The new charge, the prior conviction and the dates of each case all shape what the state can seek.

This page covers online sex-related charges that Barbieri Law Firm defends. Those include online solicitation of a minor and possession or promotion of child pornography. It is written for three readers: the person accused, a partner or parent trying to understand a notice, and someone who was arrested or contacted by police and wants to know what comes next.

Many people feel rushed and confused at this stage. Legal notices use terms that are hard to read. Knowing the main rules helps you ask better questions.

This is general information, not a prediction of how any case will end. Each case turns on its own charge, record and evidence.

How a Prior Conviction Can Enhance the Penalty

A prior felony conviction can raise the punishment range for a new felony. Texas calls this enhancement.

For a first-degree felony, the base punishment range comes from Penal Code § 12.32, not from the repeat-offender enhancements:

A first-degree felony is punishable by life, or by 5 to 99 years, in prison (Penal Code § 12.32). The same section sets those terms.

Some online offenses start higher. Under Penal Code § 33.021, knowingly soliciting a minor to meet for sexual contact is a second-degree felony. A first charge can already sit in the second-degree range.

Two more points matter. The prior conviction must be shown at trial. A conviction used for enhancement can still be used later, under Penal Code § 12.46.

Sex Offender Registration and Conditions That Can Follow

Registration can follow a conviction for certain online sex offenses. Chapter 62 of the Texas Code of Criminal Procedure defines a reportable conviction. See Chapter 62 definitions.

The end of the duty follows the expiration rules in Chapter 62. For possession or promotion of child pornography, the chapter lists the duty as ending at death, subject to its exceptions. For an offense other than one described by Subsection (a), the duty to register ends as provided in Subsection (c), subject only to Subchapter I. If the duty is based on a conviction or an order of deferred adjudication, the duty runs until the 10th anniversary of the date the person is released from a penal institution, discharges community supervision, or has the criminal proceedings dismissed and is discharged, whichever date is later. If the duty is based on an adjudication of delinquent conduct, it runs until the 10th anniversary of the date the disposition is made or the person completes its terms, whichever date is later.

Removal is governed by Chapter 62 and turns on the offense and the record. The end date is set by the rules in that chapter for each offense.

Registration is one set of duties. Your case papers and any supervision order will list others. Read them closely and track every date in writing while the case is pending. Missing a deadline or breaking a rule can create a new problem.

Probation and Sentencing Questions for a Second-Degree Felony

A second-degree felony in Texas carries 2 to 20 years in prison. Penal Code § 12.33 also allows a fine up to $10,000. Probation is a separate question, and the answer turns on the charge, the record and the sentence.

Several limits matter:

A judge may not order community supervision when the sentence exceeds 10 years, under art. 42A.053.

Under Penal Code § 12.35(a), a state jail felony is punishable by confinement in a state jail for not more than two years or less than 180 days, and Subsection (b) allows a fine not to exceed $10,000. Subsection (c) raises the offense to a third-degree felony if a deadly weapon was used or exhibited, or if the person was previously finally convicted of a felony under § 21.02 or § 21.03 or one listed in Article 42A.054(a), Code of Criminal Procedure, or of a felony for which the judgment contains an affirmative finding under Article 42A.054(c) or (d). It does not address community supervision eligibility, which is in Art. 42A.053.

Deferred adjudication is allowed in many cases. The statute lists exceptions, including some repeat cases, under art. 42A.102.

Under art. 42A.053, a judge decides in the interest of justice, the public and the defendant. A defense lawyer may also talk with the prosecutor about plea options. Each option has its own consequences, including whether registration follows, so review them carefully before deciding.

How the Defense Is Built: Digital Evidence and the Process

An online case is built on digital records, so the defense starts there. Many cases begin with a tip. The CyberTipline of the National Center for Missing & Exploited Children reviews reports of suspected online child exploitation. It refers them to law enforcement for possible investigation.

The federal ICAC Task Force Program supports investigation of technology-facilitated child sexual exploitation.

A lawyer reviews the tip source, any IP address records, the devices and accounts, the messages, the search warrant and how police linked an account to a person. Each piece can raise questions.

Age claims in messages matter. Under Penal Code § 33.021, a minor includes a person the accused believes to be under 17. What the accused believed about age is part of the review.

The process usually follows these steps:

An initial consultation, where you share the notice or charging papers.

Review of the charge, the prior record and the penalty range.

Review of the evidence and any warrant.

A strategy discussion about your options.

Negotiations, motions or trial preparation, as the case requires.

Early steps come first, such as reviewing papers and requesting evidence. Negotiations and hearings may follow over several months, depending on the court’s calendar.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Barbieri Law Firm Handles These Cases

Barbieri Law Firm is an all-women criminal defense firm based in Frisco, Texas.
