The limits that apply come from the offense, the sentence and the supervision status. It helps to sort those limits into three groups.

The first group is court orders and supervision conditions. These bind one person in one case. The second group is platform rules. Companies like Instagram and Facebook write and enforce their own terms. The third group is Texas law about minors and social media. Those rules focus on minors, not on adults on the registry as a group.

A platform that lets someone open an account does not mean that account follows the person’s legal conditions. Many people learn this the hard way. Each source needs its own check.

If you are worried about a family member's case or your own conditions, we can review the orders and online activity with you. Under Texas Penal Code § 25.07, it is an offense to knowingly or intentionally do certain listed acts, such as prohibited communication, going near protected places or possessing a firearm, in violation of certain court orders or safety-related bond conditions in a family violence, sexual assault or abuse, indecent assault, stalking or trafficking case. That includes communicating with the protected person “in any manner” when the order bars all contact, except through the person’s attorney or a person appointed by the court. Repeated violations within 12 months can bring a separate charge under Texas Penal Code § 25.072.

The account names a person uses can matter in that paperwork.

Platform rules on Instagram and Facebook are separate from criminal law

Instagram, Facebook and other platforms set their own rules about who may hold an account and what content is allowed. They enforce those rules on their own terms. A platform can remove or restrict an account even when no criminal condition applies.

The reverse is also true. An account may be allowed by a platform and still break a court order or supervision condition. Platform approval does not answer the legal question.

This is the point people often miss. A platform’s rules and a legal restriction can point in different directions. The legal restriction is the one a court or supervising officer enforces. A reader should look first at the written order and the supervision terms.

What Texas law says about minors and social media

Because of that, anyone relying on a summary should check the current statute text before acting on it.

Texas law also treats minors differently in some online conduct. Texas Penal Code § 43.261 applies to “a person who is a minor” and covers certain electronic sharing of visual material depicting a minor. That section addresses conduct between minors.

A minor-focused rule does not decide what an adult on the registry may do online. Adult limits come from the adult’s own orders, supervision terms and registration duties. Those are the documents to review first.

Online conduct that can create separate criminal exposure

Some online conduct can lead to criminal charges, even without a social media rule. The law covers the conduct itself, not only the platform used.

Texas Penal Code § 33.021 covers certain online communication with a minor. It makes it an offense for a person 17 or older to communicate in a sexually explicit manner with a minor, with certain intent. Knowingly soliciting a minor online to meet for sexual contact is a separate offense. The statute says it is not a defense that the meeting did not occur.

Those threats can involve coercion for intimate material or sexual conduct. Texas Penal Code § 21.19 covers knowingly sending sexually explicit visual material that the recipient did not request or consent to receive. That offense is a Class C misdemeanor.

The National Center for Missing & Exploited Children describes online enticement and common grooming tactics. Fake profiles and online impersonation can also become part of a case. A lawyer reviews those facts together with the rest of the record.

Questions to answer before talking with a lawyer

Gather the paperwork first. Start with the charging papers, any order, plea or bond terms, supervision conditions, registration records, and the accounts or messages involved.

Write down the dates and the exact wording of each condition. Note which platforms were used and whether any account names were registered. Small wording differences can change what a condition covers.

If a minor is involved, note that § 21.19 contains no minor-related defense; it applies to a person who knowingly transmits by electronic means visual material that depicts any person engaging in sexual conduct or with the person’s intimate parts exposed, or covered genitals of a male person that are in a discernibly turgid state, and that the recipient did not request or consent to receive. Texas law sets out the elements of online solicitation of a minor, and a lawyer can explain how they may or may not apply to the facts.

Attorney responsible for this site: Heather Barbieri, Barbieri Law Firm, Frisco, Texas.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk with a Texas criminal defense lawyer about your situation

Questions about online limits often come up at a frightening moment.
