Under Penal Code § 33.021(a)(1)(B), a person the actor believes to be younger than 17 is treated as a minor. This page explains how age enters an online solicitation case, what a defense review covers, and what to expect. It is general information, and every case turns on its own facts.

What an Age Misrepresentation Defense Is and Who It Is For

An age misrepresentation defense answers a charge that rests on claims about age. The other person may have said they were an adult, or may have appeared to be one.

These cases often start in an online chat, a dating app, or a social media message. Some start with a law enforcement sting, where an officer or agent runs a fake profile. The Internet Crimes Against Children Task Force Program supports investigations of technology-facilitated child sexual exploitation.

This page is written for three groups:

Adults who have been charged or are under investigation.

Family members trying to understand a loved one’s situation.

Professionals and students worried about what a charge could mean for a license, job, or school.

Every case depends on its facts. Use this page as a starting point, not a forecast.

How Age Enters a Texas Online Solicitation Case

Age enters the case through the statute’s definition of a minor. Under Texas Penal Code § 33.021, a minor is someone younger than 17. A minor is also someone the accused person believes is younger than 17. So the State can rely on the other person’s actual age, the accused person’s belief, or both.

Subsection (c) covers a person who, over the Internet, by electronic mail, text message, other electronic message service or system, or through a commercial online service, knowingly solicits a minor to meet another person. The solicitation must carry intent that sexual contact, sexual intercourse, or deviate sexual intercourse take place. The statute also says it is not a defense that the meeting did not occur.

Under Texas Penal Code § 33.021, it is a defense to prosecution under this section that, at the time conduct described by Subsection (c) was committed, the conditions listed in Subsection (e) applied. The first applies if the actor was married to the minor. The second applies if the actor was not more than three years older than the minor and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

Sting cases often turn on what was written in the chat. They also turn on what the accused person believed about age at the time. The charging document names the age and belief claims the defense must answer.

What a Defense Review Covers

In an online sex crime age misrepresentation defense in Texas, the review starts with the full record. The order of messages often matters as much as any single line. A thorough review examines:

Message history and timestamps, including what was said before and after age first came up.

Profile details, photos, usernames, and any age statements, and whether those statements stayed consistent.

Device, account, and login records that show who used the account and when.

Identification, dates, or other information the accused person had or relied on.

The investigative file, including how contact started, who ran a fake profile in a sting, what the reports say, and whether recordings or logs are complete.

Your own statements and what has already been said to police, since early statements can shape the case.

The review also checks entrapment. Under Texas Penal Code § 8.06, entrapment is a defense when a law enforcement agent induced the conduct using persuasion or other means likely to cause persons to commit the offense. Merely giving a person an opportunity to commit an offense is not entrapment. The statute’s definition of law enforcement agent includes state, local, and federal personnel, and anyone acting on their instructions.

What to Expect: Steps From First Contact to Resolution

Most cases move through five stages. Timing varies with each county court’s schedule and the complexity of the case.

Initial consultation. We review the charge, the timeline, any notices, and any bond conditions.

Evidence preservation. We request complete chat logs, device data, and sting records while they are still available.

Court dates and bond matters. These follow the schedule the court sets.

Discovery review. We examine how the State’s evidence supports the age and belief points.

Options. We explain motions, negotiation, and trial, so you can make decisions with full information.

No lawyer can say how a case will end. The goal of each stage is to give you clear facts and clear choices.

Why Barbieri Law Firm

Barbieri Law Firm is an all-women criminal defense firm based in Frisco, Texas.
