The offense covers recording an intimate area of another person, if that person has a reasonable expectation that the area is not subject to public view, or recording a person in a place where they have a reasonable expectation of privacy, without consent and with intent to invade privacy. It is a state jail felony. If you need an improper photography or visual recording defense lawyer Texas, start with the facts of your case.

What Is Invasive Visual Recording Under Texas Penal Code 21.15?

Invasive visual recording is a Texas offense for recording certain private images of a person without consent. Under Texas law, a person commits an offense if, without the other person’s consent and with intent to invade the other person’s privacy, the person does one of the following:

Without the other person’s consent and with intent to invade their privacy, a person who records an intimate area of another person by photograph, videotape or other electronic means, when the other person has a reasonable expectation that the area is not subject to public view, commits an offense.

Without the other person’s consent and with intent to invade their privacy, a person who records a visual image of another person in a place in which a person has a reasonable expectation of privacy commits an offense.

The statute defines “intimate area” to include the naked or clothed genitals, pubic area, anus, buttocks or female breast. It defines “changing room” to include dressing rooms, locker rooms and swimwear changing areas.

The state must prove more than a picture exists. It must show the recording, the lack of consent, the privacy setting and the intent to invade privacy.
