Whether it shows up, and how it reads, depends on the type of check, the stage of the case, and the final outcome.

Three things shape what a reader sees. The first is the check itself. Texas DPS criminal history searches, FBI fingerprint checks, commercial background reports, and licensing or child-care fingerprint checks each draw from different sources. The second is the stage. An arrest, a charge, a dismissal, a conviction, and deferred adjudication each leave a different entry. The third is who is asking, because an employer, a landlord, and a licensing agency each read a record differently.

An arrest is not a conviction. A record that shows an arrest or charge does not, by itself, say how the case ended. For the broader defense picture, read our online sex crimes defense overview.

If an online sex crime charge shows up on a background check you didn't expect, you don't have to sort it out alone. That means the final outcome matters as much as the arrest. An arrest is usually the first entry, and it does not show whether the case moved forward.

Deferred adjudication works differently. Except as provided by Article 42A.102(b), if in the judge’s opinion the best interest of society and the defendant will be served, the judge may, after receiving a plea of guilty or nolo contendere, hearing the evidence, and finding that it substantiates guilt, defer further proceedings without entering an adjudication of guilt and place the defendant on deferred adjudication community supervision (Texas deferred adjudication statute).

If the judge has not proceeded to an adjudication of guilt when supervision ends, the judge must dismiss the case and discharge the defendant (Texas dismissal and discharge rule). Texas Code of Criminal Procedure Art. 42A.111(b) allows the judge to dismiss the proceedings and discharge a defendant before the deferred adjudication community supervision period ends if the judge finds that doing so serves the interest of society and the defendant. The judge may not do this for a defendant charged with an offense that requires registration as a sex offender under Chapter 62. Under Art. 42A.111(c) of the Texas Code of Criminal Procedure, a dismissal and discharge generally may not be considered a conviction for disqualifications imposed by law, except as Section 12.42(g), Penal Code, provides. Subject to the exceptions in Subsection (d), an offense that ended in a dismissal and discharge may not be used as grounds for denying, suspending, or revoking a professional or occupational license or certificate of someone otherwise entitled to or qualified for it (Tex. Code Crim. Proc. art. 42A.111). Under Texas law, apart from a limited statutory exception, a dismissal and discharge after deferred adjudication community supervision may not be considered a conviction for the purposes of disqualifications or disabilities that the law imposes for conviction of an offense.

Records are only as current as the reports courts and agencies send. A missing or late update can make an old entry look current. So request the complete record, including the disposition. Don’t rely on a short summary or a third-party site.

Background Checks and Public Records Can Show Different Things

Several checks are common, and each one pulls from a different place. A Texas DPS criminal history search draws on state records.

An FBI fingerprint-based check searches national records. A commercial background report is different again. These reports may use different sources, may lag behind court updates, may leave out the disposition, and may contain errors.

The statute charged also matters. Texas lists specific offenses by name, and online solicitation of a minor is one of them under Texas Code of Criminal Procedure Art. 62.001.

Check the disposition details on the official record. Keep copies of every court document you receive. Those papers help you show exactly what the case became.

Sex Offender Registry: What It Draws From

The registry follows a reportable conviction or adjudication. It does not follow an arrest alone. Texas defines that term to include deferred adjudication. The list includes offenses such as sexual assault, aggravated sexual assault, indecency with a child, and online solicitation of a minor.

Because online solicitation is on that list, the specific statute charged matters. Identify the exact offense before you assume the registry does or does not apply.

The registry and the criminal history record are separate lists. One may show a person while the other does not. Read both if you are checking a record.

Duration is set by statute. Under Texas Code of Criminal Procedure Art. 62.101(c)(2), for an offense other than one listed in Art. 62.101(a), when the duty to register is based on a conviction or on an order of deferred adjudication, the duty ends on the 10th anniversary of the date on which the court dismisses the criminal proceedings and discharges the person, the date the person is released from a penal institution, or the date the person discharges community supervision, whichever date is later. That rule is subject to Subchapter I. For a person with a reportable conviction or adjudication, other than an adjudication of delinquent conduct, for a sexually violent offense or another offense listed in Art. 62.101(a), such as an offense for which the person was civilly committed as a sexually violent predator, the duty ends at death, except as provided by Subsection (b) and Subchapter I (registration duty rules).

Fingerprint-Based and Licensing Checks: What They Draw From

Licensing and child-care checks often go further than a name search. Fingerprints may be used to search criminal history. The agency may also ask for records, documents, or an explanation.

Each agency applies its own rules. It may do so when the offense relates to the activity the license covers. A licensing agency may also consider prior deferred adjudication when the job involves direct contact with children in the normal course of duties, or when the offense was, for example, committed under Chapter 21 or 43, Penal Code, or described by Article 62.001(5) or (6) (Texas dismissal and discharge rule).

Under Texas Government Code § 411.0755, a person whose record is the subject of an order of nondisclosure is not required, in an application for employment, information, or licensing, to state that the person was the subject of a criminal proceeding related to that record. Without that order, the question on the application may still apply.

Keep every notice the agency sends. Read the dates printed on it. Use the date on your notice, not a general timeline you found online.

How Employers, Landlords, and Licensing Agencies Use What They See

Employers, landlords, and licensing boards each set their own standards. Some ask for an explanation before they decide. A check result is usually one input among several.

Be ready to give context. Useful items include court paperwork, proof of disposition, and a clear timeline of the case. Ask the agency which records it reviewed. Keep copies of what you send and what you receive.

Online conduct can also trigger a separate review. A workplace may review company devices or accounts on its own track. That review can bring up information that a criminal record check would not show. Expunction and nondisclosure are different tools, and each has its own rules.

Under Article 55A.002, a person to whom this subchapter applies is entitled to have all records and files relating to the arrest expunged if the person is tried for the offense for which they were arrested and acquitted by the trial court, except as provided by Article 55A.151. The acquitted person can request it after notice to the state. The state can also request it with the person’s consent (Texas acquittal expunction article). An expunction petition is filed in a district court in the county where the person was arrested or where the offense was alleged to have occurred, subject to the statute’s requirements (Texas expunction petition article).

Nondisclosure after deferred adjudication has its own timing. The petition may be filed only after discharge and dismissal, and the wait depends on the offense. Under Texas Government Code § 411.0725(e)(3), a person placed on deferred adjudication for a felony may petition for an order of nondisclosure only on or after the fifth anniversary of the discharge and dismissal. Under Texas Government Code § 411.0725(e)(2), a person placed on deferred adjudication for a misdemeanor under Chapter 20, 21, 22, 25, 42, 43, or 46, Penal Code, may petition for an order of nondisclosure only on or after the second anniversary of the discharge and dismissal.

Some records are excluded from nondisclosure altogether. A person may not receive one if the order is requested for, or the person was previously convicted of or placed on deferred adjudication for, an offense requiring Chapter 62 registration (Texas nondisclosure conditions).
