The rule is in Texas Penal Code § 8.06. It is a defense to prosecution if a law enforcement agent induced you to commit the offense using persuasion or other means likely to cause persons to commit it. Simply giving you a chance to offend is not enough.

If you are reading this after an arrest or an unexpected police contact, the questions probably feel urgent. That reaction makes sense. This page answers one question: what are the legal protections for entrapment in Texas? This page offers general information about the entrapment defense and how it may apply to online stings.

Every case turns on its own facts. The information below is general, so use it to understand the framework, not to predict how your own matter will end.

If a chat or police contact you didn't expect has you searching for answers, you don't have to sort it out alone. The inducement must use “persuasion or other means likely to cause persons to commit the offense.”

Subsection (a) also says that “conduct merely affording a person an opportunity to commit an offense does not constitute entrapment.” That sentence matters most. An officer who simply makes a chance available has not, by that fact alone, entrapped anyone.

Subsection (b) defines “law enforcement agent” broadly. It includes state and local officers, United States personnel, and “any person acting in accordance with instructions from such agents.” A civilian working under police direction falls within that definition too.

In plain words, the key terms work like this:

Law enforcement agent: an officer or other personnel of state, local, or United States law enforcement agencies, or any person acting in accordance with instructions from such agents.

Persuasion or other means: urging, pressure, flattery, offers, repeated requests, or other tactics.

Likely to cause persons to commit the offense: the statute asks whether the tactics were the kind that could push people into the crime.

Where the Line Falls: Persuasion Versus Opportunity

The line falls between tactics that create a crime and a chance that a person simply takes. Opportunity is not inducement. Inducement is when the officer’s conduct pushes the person toward the offense.

Take a simple example. An officer posts a decoy ad, and a person replies. The reply alone does not answer the legal question. The reviewer needs to know what happened next.

Several questions matter in a review:

Who first raised the subject of the offense?

How many times did the officer repeat or escalate a request?

Did the officer use pressure, flattery, or offers of something of value?

Did the officer keep pushing after the person hesitated?

The statute focuses on what the persuasion was likely to cause. That means the officer’s conduct and its effect on the person are both part of the picture. A reviewer looks at the whole exchange, not a single message.

How Entrapment Arises in Online and Undercover Stings

Online stings use undercover chat personas, decoy profiles, and sometimes staged meetings. The inducement-versus-opportunity question still controls.

Online cases add a layer that often gets less attention. Texas also has a separate online solicitation statute. Texas law makes it a crime for a person who is 17 or older, with intent to commit a listed sex offense, to intentionally communicate in a sexually explicit manner with an individual whom the actor believes to be younger than 17 years of age, over the Internet, by electronic mail or text message, or through a commercial online service.

Section 8.06 turns on whether a law enforcement agent induced the conduct; the rule for a person the actor believes to be a minor is in § 33.021. Under § 33.021(a)(1)(B), “minor” includes an individual “whom the actor believes to be younger than 17 years of age.” In a sting, the officer’s stated age is central to how the charge is framed.

Section 33.021 also limits what a defense can do. Under subsection (d), it is not a defense to a solicitation charge under subsection (c) that the meeting did not occur. Subsection (e) lists two narrow defenses, one of which is that the actor was married to the minor. Entrapment under § 8.06 is a separate question from these limits.

Penalties depend on the subsection charged. Under subsection (f), an offense under subsection (c) is a second-degree felony. The Texas Attorney General’s cyber safety resources describe Texas information on online solicitation of minors.

How the Defense Is Raised and Who Must Prove What

Entrapment is raised as part of the defense in a criminal case. The timing and form of how it is raised are decisions made with the lawyer, based on the record.

Because the defense depends on the conduct of the officer, the evidence about that conduct often becomes the center of the case. Messages, timing, and the officer’s reports can all matter. A lawyer uses that record to decide how the defense fits with the other issues in the case.

Entrapment is one issue among several that can arise in a case. Other questions may involve the charge, the evidence of intent, or procedure. No lawyer can predict or ensure how a court or jury will rule, so any review should stay focused on what the record shows.

Evidence Reviewed When Building an Entrapment Defense

A review starts with the full record of contact between the officer and the person. Partial screenshots rarely tell the whole story. The reviewer needs the sequence.

Records commonly reviewed include:

Complete message logs from every platform used

Timestamps that show when each message was sent and answered

Screenshots and any recordings

Police reports and supplemental reports

Ad postings, profile details, or operational information if available

Context matters as much as content. Reviewers look at who made the first contact, whether the tone or requests changed over time, and whether the person had any earlier contact with the officer. A pause in the conversation or a sudden shift in topic can matter.

This is what a defense lawyer reviews to evaluate the defense. It is not a promise about what the review will show. Some records help a defense, some do not, and the lawyer explains both.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Related Issues That Can Arise in These Cases

Each issue has its own elements and its own questions, so they should be reviewed separately from entrapment.

Those federal rules can apply alongside Texas law when online images or files are involved.

If your situation involves an online conversation, the broader picture is covered in our guide on online sex crimes defense in Texas.
