Text threads, app chats, social media direct messages, photos and videos you sent or received, and call logs can all become part of an investigation.

Message content is only one piece. Account data, device data, timestamps and cloud backups can also matter. A single message may exist in several places at once: your phone, the other person’s phone, a backup you forgot was turned on, and the servers of an app or provider.

Many people don’t know which of these items live on the phone, which live in an online account, and which live in both. That is why the question is harder than it looks. Timestamps can show when messages were sent and received, which helps place events in order. What you can see on a screen may be only part of what exists. Your reasons for keeping or removing a message can matter as much as the message itself.

Why Deleting Messages Can Be Treated as Tampering With Evidence in Texas

Deleting messages can create legal exposure when the goal is to keep them from an investigation. Questions about tampering with evidence depend on the facts of each case, and a lawyer can review those facts with you.

Intent and timing are the core questions. Clearing an old phone before a new one, long before anyone raised a concern, is a different set of facts from deleting a thread the day after learning of a police inquiry. Prosecutors and investigators look closely at both what was removed and when. The same delete can carry different weight depending on what else is happening in the case.

Whether deletion creates exposure depends on the facts of the case. Don’t assume a deletion that seems harmless to you will look that way to someone else. Our firm reviews those facts, including what was removed, when and why, before any decision is made.

The Texas Penal Code Sections Behind Sexting and Online Solicitation

Texas Penal Code § 33.021 covers online solicitation of a minor. Both turn on message content, the ages involved and how the messages were sent.

Under § 43.261, a minor commits an offense by electronically promoting sexual material of a minor to another minor, when the sender produced it or knows another minor did. The base offense is a Class C misdemeanor. Higher grades apply with certain intent or prior convictions.

The statute includes an affirmative defense, meaning a legal argument that can excuse conduct if proven. It covers minors who are not more than two years older or younger than each other and had a dating relationship at the time of the offense, or who were spouses at the time of the offense, and who exchanged material only with each other. It also reaches AI-created images that, to a reasonable person, are virtually indistinguishable from an actual minor.

Under § 33.021, a person 17 or older can commit an offense by communicating sexually with a minor over the internet or by text, with intent to commit a listed sex offense. Here, a minor means someone younger than 17, or someone the actor believes is. Knowingly soliciting a minor to meet for sexual contact is a second-degree felony. The meeting does not have to happen.

Investigations can start from reports. The NCMEC CyberTipline takes reports of suspected online child exploitation and refers them to law enforcement for possible investigation. For a fuller overview, see our online sex crimes defense page.

Are Text Messages Enough Evidence to Convict?

Text messages can be important evidence, but they are one kind of proof. Other proof can include testimony, examination of devices, account records and statements.

How much weight messages carry turns on how they were obtained and whether they can be tied to a specific person and device. Who held the phone, which account sent the message and when it was sent can all matter. A single line rarely tells the whole story without the messages around it. Context, timing and the full thread often change how a line reads.

No general answer can predict how a particular case will be decided. That is why our firm reviews your messages, accounts and timeline before anyone draws conclusions about them.

Why Deleted Messages Are Not Always Gone

Deleting a message from your phone does not always remove it from every place it exists. Copies can remain in cloud backups, in an online account, on the other person’s phone, or in a provider’s records.

Investigators may seek warrants for devices and accounts. Forensic examiners can sometimes recover data a user believes is gone. How much they recover varies by device, software and timing.

A deletion made during an investigation can become part of the record itself. That removal can raise its own questions, separate from the content of the messages. Plan for what might surface, not what you hope stays hidden. Deleting is not a dependable way to make messages disappear.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Steps to Take Before You Change Any Device or Account

Before you change a device or account, speak with our firm about what that change could do to evidence. Several common actions can change or destroy data a reviewer would examine.

Those actions include deleting threads, factory resetting a phone, trading in or wiping a device, uninstalling apps, closing accounts and clearing cloud backups. Until you have spoken with us, avoid editing, forwarding or wiping anything. Some of those steps can’t be undone.

Writing a timeline can help. Note what was said, when, and on which device. Label it as a communication to our firm, keep it private and share it with no one else.

Decisions about speaking with investigators belong in that same review. Statements can become evidence, and what you say can shape the case.

How Messages Can Affect Custody Cases and Background Checks

Message records can matter in family court and in background checks, even while a criminal case is still open. If custody or divorce is also in play, our separate page on online sex crime charges and child custody and divorce covers how the issues overlap.

Texas law sets limits on who can receive an order of nondisclosure.
