But an IP address alone does not prove who typed a message. That gap matters in IP address evidence online sex crime Texas cases, where the message content and the sender’s intent usually carry the most weight.

What an IP Address Can and Cannot Show

An IP address shows which internet connection was used at a specific time. It does not show which person was sitting at the keyboard.

An IP address is a number. Your internet provider assigns it to your connection when you go online. Each message sent through that connection carries the address along the way.

Providers often reassign addresses to different customers over time. That is why the timestamp matters as much as the number itself. An address used at 9:00 p.m. on one day may belong to someone else the next morning.

An IP record is one piece of digital evidence. Investigators usually read it next to other records, such as login history, message timestamps, and device data. A defense review looks at whether those records line up or leave gaps.

If police have contacted you or someone you care about over online messages, you don't have to sort through it alone. The provider’s answer identifies a subscriber account, not a person.

This step has two parts. First, a platform or message service records the address and time a message was sent. Second, the provider matches that address and time to an account. Specialized units also work these cases. Internet Crimes Against Children (ICAC) task forces investigate online child exploitation.

The account holder is not automatically the sender. A family plan, a roommate, a guest, or a neighbor’s Wi-Fi can all use the same connection. A defense review asks who else could have used it at that moment.

Shared Networks, VPNs, and Multiple Devices

One IP address can serve many people and many devices. For that reason, it rarely points to one person by itself.

Households, workplaces, schools, hotels, and public Wi-Fi all share connections. A single home may have several phones, laptops, tablets, and smart TVs on the same network.

VPNs and proxy services route internet traffic through another server. The address that shows up can then point to a different location or provider than the user’s. Many people use these tools for privacy, so their use alone does not prove intent.

Gaps in timing, address reassignments, and limits in what providers log can leave an IP link incomplete. A common mistake is assuming an IP match settles the question either way. It does not. Each link in the chain needs its own proof.

Digital Evidence That Often Accompanies IP Records

Phones, computers, and online accounts often hold the messages that an IP record only points toward.

Device examinations may look for messages, saved accounts, browser history, and file transfers. Platform records can include registration details, login history, and message metadata. Metadata is data about a message, such as when it was sent, not what it says.

Questions about how far a device search went can matter in a case. The scope of a search is often one of the questions raised when a device has been examined.

Investigators often compare timestamps across several sources to build a timeline. The timeline is only as reliable as each source in it. If one clock is off, the whole sequence can shift.

Texas Online Sex Crime Charges Built on Messages

Texas online solicitation charges turn mainly on what was sent, to whom, and what the sender believed about the person’s age.

Texas Penal Code § 33.021 covers online conduct involving a minor. A “minor” is someone younger than 17, or someone the actor believes is younger than 17. Subsection (b) covers a person who is 17 years of age or older and, with intent to commit a listed offense, intentionally communicates in a sexually explicit manner with a minor or distributes sexually explicit material to a minor. Subsection (c) covers knowingly soliciting a minor to meet, including the actor or another person, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person.

Subsection (d) says it is not a defense to a (c) charge that the meeting did not occur. One applies if the actor was married to the minor. The other applies if the actor was not more than three years older than the minor and the minor consented.

Penalties depend on the subsection and the facts. Under § 33.021(f), a (c) offense is a second-degree felony. A (b) offense is a third-degree felony, raised to second degree when the minor is younger than 14 or the actor believes so. A second-degree felony carries 2 to 20 years in prison and a fine up to $10,000.

The specific charge depends on the facts and the statute. Firm practice areas include online sex crimes defense, child sex crimes defense, and sex crimes defense in Texas.

Questions a Defense Review of IP Evidence Typically Asks

A defense review asks whether the records connect the accused person to the messages, not just the connection.

Several questions come up in most reviews. Did the legal request for account and IP records match the scope the law allows? Are the timestamps accurate, and are the provider’s time records reliable? Who had access to the connection and devices at that time, including household members, guests, and coworkers?

Other questions focus on the devices and the messages themselves. Was the chain of custody for each device and data set documented? Were the messages tied to the accused person by more than an IP address?

Entrapment is another issue. Texas Penal Code § 8.06 makes entrapment a defense when a law enforcement agent induces the conduct with persuasion or means likely to cause a person to commit the offense. The statute says that merely giving a person an opportunity to commit an offense is not entrapment. The statute also defines a “law enforcement agent” to include personnel of state and local law enforcement agencies as well as federal officers, and any person acting in accordance with instructions from such agents.

These answers shape the options available. Each case is evaluated on its own record.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking With a Lawyer Before You Answer Questions

Talking with a lawyer before answering questions can help you understand what investigators have and what your options are.

A notice, a knock at the door, a request for a phone, or a search warrant can feel urgent and confusing.
