It sets a lifetime duty for listed offenses and a fixed end date for most others. For a conviction or deferred adjudication for an offense other than those described in Subsection (a), the duty ends on the 10th anniversary of whichever date is later: the date the court dismisses the criminal proceedings and discharges the person, the date the person is released from a penal institution, or the date the person discharges community supervision (Article 62.101). Those dates are when the court dismisses the case and discharges the person, when the person is released from a penal institution, and when the person discharges community supervision. Article 62.101 states this rule for convictions and deferred adjudications.

Texas law defines “reportable conviction” broadly. Article 62.001 says the term includes a deferred adjudication and an adjudication of delinquent conduct. It applies even while an appeal is pending. A deferred adjudication can therefore count toward registration, but not for certain out-of-state or federal offenses, or a second indecent exposure violation, where the violation results in a deferred adjudication, and an appeal doesn’t change that.

Under Article 62.101, whether the duty lasts until death depends on whether the offense is listed in Subsection (a), and for other offenses the end date is tied to the dates in Subsection (c). Different charges lead to different end dates. That’s why the exact charge, and how the case is resolved, matter so much from the first day.

Does Texas Use Registration Tiers?

The duration rules in Article 62.101 are written by offense and by date, not by numbered tier. Many search results for this phrase describe other states. Those states use their own risk-level systems.

A tier label, where another state uses one, describes a category in that state’s system. It doesn’t predict how a court or the registry will treat any one person. Keep two things straight. The offense of conviction decides which rule applies. The dates in the statute decide when the duty ends. Mixing these up leads to wrong answers.

Which Child Sex Offenses Carry Lifetime Registration

Certain offenses trigger a lifetime duty under Article 62.101. Some of those lifetime triggers apply only when the person also receives another reportable conviction or adjudication, other than a delinquent adjudication, for an offense or conduct that requires registration; civil commitment as a sexually violent predator under Chapter 841 of the Health and Safety Code does not have that condition.

Texas Code of Criminal Procedure Art. 62.101 also lists offenses under Section 20.02, 20.03, or 20.04, Penal Code, subject to the conditions stated in that article. These apply when the judgment contains an affirmative finding under Article 42.015 or, for a deferred adjudication, the case papers contain a finding that the victim or intended victim was younger than 17. The person must also have another reportable conviction or adjudication. An affirmative finding is a finding the court records in the judgment or related papers.

Civil commitment as a sexually violent predator under Chapter 841 of the Health and Safety Code is one of several circumstances that can require lifetime registration. The complete list appears in Article 62.101(a) of the Texas Code of Criminal Procedure. For that person, the duty ends at death, except as provided by Subsection (b) and Subchapter I.

Offense level matters too. Under Penal Code 21.11, sexual contact with a child is a second-degree felony. Exposure to a child is a third-degree felony. Under Penal Code 22.021, aggravated sexual assault is a first-degree felony. Article 62.001 defines the terms used in this chapter, including ‘penal institution’ and ‘public or private institution of higher education.’

Juvenile Cases and Registration Under Texas Law

Juvenile cases follow different rules. The lifetime categories in Article 62.101 apply to a reportable conviction or adjudication other than an adjudication of delinquent conduct. So a juvenile adjudication does not trigger those lifetime categories. When the duty rests on a juvenile adjudication, the statute sets a different end date. The duty ends on the 10th anniversary of the disposition or the completion of its terms, whichever is later.

Young adults may have another option. Article 62.301 lets a person ask the court for an exemption from registration. A person may be eligible to petition for this exemption if they are required to register only because of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, and the court has entered an affirmative finding under Article 42.017 or 42A.105(c) in the judgment or filed that statement with the appropriate papers.

The court may hear testimony from the victim.

What Registration Requires During the Registration Period

Registration also involves ongoing duties to report to law enforcement.

Knowing when the duty ends is the first step in planning. A lifetime duty runs until death. Both facts shape decisions about housing, work, and travel, so they should be clear early.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Registration Is Reviewed Before Any Plea

Because duration depends on the offense of conviction, the charge a plea would produce decides the registration result. A plea to one offense can lead to a fixed end date. A plea to another offense can lead to a lifetime duty. For that reason, registration is part of plea review, not an afterthought.

The review looks at the offense, the ages and dates involved, any affirmative finding in the judgment, and the duties and restrictions that would follow. Affirmative findings matter. Subject to the statute’s exceptions, Article 62.101 makes the duty to register last until death for a reportable conviction or adjudication (other than an adjudication of delinquent conduct) under Penal Code Section 20.02, 20.03, or 20.04 only if both of the following are true. First, the judgment contains an affirmative finding under Article 42.015 or, for a deferred adjudication, the case papers contain an affirmative finding that the victim or intended victim was younger than 17. Second, before or after that conviction or adjudication, the person receives or has received another reportable conviction or adjudication, other than an adjudication of delinquent conduct, for an offense or conduct that requires registration. The wording of a judgment can change the registration outcome.

Penal Code 21.11 also lists an affirmative defense with specific conditions. Those conditions include being not more than three years older than the victim and of the opposite sex, not using duress, force, or a threat, and limits tied to prior registration. Focusing only on jail time or probation can miss the registration duty that follows a plea.

Reviewing these consequences doesn’t predict how a case will end. No lawyer can promise a particular result.

Talk With Barbieri Law Firm About Your Registration Questions

If you face a pending child-related charge, registration length may be part of the decision in front of you.
