This page gives the short answer first, then explains how Texas law handles age in online cases. It explains the framework, not how any particular case will turn out.

Short answer: can you still be charged if you believed they were 18?

In Texas, a belief about age can matter, but it does not automatically end the case. Under Texas Penal Code § 33.021, a minor is an individual who is younger than 17 years of age, or an individual whom the actor believes to be younger than 17 years of age. A minor is someone younger than 17, or someone the actor believes is younger than 17. That second prong is why believed age becomes central. Lawyers usually argue these cases through the age element and the person’s mental state. They do not start from a rule that age mistakes never count. For the broader picture, read our online sex crimes overview. The result in any case depends on its facts.

If messages you didn't expect have put you or someone you love in this position, you don't have to sort out the age question alone. That statute deals with sexual contact and certain exposure conduct. Texas’s sexual assault statute covers sexual assault, including sexual assault of a child. Under that section, the offense applies regardless of whether the person knows the child’s age.

Online solicitation works on a different test. It looks at the actual age and the actor’s belief about age. Mixing these tests up is a common source of confusion. Read each statute on its own terms, and check which age element the charge actually uses.

How Texas defines a minor in online solicitation cases

Under Texas Penal Code § 33.021, a minor is an individual younger than 17. A minor also includes an individual the actor believes is younger than 17. The first applies to a person 17 or older who communicates in a sexually explicit manner with a minor, or sends sexually explicit material to one. The communication must happen online, by text or through a commercial online service. The person must also intend to commit a listed offense.

The second offense is soliciting a minor to meet. A person commits it by knowingly soliciting a minor, over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service, to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse or deviate sexual intercourse with the actor or another person. The statute says it is not a defense that the meeting did not occur.

Penalties depend on the offense. The first offense is a third-degree felony, but it becomes second-degree if the minor is younger than 14 or the actor believes so. The punishment is also increased to the next higher category of offense if it is shown on the trial of the offense that the actor committed it during regular public or private primary or secondary school hours and the actor knew or reasonably should have known that the minor was enrolled in such a school at the time. The solicitation-to-meet offense is a second-degree felony. Investigators and prosecutors usually review the messages, the stated age, any photos and the order of events.

Mistake of age and the mistake-of-fact defense

A mistaken belief about age helps only if it fits the mental state the offense requires. Under the believed-age prong, the actor’s belief is part of the definition itself. So what the person believed, and why, becomes a real question.

A stated age, a profile claim or a stated birthday is evidence that must be addressed. Attorneys look at how the belief formed. They check whether the stated age stayed consistent across messages and when the belief arose in the conversation. Under Texas Penal Code § 33.021(a)(1)(B), the age element refers to an individual “whom the actor believes to be younger than 17,” and the statute sets no reasonableness standard for that belief. That standard can frame how a belief is judged. Timing and reasonableness are part of how the facts are weighed.

How these cases commonly arise: profiles, stings and posing as a minor

Many online cases start on social apps, messaging apps or dating sites. The other person’s age often appears only in a profile or in chat. Stings are also common. In a sting, an adult or officer may pose as a minor online.

Because the definition includes someone the actor believes is under 17, the statute does not require an actual minor for that prong. Texas Penal Code § 8.06 provides an entrapment defense. It applies when a law enforcement agent induces the conduct through persuasion or other means likely to cause a person to commit the offense. Merely giving someone an opportunity to commit an offense is not entrapment. The statute covers state, local and federal agents, and persons acting on their instructions.

Federal programs support these investigations. The Internet Crimes Against Children Task Force Program supports investigations of technology-facilitated child sexual exploitation. The NCMEC online enticement page describes what online enticement involves and common grooming tactics. Many readers do not know whether the other person was a real minor, an adult or an officer. That uncertainty is itself a fact to examine.

Is physical contact or a meeting required?

A meeting is not required for the online solicitation-to-meet offense in Texas. Section 33.021(c) turns on the solicitation and the intent behind it.

Other statutes involve physical conduct. Indecency with a child under Texas Penal Code § 21.11 involves sexual contact with a child younger than 17, or causing a child younger than 17 to engage in it, or exposing one’s anus or genitals to such a child, knowing the child is present, with intent to arouse or gratify sexual desire, or causing such a child to expose the child’s anus or genitals. Sexual assault under Texas Penal Code § 22.011 involves causing penetration or contact. Which charge applies depends on what is alleged to have happened.

So a meeting changes which statute may apply. It does not decide whether the online statute applies at all. Read the charge carefully to see which conduct it describes.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Before you talk to anyone: how your phone and messages can affect the case

Phones, passcodes and message threads are often central evidence.
