Each has its own notices and deadlines. Early choices can affect both, so it helps to know how the two tracks meet before you respond to anyone.

Who This Page Is For and What a Child Sex Crime Charge Means for an Educator

This page is for Texas teachers, coaches, counselors, aides and other school employees who face a child sex crime charge or investigation. It is also for the spouses and family members helping them decide what to do first.

The exact charge matters. Indecency with a child covers engaging in sexual contact with a child younger than 17 years of age, or causing a child to engage in sexual contact, and certain exposure conduct committed with intent to arouse or gratify sexual desire. Sexual assault of a child and aggravated sexual assault are separate offenses under Texas law.

Educators can also face a school-specific offense.

Many school cases start with texts, photos or messages. Texas Penal Code § 33.021 covers online solicitation of a minor. The NCMEC online enticement resource describes how online grooming and enticement work.

What Happens to a Texas Educator Certificate After a Charge

A charge is not the same as an action against your certificate, but it can start a separate review. The Texas Education Agency (TEA) oversees educator certification and misconduct matters. A review can open after an arrest, a charge or a report from a school.

This review runs apart from the criminal case. It has its own notices and response periods. Ask yourself these questions now:

Has TEA or the district contacted you in writing?

What notices have you received, and on what dates?

Which response periods are running, and when do they end?

The criminal case and the certificate matter can move at different speeds. Do not assume one will decide the other.

How District Reporting and Administrative Leave Typically Work

District reporting and leave decisions follow district policy and your employment contract. They do not follow the criminal court calendar. Administrative leave is a common step while a district reviews a matter.

Start by gathering these items:

Your employment contract, the district’s policies on leave and misconduct, and every written notice.

A dated record of each conversation with your principal, HR office or athletic director. Note who spoke, when, and what was said.

Any formal interview request, which should go through counsel before you answer.

If you coach, a review of your duties with a lawyer. Extracurricular roles can carry their own rules on student contact, travel and team messages.

Schools also face limits on naming accused staff. Under Texas Penal Code § 21.12, a public or private primary or secondary school, or a person or entity that operates one, may not release externally to the general public the name of an employee accused of an offense under this section until the employee is indicted for the offense, except as the statute otherwise provides, including when the school must report the accusation or conduct an investigation of it. Those exceptions include reports to TEA, another state agency or local law enforcement, and investigations. The enrolled student’s name is not public under the same section.

What the Defense Covers: The Criminal Case and the Job at the Same Time

Our defense focuses on the criminal case, starting with the first review of the paperwork. We look at:

Charging papers, police reports and bond paperwork.

Digital evidence such as texts, images and account records.

A timeline of school events, schedules and roles that bear on the allegations.

Bond conditions. Knowingly or intentionally violating a bond condition that relates to the safety of a victim or the community, in a sexual assault or abuse case, is an offense. Limits on contact with minors or school grounds can conflict with your job.

We explain each option, including dismissal, trial and plea offers. A plea can lead to deferred adjudication. A judge may defer further proceedings without entering an adjudication of guilt, after a plea of guilty or nolo contendere, if the judge decides it serves society and the defendant. The judge must also explain the possible consequences of violating supervision.

Some cases involve an affirmative defense. Penal Code § 21.11 provides an affirmative defense for an actor who was not more than three years older than the victim and of the opposite sex, did not use duress, force, or a threat against the victim at the time of the offense, and, at the time of the offense, was either not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender, or was not a person who had a reportable conviction or adjudication under Chapter 62 for an offense under this section. Whether any defense fits depends on the facts.

What to Expect: A Step-by-Step Process

You can expect five steps, from a first meeting to ongoing updates on both tracks.

Initial consultation. Bring the charging papers, any TEA or district notices and your employment contract.

Document review. We gather bond paperwork, district and TEA letters and the policies for your position.

Deadline map. We list court settings, certificate and district response windows, and leave or employment dates.

Written strategy. We explain the options on both tracks and what each could mean for your job and record.

Ongoing updates. We keep you informed at each court setting and each certificate or district step, and explain each decision before it is made.

Timing depends on the court calendar, the district’s process and TEA’s process. Ask us to explain the likely sequence for your specific charge.

Why Barbieri Law Firm for an Educator or School Employee Facing These Charges

Barbieri Law Firm is an all-women criminal defense firm based in Frisco, Texas.
