Under the exposure provision, the person must act with intent to arouse or gratify sexual desire. If the person exposes the person’s own anus or genitals, the person must know the child is present. If the person causes the child to expose the child’s anus or genitals, that knowledge element does not apply.

Touching is a different form of the offense. This guide explains each piece in plain words.

If someone you care about has been accused, or you just learned a report was made, the questions come fast. Let’s take them one at a time.

What Texas Law Says Indecency With a Child by Exposure Is

Exposure is one form of indecency with a child. The statute covers exposure and touching as separate acts, and the child must be younger than 17.

The statute says a person commits an offense if, with a child younger than 17, the person does one of the listed acts. The age rule applies whether or not the person knows the child’s age at the time.

The name “indecency with a child” covers several kinds of conduct. The subsection named in the charge tells you which conduct the State says happened, so read it closely.

If a charge like this has reached someone you love, you don't have to face it alone. It can also mean causing the child to expose the child’s own anus or genitals.

The statute refers to exposing the person’s anus or any part of the person’s genitals. The wording of the charge and the police reports carry real weight.

Touching is a different category. Under § 21.11(c), “sexual contact” means, when done with intent to arouse or gratify sexual desire, either touching the anus, breast, or genitals of a child, including through clothing, or touching any part of a child’s body with the anus, breast, or genitals of a person, including through clothing. That conduct falls under subsection (a)(1), not exposure.

A single report can describe both exposure and touching.

The Intent and Child-Presence Requirements

The exposure provision in Texas Penal Code § 21.11 requires intent to arouse or gratify the sexual desire of any person. When the person exposes the person’s own anus or genitals, the person must also have known the child was present.

Intent means the person acted to arouse or gratify the sexual desire of any person. Intent is a state of mind. Prosecutors usually prove it from what was done, what was said, and the setting around the act.

Under the exposure subsection, a person who exposes the person’s own anus or genitals must know the child is present. With intent to arouse or gratify the sexual desire of any person, the statute covers exposing the person’s anus or any part of the person’s genitals, knowing the child is present, or causing the child to expose the child’s anus or any part of the child’s genitals (Texas Penal Code § 21.11). Whether the child was present and whether the person knew it are separate questions.

A child’s account is often central. Children’s Advocacy Centers of Texas coordinate forensic interviews within a multidisciplinary response and offer a child-friendly setting. Professional guidance from the OJJDP child abuse investigations resource favors open-ended questions and avoids repeated questioning. A careful review looks at how the statement was gathered, not only what it says.

The statute also lists affirmative defenses. Texas law makes it an affirmative defense to indecency with a child that the actor was not more than three years older than the victim and of the opposite sex, did not use duress, force, or a threat against the victim, and, at the time of the offense, was not required to register for life as a sex offender under Chapter 62, Code of Criminal Procedure, or had no reportable conviction or adjudication under that chapter. It also requires no duress, force, or threat, and the registration conditions the subsection lists. Whether any defense applies depends on the facts.

How Exposure Differs From Indecent Exposure Under §21.08

Indecency with a child by exposure requires a child under 17. Indecent exposure does not require a child at all.

Section 21.08 applies when a person exposes the anus or genitals with intent to arouse or gratify sexual desire. The person must also be reckless about whether another person is present who will be offended or alarmed.

The awareness standards differ. Subsection (a)(2)(A) requires that the person know the child is present when exposing the person’s anus or any part of the person’s genitals, while subsection (a)(1), which covers engaging in sexual contact with the child or causing the child to engage in sexual contact, contains no such element (Texas Penal Code § 21.11). Section 21.08 requires recklessness about whether someone is present who will be offended or alarmed.

The base level of § 21.08 is a Class B misdemeanor. It rises to a Class A misdemeanor after one prior conviction under that section. It becomes a state jail felony after two or more prior convictions.

Because the two statutes have different elements, the statute named in the charge matters. A label like “indecent exposure” alone does not show which law the State charged.

Penalty Level for an Exposure Charge

An exposure offense under § 21.11(a)(2) is a third-degree felony. Section 21.11(d) sets that level. The contact form under (a)(1) is a second-degree felony in the same subsection.

Under § 12.34, a third-degree felony carries imprisonment in the Texas Department of Criminal Justice for not more than 10 years and not less than 2 years. The law also allows a fine of up to $10,000 in addition to imprisonment.

The child’s age is the first question. A lawyer also reviews the facts alleged and any prior record when reading the charge and the penalty range. No one can say in advance how a case will end.

Why the Facts Around the Accusation Matter

Exposure accusations often rest on a child’s statement, a parent’s report, or an account from someone who saw something. Timing, setting, and who was present get close review.

When a report reaches Texas Child Protective Services, the investigation can include an ongoing child-safety assessment. The DFPS CPS handbook describes this basic investigation process.

A lawyer compares each account with the reports and any recordings in the file. The review looks at dates, places, and who was in the room. The goal is to understand what the State can actually prove.

Family questions often come up alongside a charge. These can include questions about contact with children in the family. Those questions can be raised during a consultation.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk Through Your Situation With Barbieri Law Firm

Yes.
