These cases can turn on several factual and legal questions. Who was the other person, or who were they presented to be? What age was stated or implied? What did the messages actually say?

If you are reading this about your own chat, you may be worried about what happened. If you are reading about a partner, friend, or family member, you may feel scared or confused. Both situations raise the same core questions.

This is general information about Texas law, not advice about your case. Small details in a conversation can change how the law applies, so the full exchange matters.

What Texas Online Solicitation of a Minor Covers (Penal Code 33.021)

Texas online solicitation law is about communications with minors. Texas Penal Code § 33.021 applies to a person who is 17 or older for the sexually explicit communication offense in Subsection (b); the solicitation offense in Subsection (c) has no age requirement for the person. It covers sexually explicit communication with a minor sent over the internet, by email, by text, or through a commercial online service. The person must act with intent to commit a listed offense.

The statute covers a second act too. It is a crime to knowingly solicit a minor to meet another person over the internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service. The solicitation must carry the intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. It is not a defense that the meeting never happened.

Two points matter most. First, the communication offense does not need a physical meeting. Second, the statute counts a person the sender believes is under 17 as a minor. That belief can carry the same legal weight as knowing the real age.

Why Age Decides Most Role-Play Cases

Age is one element that can matter in these cases. Fictional framing alone does not answer the age question. A chat can be labeled a role-play, a fantasy, or a character. The law still asks about the age of the person on the other end, or the age the sender believed.

Ages come up in many places. A profile may list a birth year. A username or bio may mention a grade level or a school. A message may refer to a class, a curfew, or a school event. Each detail can become evidence about whether someone was presented as a minor.

That is why the whole conversation gets read, not one line. Timestamps show when things were said. Platform records can show account details. A single reference to a school year can change how an entire exchange is viewed. This is the core of whether adult role-play chat can become an online sex crime charge in Texas.

What If You Did Not Know the Other Person’s Age?

Under the statute, belief matters. A chat with someone the sender believed was an adult raises different questions than a chat where the sender believed the other person was a minor. This question can arise in accidental situations.

Consider one example of how this can arise. An adult messages what appears to be an adult profile. Later, the other person turns out to be a minor. The stated and apparent ages in the chat become central. What the sender knew at the time matters most.

Records help show what the sender knew. The full thread, earlier messages, and how the other person introduced themselves all matter. Any profile information visible at the time can matter too.

Two other points come up. A narrow defense applies to the meeting offense. It applies if the actor was married to the minor, or was not more than three years older than the minor and the minor consented to the conduct. Also, if the other person was an undercover officer, entrapment may apply. Texas Penal Code § 8.06 says that merely giving someone an opportunity to offend is not entrapment.

Sexting and Sexually Explicit Images Involving Minors

Sexting questions can involve separate statutes. Sharing explicit images raises issues beyond the text-only solicitation law. Several Texas statutes cover visual material, and each has its own elements.

Texas Penal Code § 21.19 makes it an offense to knowingly transmit, by electronic means, visual material that shows sexual conduct, a person’s exposed intimate parts, or covered genitals of a male person that are in a discernibly turgid state. The recipient must not have asked for it or expressly consented. That offense is a Class C misdemeanor.

Texas Penal Code § 43.261 covers minors who intentionally or knowingly share, by electronic means, with another minor visual material showing a minor engaging in sexual conduct, including material depicting the minor who shares it, if the sharer produced the material or knows another minor produced it. It includes an affirmative defense tied to a dating relationship. Texas Penal Code § 43.26 turns on whether the person knew or should have known the depicted child was younger than 18. It also covers computer-generated images made with artificial intelligence.

One exchange can raise more than one potential charge. Review the whole conversation and every image together. The exact statute, element, and degree depend on the facts.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Potential Consequences of an Online Sex Crime Charge in Texas

Online solicitation of a minor is a felony in Texas. Under Texas Penal Code § 33.021, communicating in a sexually explicit manner with a minor over the internet, with intent to commit a listed offense, is a third-degree felony, or a second-degree felony if the minor is younger than 14 years of age or the actor believes the minor is younger than 14 years of age. The meeting solicitation offense is a second-degree felony.

Punishment can move up one level if the offense happened during regular public or private primary or secondary school hours. The actor must have known, or reasonably should have known, that the minor was enrolled in a public or private primary or secondary school at the time of the offense.

Registration is another concern. Texas lists online solicitation of a minor among the offenses in the registration chapter’s definitions (Texas Code of Criminal Procedure art. 62.001). For material involving a computer-generated child, Texas Penal Code § 43.26 provides that if it is shown on the trial that the visual material contained a depiction of a computer-generated child who appears to be younger than 10 years of age and is engaging in sexual conduct, the punishment for the offense is increased to the punishment for the next higher category of offense, and for an offense punished under Subsection (c-3)(3) the minimum term of imprisonment is 10 years.

Investigations can start before any charge is filed. Federal investigators may work alongside Texas police in online child exploitation cases, through the Internet Crimes Against Children Task Force Program. Each step, from an arrest to a device search, carries its own legal consequences.

How a Defense Review of a Chat Works in Collin County

A defense review starts with the full record. That includes the transcript, timestamps, the platform used, stated and apparent ages, and any images or links. The review looks at the state’s theory and at the facts that support the defense.

Those facts include what the sender knew and what the other person said about themselves. They also include any context around the exchange, such as how the conversation started and who introduced the topic.

Barbieri Law Firm is based in Frisco. The firm serves clients in Collin County, across Dallas-Fort Worth, and throughout Texas. Our team reviews the records in the context of the specific charge.

Cases often move through several stages, from investigation to charges and sometimes to court. Each stage can bring new records.
