Texas Penal Code § 21.08 governs indecent exposure and sets out its penalty tiers. This page explains each part in plain language, along with the penalties and why the facts matter so much. It is general information, not advice about any one person’s case.

What Does the Texas Indecent Exposure Statute Say?

Texas Penal Code § 21.08 is the state law that defines indecent exposure. It applies when a person exposes his anus or any part of his genitals in the way the statute describes.

Under Texas Penal Code § 21.08, a person commits indecent exposure if he exposes his anus or any part of his genitals with intent to arouse or gratify the sexual desire of any person, and he is reckless about whether another is present who will be offended or alarmed by his act. Section 21.08(a) describes the conduct, the intent, and the recklessness that define the offense. If one part is missing from the proof, the statute’s own wording is not met.

The statute uses broad words, such as “any part” and “any person,” alongside more specific mental-state words.

The offense also changes in level. Section 21.08(a) defines the offense of exposing his anus or any part of his genitals with the required intent and recklessness. The penalty levels, which can be a misdemeanor or a felony depending on prior convictions or a civil commitment, are set out in subsection (b), not in subsection (a). The penalties section below covers those steps. For the wider picture of how sex crimes cases move through the system, read our Texas sex crimes defense guide.

If an indecent exposure accusation has reached your family, you don't have to sort out the facts alone; call Barbieri Law Firm at (972) 424-1902 to talk it through. It does not list clothing or nudity in general as its test. Disputes can arise over what was actually exposed and whether anyone saw it clearly.

Intent. Section 21.08(a) requires that the person act with intent to arouse or gratify the sexual desire of any person. The statute says “any person,” so the sexual desire at issue need not be the accused’s own.

Recklessness. Section 21.08(a) requires that the person be reckless about whether another is present who will be offended or alarmed by his act. The next-to-last section below explains this element in more detail.

A lawyer reviewing a case checks each element against the evidence.

How Does Intent Matter in a Texas Indecent Exposure Case?

Intent is the part of the offense that turns on what the person was trying to do.

The State must prove the person acted to arouse or gratify sexual desire. Exposure alone does not match the statute’s wording. Intent and recklessness are different tests. A person can be reckless about others being present without the sexual intent the statute requires. The State must prove both.

The State may point to surrounding circumstances. Those can include what the person did before and after, what was said, where it happened and how people reacted.

A defense lawyer looks at the full sequence of events, not one moment in isolation. One common defense is lack of sexual intent. That defense argues the exposure had a different, non-sexual explanation. How intent is assessed depends on the facts of each case.

Recklessness About Who Might See: Does the Presence of Others Matter?

Yes. The State must show the person was reckless about whether another person was present who would be offended or alarmed.

Texas law defines “reckless” in a separate part of the Penal Code. The definitions section points to Section 6.03 for culpable mental states (Texas Penal Code § 1.07). Reckless is a different test from intent, so each needs its own proof.

This element often turns on the setting. Location, visibility, time of day and whether anyone was nearby are facts that get examined. If witnesses disagree about what could be seen, this element can become the center of the dispute.

Questions a lawyer may ask include where the person was, who could see the area, and what each witness actually observed.

What Are the Penalties for Indecent Exposure in Texas?

The base offense is a Class B misdemeanor, and prior convictions or a civil commitment can raise it.

One prior conviction under § 21.08: Class A misdemeanor. A Class A misdemeanor carries a fine up to $4,000, jail for up to one year, or both (Penal Code § 12.21).

Two or more prior convictions under § 21.08: state jail felony. Confinement in a state jail runs from 180 days up to two years, and a fine up to $10,000 may also be imposed, unless subsection (c) applies, for example a deadly weapon finding or certain prior felony convictions, in which case third-degree felony punishment applies (Penal Code § 12.35).

Under § 21.08(b)(3), the offense is a third-degree felony if the actor is civilly committed as a sexually violent predator under Chapter 841, Health and Safety Code.

Under § 12.35, a state jail felony is punished by confinement in a state jail for not more than two years or less than 180 days. Under § 12.44, a court may instead punish it by Class A misdemeanor confinement if it finds that such punishment would most appropriately serve the ends of justice. It must find that this serves the ends of justice, after weighing the offense and the person’s history (Penal Code § 12.44). At the prosecutor’s request, the court may also let the State prosecute a state jail felony as a Class A misdemeanor.

Prior convictions can also be used again for enhancement later (Penal Code § 12.46). The penalty in any one case depends on the charge and the person’s record.

Mistaken Identity, Insufficient Evidence and Reviewing the Evidence

Each element can be tested against the evidence. That includes who was involved, what was seen and whether the State can prove it.

Accusations can rest on identification, timing, location or witness accounts. A person may be mistaken for someone else. A witness may have seen the scene from far away or only at a glance. Each of these points can be examined.

Timing can matter too. If the State’s account of when and where something happened does not match other records, that gap is a fact to examine.

Insufficient evidence is a separate question. A defense lawyer tests that proof rather than accepting it at face value.

We will review the evidence, including any video, witness statements and police reports, and explain your options. No lawyer can promise an outcome.

After an arrest, a magistrate hearing is one of the first steps. Records can also follow a person. According to the Texas Department of Public Safety, arrest and conviction records may remain publicly accessible and may affect criminal-history checks for employment or professional licensing (Texas DPS criminal history FAQ).

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Where You Are Now, and How to Reach Out

You may be reading this after a police contact you did not expect.
