Not automatically. Whether you lose it depends on four things: your employer’s written policy, the specific charge and where the case stands, what records show when someone checks, and whether your work is licensed or regulated. No lawyer can predict how a particular employer will respond. Look in your employee handbook, code of conduct, and any form you signed when you were hired. Check what they say about criminal charges, arrests, and reporting. Some policies require you to tell a supervisor or human resources about an arrest or charge within a set time. Others say nothing on the topic. Some employers follow written steps for reviewing a criminal matter. Others decide case by case. Your job contract and any applicable law also matter. Write down what each document says, with the section number and date. Keep copies at home, not only on a work device. A policy shows the rules your employer has set. It doesn’t show how your employer will apply them to your situation.

Background checks and public records can show different things

Criminal records can appear in a background check, but what appears varies. A check may show an arrest, a filed charge, a pending case, or a final result. Each one can read differently to the person reviewing it. What a search returns depends on the source, the county, and the date the check runs. Background check companies gather information from different places, so two checks can show different results. A check run during a pending case may look different from one run after the case closes. Not every sex-related charge creates the same record. The offense and its grade matter. Texas classifies offenses as felonies or misdemeanors (Texas Penal Code § 12.02). A felony charge can look more serious on a record than a misdemeanor. Before you assume what a check will show, review the exact charge and the county records together.

Licensed and regulated jobs add a second layer of risk

Licensed jobs carry more risk, because the agency that issues the license can act on it. Teaching, nursing, childcare, coaching, and security work often require a license or certificate. Some offenses target people in specific roles. For example, an improper relationship between a school employee and a student is a second-degree felony under Texas Penal Code § 21.12. That statute also includes its own affirmative defenses, and those come with conditions. Each profession has its own licensing agency and rules, and those rules control. Check the current requirements for your license directly with the agency that issues it. A charge in a regulated field can raise questions about the license itself, not only about the job.

Online conduct and work devices can start a separate review

An employer can look into allegations involving a work device, work account, or company network. Company rules on technology use may apply to that review. Don’t delete, move, or change anything on a work phone, laptop, email, or messaging account. Doing so can create a separate problem and can look like hiding something. An internal review can run on its own timeline, apart from the criminal case. An employer may ask questions the police never asked. Online conduct can also be a crime. Online solicitation of a minor can be a second-degree felony, depending on the conduct and the minor’s age (Texas Penal Code § 33.021). Don’t assume an employer’s review is limited to what the police have.

How the stage and outcome of a case change what employers see

The stage of a case and how it ends can change what becomes public and when. A case may move from investigation to arrest, then charging, pretrial release, court settings, and a final result. The record can look different at each stage. Which path a case takes depends on the facts, the evidence, and the court. We can review the specific charge with you and explain what it may mean in your situation. Aggravated sexual assault, for instance, is classified as a first-degree felony in Texas (Tex. Penal Code § 22.021(e)). How a defense develops can affect what becomes public and when. That doesn’t mean a particular result is available or likely. No lawyer can ensure a specific outcome, and the consequences for any person depend on that person’s facts.

Not sure what your next step is?

Talk it through with Barbieri Law Firm.

Get a free consultation

Get a free consultation

Practical steps while your case is pending

Limit what you say about the case at work and online until you understand the risks. Comments to coworkers, a supervisor, or on social media can be repeated or recorded. Follow every bond or release condition exactly. Those conditions must relate to the safety of a victim or the community. The specific conditions vary from one order to another, so the exact wording of each order matters. Read your conditions closely, especially any limits tied to travel or equipment. Keep a personal file of notices, dates, and written messages from your employer.
