Release conditions in these cases can vary, and a lawyer can review what may apply to your situation. Those conditions matter from the first day.

This guide walks through that first court appearance step by step. For the wider picture on these charges, read our online sex crimes defense lawyer guide.

What a Texas Magistrate Hearing Is and When It Happens

A court appearance may follow an arrest, and a lawyer can explain what to expect. It is held early, after police have taken the person into custody. It is one of the first legal steps in the case.

It is not a trial. No jury is seated, and guilt is not decided here. A magistrate is a court official, and a lawyer can explain how that role may affect your case.

Many families ask what happens in the first 48 hours. This hearing is often part of that early window, though timing varies from case to case. A trial can come much later, after the case has moved through several stages.

Online cases can move quickly once police collect digital evidence. The early paperwork and release terms shape what comes next. That is why it helps to understand the hearing before it happens.

If you were arrested on an online sex crime charge and your bond limits your phone, computer or contact with others, we can talk through your options in a free, confidential initial consultation. Whether the arrest had sufficient support is a question a lawyer can review with you.

The magistrate relies on information from the arresting agency and on facts known at the time of arrest.

Statements the person makes, and anything found on a phone or computer, can shape what the court sees. Online cases often rest on digital evidence, such as messages, images or account records. Early facts matter for that reason.

The charge itself deserves a close read. Texas defines online offenses in specific statutes. The same conduct can sometimes be prosecuted under more than one law. Reading the exact statute named in the paperwork helps you understand what the state says happened.

How Bail and Bond Are Set After an Online Sex Crime Arrest

Release terms are a question a lawyer can review with you. The court makes these decisions, not the lawyer.

Non-monetary conditions are rules the person must follow. Examples include who they may contact or what devices they may use.

In online sex crime cases, conditions often address contact with other people and use of phones, computers and the internet. A court can set rules about who the person may contact, especially minors.

Families often ask whether the person can pay bond and go home that day. The answer depends on the amount set and the conditions attached. Our role is to review each term with the client and explain what it requires.

Bond Conditions That Restrict Contact and Device Use

Bond conditions can bar contact with certain people and limit how a person uses devices. Breaking a condition can be a separate crime.

Texas Penal Code § 25.07 makes it an offense to violate certain bond conditions in family violence, sexual assault or abuse, and related cases. The condition must relate to the safety of a victim or the community. Listed violations include contacting a protected person when the order prohibits communication, going to or near places the order names, possessing a firearm, and tracking a protected person’s property or vehicle without consent.

Repeated violations carry more risk. Texas law makes it a third-degree felony under Section 25.07 for a person who has previously been convicted two or more times of an offense under that section or Section 25.072, or once under each, to violate a court order or bond condition covered by Section 25.07. Section 25.07(g) grades the offense by its facts. The starting level is a Class A misdemeanor. It can rise to a state jail felony in limited situations, including when the defendant violates an order or a condition of bond in the manner described by Subsection (a)(1), (2), (3), (5), (6), or (7) while possessing a deadly weapon. It becomes a felony of the third degree in the circumstances listed in Section 25.07(g)(2), such as violating the order or condition of bond by committing an assault or the offense of stalking. Section 25.072 makes repeated violation a separate offense: a person commits it by engaging, two or more times during a period of 12 months or less, in conduct that constitutes an offense under Section 25.07. That repeated-violation offense is graded as a third-degree felony, rising to a second-degree felony when the trial shows that at least one time the person engaged in conduct punishable as a state jail felony under Section 25.07(g)(1)(B), which covers violating an order or condition of bond in certain listed ways while possessing a deadly weapon. In some cases it rises to a second-degree felony.

The same section also limits officers. A peace officer investigating a possible violation may not arrest the protected person for violating that order.

Vague wording creates real risk. A person on bond may not know what “near” or “contact” covers. Read the exact wording right away. Conditions can also affect work, school and family life, so raise those concerns early with a lawyer.

How the Defense Reviews Bond Conditions and Options to Change Them

Barbieri Law Firm reviews each bond condition with the client. We explain what each one requires in plain terms.

We look at the charge, the bond amount, the listed conditions and the evidence. We then explain the options that fit the client’s situation. One option can be asking the court to change a condition.

Whether the court grants a request is up to the court. No lawyer can promise a particular result.

Our lawyers, including Heather Barbieri and Carrie Thomas, can review these terms with you. We will review the charge, the bond conditions and the evidence, and explain your options.

Bond terms can change daily life quickly. Bring a written copy of each condition, the next court date and the charge as written to every conversation.

Magistrate Hearings in Collin County and Surrounding Cities

The basic steps in this guide are the same across Texas. An arrest in Collin County follows the same general path.

Barbieri Law Firm is based in Frisco, Texas. We defend online sex crime charges across Collin County, Dallas-Fort Worth and Texas. That includes arrests in Frisco, Prosper, McKinney and Plano.

Online cases can involve more than one agency. According to the Texas Attorney General’s ICAC page, the Southern Texas ICAC Task Force covers 134 Texas counties. It investigates online child exploitation, including sexual solicitation.

The federal Internet Crimes Against Children Task Force Program describes how technology-facilitated child sexual exploitation is investigated. State and federal investigators may both be involved in a case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions to Bring to a Free Initial Consultation

Before a consultation, gather the bond amount, every listed condition, the next court date and the charge as written.
