It is written for people trying to understand a charge, whether it involves them or someone they love.

What indecent exposure means under Texas law

Indecent exposure is a legal category defined by statute.

The statute ties the exposure to a sexual purpose and to awareness of other people. A defense lawyer tests each element against the records in the file. For the third element, the key questions are where the event happened, who could see it, and what the person was aware of at the time.

Examples of conduct the statute can cover

The statute covers exposing the anus or genitals with intent to arouse or gratify sexual desire, where the person is reckless about whether another present person will be offended or alarmed. It does not require a public place. Many readers are surprised by that point.

Illustrative situations include:

exposure in a shared area of a building, such as a hallway or common space.

Each example still needs the sexual purpose and the awareness of others. Context matters too. Intent, what a witness actually saw, and where the event took place often shape how a case reads. Two acts that look alike can lead to different charges, depending on the evidence.

Indecent exposure vs. public lewdness

Indecent exposure and public lewdness are different Texas offenses. Public lewdness is about sexual acts, not just exposure. Under Texas Penal Code § 21.07, a person commits public lewdness by knowingly engaging in sexual intercourse, deviate sexual intercourse, or sexual contact in a public place.

If the act is not in a public place, the person must be reckless about whether another is present who would be offended or alarmed. Public lewdness is a Class A misdemeanor. It becomes a third-degree felony if the person is civilly committed as a sexually violent predator under Chapter 841, Health and Safety Code.

People use it to describe many kinds of conduct. The charge depends on the specific conduct alleged and the evidence about it. Mixing up the two offenses can lead to confusion about what the state must prove.

Penalties and how the charge is graded

Indecent exposure is a Class B misdemeanor on its base grade. Prior history can raise the grade under Penal Code § 21.08:

Class A misdemeanor: one prior conviction under this section.

State jail felony: two or more prior convictions under this section.

Third-degree felony: civil commitment as a sexually violent predator under Chapter 841, Health and Safety Code.

For a Class A misdemeanor, Texas Penal Code § 12.21 allows a fine up to $4,000, jail confinement up to one year, or both. Texas law also says a prior conviction used for enhancement can be used again later, under § 12.46.

The statutory range sets the limits. Penalties are not the only cost.

When the alleged exposure involves a child

If the alleged exposure involved a child younger than 17, the charge may be indecency with a child by exposure. That offense is more serious. Under Texas Penal Code § 21.11, a person commits it by exposing the anus or genitals, with intent to arouse or gratify sexual desire, while knowing the child is present. Exposure under this subsection is a third-degree felony. The contact-based version in the same section is a second-degree felony.

The statute lists an affirmative defense. Texas law recognizes this defense only when several conditions are all met: the person was not more than three years older than the victim, was of the opposite sex, and used no duress, force, or threat. These listed conditions are only part of the requirements. The statute also requires that, at the time of the offense, the person (A) was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender, or (B) was not a person who under Chapter 62 had a reportable conviction or adjudication for an offense under this section. A separate defense applies if the actor was the spouse of the child at the time of the offense. Penal Code § 21.11(b-1) makes it an affirmative defense that the actor was the spouse of the child at the time of the offense, so the facts of each case determine whether it applies.

A separate rule applies to judgments. Under Code of Criminal Procedure Art. 42.017, the judge makes an affirmative finding in some age-based cases. That finding applies when the defendant was not more than four years older than a victim who was at least 15, and the conviction rests only on the two ages.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What a criminal defense lawyer reviews in an exposure case

A criminal defense lawyer reviews the charging papers, the police report, witness statements, any video or photos, and the timeline of events. The review follows the same questions as the elements. What did the person intend? What did they know about who was nearby? Can a witness identify the person, and from where did they see it?

Gaps and conflicts in the accounts deserve close review. Early review matters, too. Statements made to police early on can shape a case later, so it helps to understand the charge before giving one.

In child-related cases, professional standards for forensic interviews matter.

No lawyer can promise how a case will end.
