Some of them can be, depending on which record is searched. “Public record” is not one database. Court files, state criminal history, the sex offender registry and jail booking data are separate sources.

If a charge was just filed against you or someone close to you, the question of who can see it can feel as heavy as the case. This guide explains where each record lives, so you know what to ask.

The Short Answer: Some Records Are Public, and Which One Matters

Online sex crime charges can appear in public records in Texas, but the answer depends on the record. Each source answers a different question. A court file shows the case. A state criminal history shows reported arrests and outcomes. The registry shows who must register. A jail roster shows who is currently held.

The stage of the case matters too. A charge filed last month can look very different from a case that ended in dismissal. Some online charges fall under Penal Code § 33.021, which makes certain online communications with a minor a felony.

For the background-check side of this question, see our online sex crime arrest background check guide.

If a charge has been filed against you or someone you love, the question of who can see it can feel as heavy as the case itself, and we're glad to talk it through. The clerk keeps the filings, the case number and the docket of court dates. Collin County cases go through Collin County courts, so the Collin County clerk keeps those files.

Court indexes can list a case as soon as it is filed. That can be well before any conviction, dismissal or final ruling. Some filings or details may be restricted by statute or court order, so a file is not always complete.

Public access to a file is not the same as a full picture of how a case ended. Read the status of the case closely. A pending case and a closed case can look similar at a glance.

Texas DPS Criminal History: Arrests, Charges, and Dispositions

The Texas Department of Public Safety holds the state’s central criminal history record. Those records may also affect criminal-history checks used for jobs and professional licenses.

Private background check companies pull from their own mix of sources. Their results may not match what DPS holds or what a court file shows. A check may also miss a court change that happened after the data was collected.

Sex Offender Registry: Not Every Sex Crime Charge Leads to Registration

Being charged is not the same as having to register. Registration depends on a qualifying conviction or deferred adjudication. Texas law defines a reportable conviction or adjudication to include a deferred adjudication when it is based on a listed sex offense. Texas Code of Criminal Procedure Art. 62.001 reads: “(I) the second violation of the laws of another state, federal law, the laws of a foreign country, or the Uniform Code of Military Justice for or based on the violation of an offense containing elements that are substantially similar to the elements of the offense of indecent exposure, but not if the second violation results in a deferred adjudication.” Texas Code of Criminal Procedure Art. 62.001 reads: “(H) a violation of the laws of another state, federal law, the laws of a foreign country, or the Uniform Code of Military Justice for or based on the violation of an offense containing elements that are substantially similar to the elements of an offense listed under Paragraph (A), (B), (B-1), (C), (D), (E), (G), (J), (K), (L), or (M), but not if the violation results in a deferred adjudication.” Under Texas Code of Criminal Procedure Art. 62.001, a reportable conviction or adjudication includes an adjudication of delinquent conduct or a deferred adjudication, so a case that did not end in a final conviction can still carry registration duties.

The length of the duty also varies. For certain listed offenses, including some sexually violent offenses (defined as listed offenses committed by a person 17 years of age or older), the length of the registration duty is set by other provisions of Chapter 62, not by these definitions. For many other offenses, it ends on the 10th anniversary of a later date tied to dismissal, release or discharge.

A charge that is pending or dismissed, with no qualifying outcome, does not place someone on the registry for that reason alone.

Mugshots, Jail Rosters, and Booking Information

Jails and sheriffs’ offices keep booking records for arrests. Some agencies publish current inmate rosters that list name, charge and booking date. Publication practices vary from agency to agency. The same arrest may appear on one roster and not on another.

Third-party mugshot websites often copy booking data. Their listings can stay online after a case changes or is resolved. These copies sit outside the court and DPS systems. A copy is not the official record of how a case ended.

Arrest, Charge, Dismissal, or Conviction: How Each Is Recorded

Each stage can create its own entry. An arrest is recorded at booking, even if no charge is filed later. A charge appears once the case is filed in court. Charges can be amended, reduced or dismissed, and each change becomes a new event.

A dismissal is recorded as a disposition. Older searches may still show the earlier arrest or charge.

A deferred adjudication works differently. The judge may place the defendant on deferred adjudication community supervision instead. Each record may show that outcome differently from a final conviction.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Can These Records Be Limited or Cleared?

Texas allows some arrest and charge records to be expunged through a court process. Eligibility depends on the charge, the outcome and the timing. Sex offense cases often have strict limits.

Under nondisclosure rules, a person may not get a nondisclosure order for an offense requiring registration under Chapter 62. The same is true for a family violence offense.

An expunction petition is filed in a district court. The court can be in the county of arrest or the county where the offense was alleged to have occurred, under expunction venue rules.

When questioned under oath in a criminal proceeding about an expunged arrest, the person arrested or anyone else may say only that the matter has been expunged; otherwise, the person arrested may deny the arrest and the expunction order, under final expunction effects. Copies on other websites are a separate question.

Facing an Online Sex Crime Charge? Start With a Confidential Conversation

If you’re trying to figure out what records show, a confidential talk is a useful first step. The firm’s lawyers can review which records may apply to a specific situation.

Are online sex crime charges public record Texas?

Some can be.

Does a deferred adjudication count as a conviction for registration?

It can. Texas defines a reportable conviction to include a deferred adjudication based on a listed offense, including some sex offenses and certain unlawful restraint, kidnapping, and burglary offenses that meet the conditions stated in the statute, except that a second indecent exposure violation, or an out-of-state, federal, or foreign offense substantially similar to a listed offense, does not count if it resulted in a deferred adjudication (Art. 62.001(5)).

Can a sex crime record be sealed in Texas?

Some records may be expunged.
