This page explains the rules in plain terms, so you can understand what you may be facing.

Who Has a Duty to Register in Texas

A person has a duty to register after a reportable conviction or adjudication for an offense the law lists. That trigger is what makes someone a registered sex offender in Texas. The duty follows the offense and the person’s record, not the labels people use in conversation.

Texas defines a reportable conviction or adjudication to include deferred adjudication. The exact judgment and the listed offense matter.

How long the duty lasts depends on the offense. For some offenses, the duty can last for life, subject to the exceptions stated in the statute. Except as provided by Subchapter I, under Art. 62.101(c)(2), for an offense not listed in subsection (a), if the duty to register is based on a conviction or an order of deferred adjudication, the duty to register ends 10 years after the latest of these dates: the date on which the court dismisses the criminal proceedings and discharges the person, the date on which the person is released from a penal institution, or the date on which the person discharges community supervision. The registration expiration rules lay out these timelines.

Texas also covers online identifiers.

If someone you care about is facing a registration charge, you don't have to work through the facts alone. The failure side looks at what was reported, when, and to whom.

Cases often turn on dates. Lawyers look at when a person moved, when a change was reported, and what notice the person received. A gap in the paper trail is worth examining closely.

No single fact decides a case. The dates, notices, and reports work together, so the file is read as a whole.

Penalty Range for Failure to Register in Texas

Texas sets its felony ranges in the Penal Code.

A second-degree felony carries 2 to 20 years in prison and a fine of up to $10,000. A third-degree felony carries 2 to 10 years in prison and a fine of up to $10,000. Under Texas law, a person adjudged guilty of a state jail felony faces confinement in a state jail for not less than 180 days and not more than two years, and may also be fined up to $10,000. That person is instead punished for a third-degree felony if it is shown at trial that a deadly weapon was used or exhibited during the offense or immediate flight from it and the person used or exhibited it, or was a party who knew it would be used or exhibited, or that the person has certain specified prior felony convictions.

Prior convictions can raise the grade. A third-degree felony can be punished as a second-degree felony when the person has a prior final felony conviction, other than a state jail felony under § 12.35(a) (repeat felony offender rules).

When a sex offender does not register in Texas, the charging papers show the grade filed. Read those papers with a lawyer, because the grade drives which range applies.

Sex Offender Laws for Visitors and People Moving to Texas

A person who moves to Texas from another state can have a Texas duty to register. Texas bases its duty on listed offenses and also on substantially similar out-of-state or federal convictions, according to the U.S. Department of Justice SMART Office summary of Texas law.

For visitors, the answer turns on the person’s record. The key question is whether a prior conviction matches a Texas listed offense. A single rule rarely answers every case.

A person who moves to Texas should review Texas rules early. It helps to do this before a notice arrives, not after.

Each state writes its own registration rules. One state’s rules do not describe another’s, so a move does not settle the question by itself.

Consequences Beyond the Criminal Sentence

Failure-to-register charges can affect more than a sentence. They can shape where a person lives and works and what shows up on a background check.

The Texas State Library guide to sex offender restrictions summarizes these limits.

Records can stay public. Those records may also affect criminal-history checks for employment or professional licensing.

A separate route is the young adult exemption. A person required to register under this chapter who is eligible may petition the court at any time on or after sentencing or placement on deferred adjudication community supervision. The young adult exemption statute sets out the other conditions too.

How a Defense Review of a Failure-to-Register Charge Begins

A defense review starts with the records. The lawyer gathers what the State relied on and checks it against the law.

The file usually includes the registration history, any notices the person received, the dates of moves or changes, what was reported and when, and the charging papers. Each item answers a specific question.

The review asks whether each part of the charge can be proven as written. It also asks whether the duty and the notice in the file match. A lawyer checks the offense behind the duty, since the duty rules depend on it. Online identifiers become part of the review when the charge involves internet activity.

No one can predict how a case will end before the records are reviewed. Each file turns on its own facts. The review explains the options that the record supports.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

If This Is Happening to Someone You Care About

You may be reading this because a family member, friend, or coworker has been charged with failing to register.
