A polygraph records body responses while you answer questions, but it does not detect lies by itself. This page explains what the test is, why its results are contested, and what a lawyer should review before you decide. It is general information, not legal advice about your case.

What a Polygraph Is and What It Is Not

A polygraph is an instrument that records physical responses, such as breathing, heart rate, and skin reactions, while a person answers questions. It does not read minds. The machine records signals, and a person called an examiner decides what those signals mean. Two examiners can read the same chart differently, which is one reason results get challenged. The questions matter too. Their wording, order, and topics shape both the answers and the chart. A polygraph is an investigative step, not a finding of guilt or innocence. Anything you say during the exam, and any notes or reports about it, can end up in the investigation file. Wrongful convictions are studied closely.

If police have asked you to take a polygraph over online messages, you can talk with our firm about that request. A request from police is still a request, so read what it says before you act on it. Ask whether anything in writing requires you to sit for the test. The same caution applies to requests from the person who made the accusation, a family member, or a school official. Investigators may describe the exam as routine or as a chance to clear your name. That framing is their view, not a legal finding. Agreeing in the moment is the real risk. A quick yes, given under pressure, can commit you to a plan you have not studied. Take time to decide, with the case facts in view.

Can a Polygraph Result Be Used in a Texas Court?

Texas courts have long held polygraph results inadmissible in criminal trials. A lawyer can explain how Texas rules apply to your charge and your county, whether that is Collin County, Dallas County, or somewhere else. Even if a result never reaches a jury, the exam still creates a record. Notes, reports, and what you said can shape how the investigation moves. Do not assume a favorable-looking chart will end the matter, and do not assume an unfavorable one will decide it. Ask a lawyer to review the whole record, not just the chart.

Why Answering Before a Lawyer Reviews the Case Is Risky

Answering polygraph questions before a lawyer reviews the case can lock in facts that matter later. Under Texas Penal Code § 33.021, a minor means someone younger than 17, or someone the actor believes is younger than 17. The statute covers sexually explicit communication and sending explicit material when the actor is 17 or older and acts with intent to commit an offense listed in Code of Criminal Procedure art. 62.001(5)(A), (B), or (K), as well as knowingly soliciting a minor to meet for sexual contact. Each of these offenses turns on specific points, such as age, belief about age, content, and intent. Questions often track those points. A short yes or no can sound like more than you meant. The statute also says it is not a defense to the meeting offense that the meeting did not occur. School hours matter, too. The explicit communication offense is a third-degree felony, and the same statute raises it to a second-degree felony when the minor is younger than 14 or the actor believes the minor is younger than 14, or when the offense happens during regular school hours and the actor knew or should have known the minor was enrolled. Avoid deleting devices or messages, and discuss the exam only with a lawyer.

What a Lawyer Reviews Before Any Decision

A lawyer reviews the charge, the messages, and the exact questions before you decide anything about the exam. A typical early step is reviewing the accusation and any paperwork the person has received. Next comes the digital record: messages, timestamps, the age the other person gave, and any attachments. The lawyer also reads the wording of each requested question and asks who the examiner works for. An examiner tied to police is not the same as an independent one. Then the lawyer checks what you already told investigators, because earlier statements can shape later choices. After that review, the lawyer explains your options: declining, agreeing with written conditions, or proposing a different step. No lawyer can predict or promise a result. The goal is an informed choice you can stand behind later.

Talk With a Lawyer About Your Next Step

If a polygraph is on the table, the choice to agree or decline should happen before you answer any question. Your timing, your messages, and the exact wording of the requests all matter to that choice. You don’t have to make it alone or on the spot. Send your case details through the contact form, or call (972) 424-1902, and a lawyer can review the request with you.

Frequently asked questions

Can police make me take a polygraph? A police request for a polygraph during an investigation is generally voluntary, but some settings, such as supervision or treatment conditions, can require one, so ask a lawyer before you agree.

Does it matter if the meeting never happened? For soliciting a minor to meet, the Texas Penal Code § 33.021 says it is not a defense that the meeting did not occur.

Does school hours change the punishment? Yes, the statute can raise the punishment category if the state shows the offense happened during regular school hours and the actor knew or should have known the minor was enrolled.

Attorney responsible for this site: Heather Jean Barbieri, Barbieri Law Firm, Frisco, Texas.

This page is general information only and is not legal advice about your specific case.

Barbieri Law Firm, 17 Cowboys Way, Suite 175, Frisco, TX 75034.
