It does not apply when the agent only gave someone a chance to act.

What the Texas entrapment defense is

Entrapment is a defense to prosecution in Texas. Under Texas Penal Code § 8.06, a person may use it when a law enforcement agent induced the charged conduct. The inducement must come from “persuasion or other means likely to cause persons to commit the offense.”

The statute also says that conduct which only affords a person an opportunity to commit an offense does not count as entrapment. That line between pressure and opportunity is the center of the defense. Two people can talk about the same topic and land on opposite sides of it.

The law covers more than police officers. The statute defines “law enforcement agent” to include state, local, and federal personnel. It also covers any person acting under their instructions. That matters in online operations, where the person on the other end may be an officer or someone working for one.

If a message or police contact has left you worried about a charge, our team can review the record with you in a free, confidential consultation with no obligation to continue. Usually not by pointing to one message. The defense is built from the whole record, and that record is often mostly the state’s own evidence.

The most useful records are usually chat logs, recordings, and police reports. The defense also looks at the person’s own account of how the exchange began. Lawyers look at who started the conversation, who raised the topic, and how the messages changed over time.

They also look at what the person said and did before the agent’s first contact. Then they test whether the agent’s conduct matches the statute’s language about persuasion or other means likely to cause the offense. Each step needs a source in the record.

For how message records are read as proof, see text messages as evidence.

What justifies entrapment?

Under § 8.06, entrapment requires inducement by a law enforcement agent or a person acting under one’s instructions. The inducement must use persuasion or other means likely to cause the offense. A chance to offend is not enough.

In practice, reviewers look for specific conduct in the record. They check for repeated requests after the other person said no. They check for pressure to keep going, offers of benefits, and flattery. They also check whether the agent introduced the sexual topic first.

Each item is a fact to match against the messages. None of them wins a case on its own. Ordinary conversation is generally not the same as inducement.

Everyday words like “pressure” or “trap” do not decide the question.

Why entrapment is often contested in online sting cases

Online stings are often contested because the written record can help either side. Messages are saved, so the sequence can be reviewed line by line. That record can show who made first contact and how fast the exchange moved.

It can also show whether the agent changed the stated age or the persona during the chat. Age matters here. Under Texas Penal Code § 33.021, a minor includes an individual the actor believes to be younger than 17. So what the accused person believed is part of the charge.

The charge itself carries weight. Under Section 33.021, a person who is 17 years of age or older commits an offense if, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K) of the Code of Criminal Procedure, the person intentionally communicates in a sexually explicit manner with a minor, or distributes sexually explicit material to a minor. This applies whether the contact happens over the Internet, by email, by text message or other electronic message service, or through a commercial online service. Knowingly soliciting a minor to meet over the Internet, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse, is a second-degree felony under the same section. It is a defense to prosecution under this section that at the time conduct described by Subsection (c) was committed the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct.

The statute also says that if conduct that is an offense under this section is also an offense under another law, it may be prosecuted under this section, the other law, or both. The National Center for Missing & Exploited Children describes what online enticement involves. Those descriptions help readers see why these cases draw close attention.

Is entrapment hard to prove? It depends on the record

Is it hard to prove entrapment? It can be, because a single message rarely decides the question. Courts and lawyers look at the whole exchange, including who started it and how it developed.

No lawyer can promise how a court will rule on an entrapment claim. Results turn on what the record contains and how the evidence reads as a whole. That is why the details matter so much.

The stakes can also last beyond the case itself. Those records may also affect criminal-history checks for employment or professional licensing. That is one reason to look at the full picture early.

Is there more than one type of entrapment?

Texas Penal Code § 8.06 makes entrapment a defense where a law enforcement agent induced the conduct through persuasion or other means likely to cause persons to commit the offense, and it states that merely giving a person an opportunity to commit an offense does not constitute entrapment. It helps to read the wording of the entrapment provision closely. One part covers inducement by an agent. The other says an opportunity alone is not entrapment.

Many online articles list “five types” of entrapment. Those lists often come from other states or federal case law. Some states and federal courts describe entrapment with different tests.

Before you rely on any article, check which jurisdiction it covers. A rule from another state does not decide a Texas case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What a good example of entrapment looks like

A clear example is one where the agent, not the person, raises the illegal topic. The agent also keeps pushing after the person declines. These examples are hypothetical illustrations only, not descriptions of any real case.

In the first hypothetical, an officer posing online as a 16-year-old messages a man who never mentioned minors. The officer raises the topic and presses it again after the man says he is not interested. The officer then offers reasons to keep talking. This record would draw close attention on the inducement question.

In the second hypothetical, a man raises the topic himself in a chat. The officer answers in a way that follows his lead and adds no new pressure. That record may show an opportunity rather than inducement.

Both examples turn on the record. The outcome of any real case depends on its own evidence and the court’s ruling.

Talk with us about your situation

If you’re trying to make sense of a message, a police contact, or a charge you didn’t expect, you don’t have to work it out alone.
