It can happen, but whether a particular charge can be dismissed depends on the facts, the evidence and the stage of the case. A dismissal ends the case without a conviction at that point. This guide explains what dismissal means, the routes a case can take, and the facts that decide whether a charge can be challenged.

What Counts as an Online Sex Crime in Texas

Online sex crimes are offenses carried out through phones, computers, messaging apps and social media. One common example is online solicitation of a minor, covered by Texas Penal Code § 33.021. The statute reaches communications sent over the Internet, by text, or through a commercial online service.

The law also counts a person the accused believes is under 17 as a minor. So the other person’s real age is not the only question. The charge depends on the statute, the age the State claims, and what the State must prove about intent or knowledge.

Sending sexual images without the recipient’s request or consent can be a separate offense. Under Texas Penal Code § 21.19, that conduct is a Class C misdemeanor. The National Center for Missing & Exploited Children describes the grooming and exploitation tactics that online enticement involves.

An arrest is not a conviction. The charge on paper may be narrower or broader than what happened. For the full range of charges we defend, see our online sex crimes defense page.

If a charge has someone you love facing messages, screenshots and no clear answers, we can talk through the evidence and your options with you. It is different from an acquittal, which follows a trial and a not-guilty verdict. A grand jury no-bill means jurors did not vote to indict. A reduction swaps the charge for a lesser offense. A conviction means the person was found guilty or pleaded guilty.

Deferred adjudication is one path that ends in dismissal. Under Texas Code of Criminal Procedure art. 42A.111(a), when the supervision period expires and the judge has not adjudicated guilt, the judge shall dismiss the case and discharge the defendant.

There is a limit. The judge may end supervision early if it serves the best interest of society and the defendant. But the judge may not do that for a defendant charged with an offense requiring registration as a sex offender under Chapter 62, according to art. 42A.111(b). The reason for a dismissal still shapes what comes next.

Ways an Online Sex Crime Case Can End Before Trial

Can an online sex crime charge be dismissed in Texas before trial? Several routes exist, and each turns on the evidence and the timing. A case can end when the prosecutor drops it, when a grand jury declines to indict, when a court excludes key evidence, or when the proof of who sent the messages falls apart.

After reviewing reports, messages and digital records, a prosecutor may decide not to file or to dismiss. If the State presents the case to a grand jury and jurors do not find probable cause, the result is a no-bill. A court that excludes improperly obtained evidence can leave the State with less proof. If the State cannot show who typed a message, that gap can matter.

Texas record relief, such as expunction or nondisclosure, is limited and depends on the specific case and how it was resolved. The case file, not general patterns, decides which route applies.

How Intent and Knowledge of Age Affect the Case

The State must prove the mental state the statute requires. That proof is often where a challenge starts. Under subsection (c), the State must show the accused knowingly solicited a minor to meet, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse.

Belief about age matters too. The messages, profile details and what each side said about age become central facts. Gaps in proof of intent or knowledge can support a challenge or a dismissal request. How strong those gaps are depends on the record.

Subsection (e) lists two defenses to the solicitation-to-meet offense. The first is that the parties were married. The second is that the accused was not more than three years older than the minor and the minor consented.

Entrapment is another defense. Under § 8.06(a), it applies when a law enforcement agent induced the conduct through persuasion or other means likely to cause persons to commit the offense. Merely giving a person an opportunity to commit an offense is not entrapment. For how messages between adults are analyzed, read our sexting guide.

How Digital Evidence Can Be Challenged

Phones, laptops and online accounts often hold the core evidence. Each step used to collect them can be reviewed. A motion to suppress asks a court to exclude evidence obtained improperly. Learn more in our guide to suppressing phone evidence.

Account access is another issue. For sex offender registration purposes in Texas, an “online identifier” includes electronic mail address information or a name a person uses when sending or receiving an instant message, social networking communication, or similar Internet communication, or when taking part in an Internet chat. That definition covers any assumed name, nickname, pseudonym, moniker or user name the person sets up for an email address, a chat or instant chat room platform, a commercial social networking site or an online picture-sharing service. A name on a message is therefore a fact to test. Who actually used the device or login is a separate question. If another person may have used the account, read about someone else using an account.

A forensic review can help. Reviewing the device, the account logs and the timestamps can show whether the State’s version of events is complete.

Dismissal Versus Reduction: What to Ask Early

A case may end in a reduction instead of a dismissal. The difference matters for the record and for later consequences. For a state jail felony, Texas Penal Code § 12.44(a) lets a court impose punishment allowed for a Class A misdemeanor if that would serve the ends of justice. Under Texas Penal Code § 12.44, a court may punish a defendant convicted of a state jail felony with the confinement permissible for a Class A misdemeanor if, after considering the gravity and circumstances of the felony and the defendant’s history, character, and rehabilitative needs, it finds that this would best serve the ends of justice.

Registration is another reason to ask early. Art. 62.001 lists a violation of § 33.021 among the offenses in its definitions of reportable conviction.

Raise these questions early:
– Which statute is charged?
– What must the State prove?
– What evidence has been disclosed?
– Do bond conditions limit device use or contact with anyone?

The court calendar and the prosecutor’s review set the timing, and either can take time. Gather the charging papers, bond paperwork, phone and account information, and a written timeline of events now.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk Through Your Situation With Barbieri Law Firm

If you are reading this about a charge against a spouse, partner, child or yourself, the uncertainty is hard.
