The duty follows a reportable conviction or adjudication under Chapter 62 of the Texas Code of Criminal Procedure. Under Chapter 62 definitions, that term includes a deferred adjudication. Many families don’t expect this. A deferred adjudication doesn’t end in a final conviction, yet it can still start the duty.

A federal court’s sex offender program page makes the same timing point for pretrial defendants.

A charge still matters before any duty exists. The Texas Department of Public Safety notes that deferred-adjudication, conviction, arrest, and probation records may remain publicly accessible. Those records can appear in criminal-history checks for jobs and licenses. This matters most for families planning around a case that is still open.

The exact start point depends on the facts and the final judgment. Review the case record early.

If someone you care about was just charged, you don't have to work out the registration timeline alone. The duty can begin at the plea or judgment stage, depending on the offense and the result.

Here is how each stage lines up:

Pending charge. No plea or judgment exists yet, so there is no reportable conviction or adjudication.

Plea and deferred adjudication. After a guilty or nolo contendere plea, hearing evidence that supports guilt, a judge may place the defendant on deferred adjudication community supervision if, in the judge’s opinion, the best interest of society and the defendant will be served, except as provided by Article 42A.102(b).

Final conviction. A conviction for a listed offense is a reportable conviction, and it can start the duty.

Some offenses face extra limits.

Early release has limits too. Under art. 42A.111, a judge may not dismiss and discharge early a defendant charged with an offense that requires registration under Chapter 62.

Charge language matters. Whether an offense is reportable depends on the specific statute and the facts alleged. Check the exact charge and any plea terms against the case record.

How Long Do Sex Offenders Have to Register in Texas?

For many reportable offenses, the duty lasts 10 years after the case ends. For certain listed offenses, it lasts for life. The clock usually starts when the case or supervision ends, not on the date of the charge.

For a person whose duty to register is based on a conviction or an order of deferred adjudication for an offense not described in subsection (a), art. 62.101(c)(2) provides that, except as provided by Subchapter I, that registration requirement expires on the 10th anniversary of whichever date is latest: the date the court dismisses the criminal proceedings and discharges the person, the date the person is released from a penal institution, or the date the person discharges community supervision. Where the duty to register is based on a conviction or an order of deferred adjudication and ends on a 10th anniversary, it ends on the 10th anniversary of the date on which the court dismisses the criminal proceedings against the person and discharges the person, the person is released from a penal institution, or the person discharges community supervision, whichever date is later, under Texas Code of Criminal Procedure Art. 62.101. The later date controls.

Lifetime rules work differently. For a person with a reportable conviction or adjudication, other than an adjudication of delinquent conduct, for certain listed offenses, the duty to register ends when the person dies, except as provided by Subsection (b) and Subchapter I of Texas Code of Criminal Procedure Art. 62.101. Among the listed offenses are sexually violent offenses and possession or promotion of child pornography.

Other exceptions in Chapter 62 can change these periods, so the answer depends on the facts. Checking the judgment or the deferred adjudication order shows which rule applies.

What Happens If Someone Does Not Register in Texas?

A missed verification date or a missed required report can create exposure for someone who believed the paperwork was done. Each reporting date should be recorded and tracked from the start.

Registration can also limit daily life.

Because the duties are ongoing, it is important to raise questions about them early.

Can a Sex Offender Get Off the Registry in Texas?

Removal is possible in certain cases that Texas law sets out. One route is a petition for exemption that Chapter 62 titles “Exemption From Registration for Certain Young Adult Sex Offenders,” found in art. 62.301.

Eligibility is narrow. A person may petition if the duty comes from a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, or if the person was convicted of or placed on deferred adjudication community supervision for an offense under Section 21.11 or 22.011, Penal Code, before September 1, 2011. For a petition under subsection (c) of Article 62.301, the court may consider it only if the petition states, and the court finds, that the defendant would have been entitled to the entry of an affirmative finding under Article 42.017 or 42A.105(c), as appropriate, had the conviction or placement on deferred adjudication community supervision occurred after September 1, 2011. A petition may be filed at any time on or after sentencing, or on or after the date the person is placed on deferred adjudication community supervision.

A petition is not a formality. Under Texas Code of Criminal Procedure Art. 62.301, the court may issue an order exempting a person from registration under this chapter if it appears by a preponderance of the evidence that the conditions listed in the statute are met. The exemption must not threaten public safety. The conduct must not have occurred without the victim’s consent. The exemption must serve the victim’s interest and the interest of justice.

An exemption order does not expire. But the court must withdraw it if the person later receives a reportable conviction or adjudication.

Not everyone qualifies, and no one can predict how a court will rule. The offense and the record decide eligibility.

Which Crimes Require Sex Offender Registration in Texas?

Registration follows a conviction or adjudication for an offense that Chapter 62 lists. The list is specific. It covers many sex offenses and certain offenses involving children, as set out in art. 62.001.

Online offenses need careful attention. Under Penal Code § 33.021, a person who is 17 years of age or older commits an offense by communicating in a sexually explicit manner with a minor over the Internet, with intent to commit an offense listed in art. 62.001(5)(A), (B), or (K).

Other charges use different statutes. Indecency with a child is covered by Penal Code § 21.11. Sexual contact under that section is a second-degree felony. Under Penal Code § 22.021, aggravated sexual assault is a felony of the first degree.

A charge is not reportable just because it involves a sexual topic. That check matters more than the label on the charge.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Barbieri Law Firm About Your Situation

If a family member was just charged, or you were charged and didn’t expect it, these timing questions can feel urgent. Reviewing the full record is the first step.

Who reviews the details of my case?

Our team, led by Heather Barbieri, reviews the charge, the court paperwork and the available evidence, then explains what it means for you.

Talk With Heather Barbieri About Your Charge

Schedule a Free Consultation or Call (972) 424-1902

Schedule a Free Consultation or Call (972) 424-1902

Related practice areas

Online Sex Crimes Defense Lawyer | Collin County & Texas

More in this section

Will an Arrest for an Online Sex Crime Show Up on a Background Check in Texas?

Workplace Sexual Assault Accusation Defense Lawyer in Texas | Barbieri Law Firm

Online Solicitation Charge When the Person Was an Adult Posing as a Minor: Texas

Adult Posing as a Minor Online: Texas Defense

Aggravated Sexual Assault Defense Law Firm Collin County

A charge alone generally does not start Texas sex offender registration.
