A visit alone doesn’t show what officers already have or what they plan to do next. This guide explains what to say, what to avoid, and when to bring in a lawyer. Texas law on online messages with minors is specific. Whether a charge applies depends on the content, the ages involved and the facts of the case.

Why Officers May Be at Your Door About Online Messages

Officers who come about online messages may be following up on a report or an investigation that involves those messages. A visit doesn’t tell you how much they have or how the case will move. It’s normal to feel shaken, especially if the knock came without warning.

Texas makes some online messages a crime. Under Texas Penal Code § 33.021, the statute defines a minor as a person younger than 17, or an individual whom the actor believes to be younger than 17 years of age. Subsection (b) of Penal Code § 33.021 applies to a person who is 17 years of age or older and who intentionally communicates in a sexually explicit manner with a minor, or distributes sexually explicit material to a minor, over the internet, by email or text message or another electronic message service or system, or through a commercial online service, acting with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure. Subsection (c), which has no age requirement, separately makes it an offense to knowingly solicit a minor to meet for sexual contact, sexual intercourse, or deviate sexual intercourse; the statute provides a defense if the actor was married to the minor, or was not more than three years older than the minor and the minor consented. The statute sets different felony levels for different conduct, so the exact charge matters.

For a broader overview, read our online sex crimes defense overview.

If officers have come to your door about messages you sent or received online, you don't have to face the next step alone. You can talk through a closed door. Stepping outside is your choice, and you can make it only if you feel safe doing so.

Ask a few direct questions. Ask whether you are under arrest. Ask whether you are free to leave. Ask whether they have a warrant. Their answers tell you where you stand.

Write down what you can after they leave. Note the time, the officers’ names and agency, and what each person said. Your notes can help a lawyer later, so keep them private and accurate.

What to Say, and What to Avoid Saying

Keep your words short and polite. Two lines work well: “I’d like to speak with a lawyer before I answer questions.” And, “I do not consent to any searches.”

Avoid explaining the messages on the doorstep. Small details, guesses about someone’s age, and partial explanations can be repeated later and are hard to take back. Even a friendly, honest-sounding story can create new problems if it is incomplete.

Don’t make up answers or give false information. A false or misleading statement can create a separate issue, so the safest choice is to say nothing about the substance and ask for a lawyer. For what changes after an arrest, read talking to police after an online sex crime arrest.

Consent, Searches and Your Phone

Many people in this situation choose to decline consent to a search of their home, car or phone. Saying no on the spot is a clear, calm step. A lawyer can explain how that choice applies to your case.

Ask to see the warrant and read what it covers. Don’t argue at the door. Note what they say they are searching for.

Don’t delete, edit or hide messages, accounts or apps. Changing anything can create new questions on top of the original ones. Officers may also ask for your phone passcode. That question has its own issues, which we cover in phone passcode requests during a sex crime investigation.

Can Police Read or Track Your Messages?

Digital evidence in criminal cases can come from many sources, and each case depends on its own facts. Devices and online accounts can keep data even after a message is removed from view.

Federal and state teams also investigate online child exploitation. The Internet Crimes Against Children Task Force Program supports investigations of technology-facilitated child sexual exploitation. That means a case may involve more than one agency.

What investigators can get depends on the platform, the device and the legal process used. You can’t tell from the doorstep what they already have. A lawyer can ask the state what it has and review the evidence. If your questions center on the age of the person in the messages, see our guide on age questions in online sex crime cases.

If You Are Asked to Come In or Are Arrested

If officers ask you to come in for an interview, ask whether you are being detained or are free to leave. Those two answers mean very different things. Ask whether you are under arrest.

You can say that you want a lawyer before answering questions. Say it clearly, and say it each time the topic comes up. Repeat the request until you have counsel.

Each criminal case follows its own timeline, and the details of each case matter. The timing can move quickly, so early preparation matters. Texas sex offender registration also carries ongoing duties.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Bringing a Lawyer In Early

Talk to a criminal defense lawyer early, before you give a statement or send another message.
