deleted data raise their own issues, which our guide to deleted messages explains.

Search Warrants, Scope, and Digital Devices

Searches of homes, phones and computers raise questions that depend on the facts of each case. Its scope matters. Digital evidence is often examined after a device is seized, and that examination can take time. How the data was collected, preserved, and read can itself be disputed. If you receive a warrant, a property receipt, or an inventory, keep copies. Bring them to your first consultation so questions about scope can be reviewed against the actual paperwork. Share your own notes about who used which device, and when, with your attorney rather than with investigators.

Texas Charges Involving Computers, Devices, and Online Contact

Texas law covers several kinds of online conduct, and each charge has its own elements. Online solicitation of a minor is in Texas Penal Code § 33.021. The statute defines a minor to include a person the actor believes is younger than 17, so what the actor believed matters. Under § 33.021(c), a person commits an offense by knowingly soliciting a minor to meet, over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person. It is not a defense that the meeting did not occur. As defined in § 43.26, the material at issue in a possession or promotion of child pornography charge can include a file in any digital format that allows an image to be displayed on a computer or other video screen. In the prosecution of an offense under Subsection (a-1) or (e) of Penal Code § 43.26, the state does not have to prove the identity of the child in the depiction described by Subsection (a-1)(1) (§ 43.26(f)(1)).
