It applies to school employees who engage in certain sexual conduct with a student. This guide explains the charge. It also covers what an improper relationship between educator and student defense lawyer reviews, and how Barbieri Law Firm in Frisco, Texas approaches these cases.

What an Improper Relationship Charge Means for Educators

A charge of improper relationship between an educator and a student is a criminal offense under Texas law. The statute applies to an employee of a public or private primary or secondary school.

It covers sexual contact, sexual intercourse, or deviate sexual intercourse with a student enrolled at the school where the employee works. It also reaches a student enrolled at another school, and a student taking part in a school-sponsored activity if students enrolled in a public or private primary or secondary school are the primary participants in the activity, but only when the employee holds a position described by Section 21.003(a) or (b), Education Code, and knows the student is enrolled at that other school or is a student participant in the activity.

Under Texas Penal Code § 21.12, an employee can commit an offense by engaging in conduct described by Section 33.021 with a student enrolled at the school where the employee works, or with a person the employee knows is an enrolled student at another school or a student participant in a school-sponsored activity, regardless of that person’s age; Section 33.021 itself defines a minor as an individual younger than 17 or whom the actor believes to be younger than 17.

An investigation can start with a school report, a parent complaint, a police referral or a message found on a device. None of those steps alone means a charge has been filed.

A criminal case and a school review run on separate tracks.

If a school notice or a call about a student has you worried about your job and your future, you do not have to face it alone. That includes teachers, coaches, aides, counselors, administrators and other school staff.

Family members who are helping an employee read a notice, a police request or a complaint can use this guide too. If a school administrator or detective has called, talk with a lawyer before you answer questions about messages or contact with a student. Statements can be used later.

The statute also limits who can learn about a case. Under Texas Penal Code § 21.12, the name of an enrolled person involved in such a relationship may not be released to the public. A school generally may not release an accused employee’s name to the public until the employee is indicted, with exceptions for reporting and investigation.

Barbieri Law Firm defends sex crimes and assaultive offenses across Collin County, Dallas-Fort Worth and Texas. This matter fits within that criminal defense work.

What We Review in an Improper Relationship Case

We start with the exact allegations, then build a timeline from the records. Each record can show a different part of the story.

The complaint or charging papers, including the dates and places the State names.

School records showing the employee’s position and the student’s enrollment, such as schedules, rosters and assignments.

Text messages, social media messages, emails and call logs, including who sent what, when, and from which account or device.

Any recorded or written statements from interviews.

School records can show dates and schedules that the complaint may not mention. The timeline shows where the State’s account and the documents agree or differ. We also review how any phone or account evidence was collected.

Texas Penal Code § 21.12 sets out affirmative defenses to prosecution under this section. The first applies when the actor was the spouse of the enrolled person at the time of the offense. The second applies when the actor was not more than three years older than the enrolled person and, at the time of the offense, the two were in a relationship that began before the actor’s employment at any public or private primary or secondary school.

How the Defense Process Works

The process moves in stages, from the first consultation through evidence review to court. Each stage builds on the one before it.

Consultation. We hear the facts, review the documents you have, and explain what to gather next.

Early guidance. We advise you on contact with the student, school staff, parents and police. We also cover requests for interviews, school meetings and documents, and what to say to investigators.

Evidence review. We review the complaint, school records, messages and any interview recordings. Then we explain your options at that stage.

Prosecutor communication and court dates. We discuss the evidence with the prosecutor and prepare for hearings. After a guilty or no-contest plea, a judge may in some cases place a defendant on deferred adjudication community supervision, without entering an adjudication of guilt.

Trial preparation. If the case does not resolve earlier, we prepare for trial and keep you informed at each stage.

Timing comes in stages, not fixed days. The pace depends on how quickly records are produced and how the court calendar moves.

Why Barbieri Law Firm for This Matter

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas.
