Under that section, the offense is a Class B misdemeanor unless prior convictions raise the level. This page explains what happens if you get done for indecent exposure in Texas, from the first report through court dates and possible penalties. It gives you the process so you can ask better questions. It does not predict how any case will end.

What Texas law says about indecent exposure

Texas defines indecent exposure as exposing the anus or genitals with intent to arouse or gratify sexual desire. The person must also be reckless about whether someone is present who would be offended or alarmed.

The statute sets out the elements of the offense and the penalty levels, including increased penalties for prior convictions. A criminal case involves evidence presented by both the state and the defense. The first is intent. The second is recklessness about whether another person is nearby and would be offended or alarmed.

That’s why the facts of each report matter. Two people can describe the same moment in very different ways. Who was nearby, what they saw, and what the person meant all become central questions.

If you're waiting on a court date or trying to help someone who was just charged, you don't have to sort it out alone. Under § 21.08, indecent exposure is a Class B misdemeanor unless an enhancement applies.

The level goes up with prior history. One prior conviction under the section makes it a Class A misdemeanor. Two or more prior convictions make it a state jail felony. A civil commitment as a sexually violent predator makes it a third-degree felony.

A Class B misdemeanor carries a fine up to $2,000, jail time up to 180 days, or both, under Texas Penal Code § 12.22. A Class A misdemeanor carries a fine up to $4,000, jail up to one year, or both, under Texas Penal Code § 12.21.

Don’t assume the lowest or highest level. Read the charging papers closely. They show exactly what the state alleges and which level it uses.

What happens right after a report: citation, arrest, or investigation

Right after a report, the first contact is often a citation, an arrest, or an open investigation with no arrest yet. Each path leads to different next steps, so know which one applies to you.

Police may send a report to a prosecutor. The prosecutor decides whether to file a formal charge. That charge is the document that starts the case in court.

A person who is arrested usually goes before a magistrate, who sets bond conditions. Those conditions can limit contact with certain people or places. Read them closely and follow every term.

Timing matters too. Under Penal Code § 12.02, offenses are designated as felonies or misdemeanors. Separately, Code of Criminal Procedure art. 12.02 sets time limits for presenting certain misdemeanor charges. A case can move slowly, so stay alert to new paperwork.

How an indecent exposure case moves through Collin County and DFW courts

A case usually moves through several court settings over time, not in one hearing. Expect more than one date.

The first setting is often where the charge is read and the next date is set. Arraignment comes next. Then discovery begins, which is the exchange of evidence such as police reports, video, and witness statements.

Negotiations and pretrial motions follow. Trial comes later only if the case is not resolved earlier. Each court sets its own schedule, so dates can differ across Collin County and other Dallas-Fort Worth counties.

Crime victims also have a stake in how a case is handled.

Reviewing discovery early matters. The report and any video often shape which options are on the table.

Possible penalties and long-term consequences

Penalties follow the class of the charge and any prior convictions. Deferred adjudication may also be possible for some people.

Under Code of Criminal Procedure art. 42A.101, a judge may defer further proceedings after a plea and a finding that the evidence supports guilt. The judge must find that this serves the best interest of society and the defendant.

Whether a judge may grant deferred adjudication community supervision depends on the specific offense charged. A judge may grant deferred adjudication unless one listed exception applies.

If supervision ends without an adjudication of guilt, the judge must dismiss and discharge the case under art. 42A.111. Texas Code of Criminal Procedure Art. 42A.111 reads: “(b) The judge may dismiss the proceedings and discharge a defendant before the expiration of the period of deferred adjudication community supervision if, in the judge’s opinion, the best interest of society and the defendant will be served, except that the judge may not dismiss the proceedings and discharge a defendant charged with an offense requiring the defendant to register as a sex offender under Chapter 62.” Except as provided by Section 12.42(g) of the Penal Code, a dismissal and discharge is not treated as a conviction for disqualifications or disabilities imposed by law for conviction of an offense.

Records are a separate issue. They can also affect criminal-history checks for jobs or licenses.

Registration works differently. Other consequences, such as school, work, or licensing effects, depend on the facts of your case.

Quick answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is it illegal to show your privates in public in Texas?

Exposing the anus or genitals with the intent and recklessness described in § 21.08 is a criminal offense.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long does the state have to file the charge?

Penal Code § 12.02 designates offenses as felonies or misdemeanors, while Code of Criminal Procedure art. 12.02(a)(1) sets a two-year limit, from the date of the offense, for presenting an indictment or information for a Class A or Class B misdemeanor.
</details>

When the report involves a child, a minor, or online conduct

A report involving a child, a minor, or online messages can lead to different charges and a different investigation. That includes email addresses, chat names, and social media user names. Chapter 62 also lists child grooming as a reportable offense.

If a report includes these facts, the charges may be more serious. These questions often decide how the case is reviewed.

A defense review often looks at several points. These include intent, whether anyone was present, and how close they were. They also include what each witness says they saw, who is identified, timing, location, and whether the evidence is reliable.

A lawyer reviews the police report, any video, witness accounts, and the charging documents. Then the lawyer explains the options that exist. No lawyer can predict the result with certainty.

Questions about a criminal case and questions about a civil claim can arise from the same events. Whether a civil claim applies turns on the facts of your situation.

Steps that can protect your position now

Keep every court paper, bond term, and date in one place. Attend every court setting, even if the case seems small.

Avoid discussing the facts with police, the complainant, or anyone on social media. Words said or posted can later be repeated to the court.

Talk with a lawyer before you answer questions about what happened. Tell your lawyer about any date you cannot attend, so it can be handled before it is missed.

These are general steps. The right next move turns on your own case.

Talk with Barbieri Law Firm about your situation

If you were just cited or arrested, or you’re worried about someone you love, the waiting is hard.
