It depends on the exact charge. For a Texas sex offense charged as a felony, the felony level sets the prison range. A first-degree felony can carry life or a term of 5 to 99 years, under Texas Penal Code § 12.32. This guide explains the main ranges, what can move them, and how registration works. It is general information, not advice about any one case.

Why the answer depends on the specific charge

The same conduct can sometimes fall under more than one statute.

Texas sets each felony level in the Penal Code. Each level has its own prison range and fine. In Texas, a person adjudged guilty of a second-degree felony faces a prison term of no less than 2 years and no more than 20 years, and a fine of up to $10,000 may be imposed in addition to imprisonment.

Punishment only follows a finding of guilt or a plea. The statute is also a first-degree felony in certain listed situations. It lists when conduct counts as without consent, such as force, threats, or inability to resist.

Aggravated sexual assault is a first-degree felony under § 22.021. The minimum prison term rises to 25 years if the victim is younger than 10. It also rises if the victim is younger than 14 and the case involves a listed aggravating act. Those acts include serious bodily injury, a deadly weapon, threats, acting with another person, and a substance that impairs the victim.

Indecency with a child is covered by § 21.11. Sexual contact is a second-degree felony. Exposure is a third-degree felony. The statute includes an affirmative defense for an actor no more than three years older than the victim, if listed conditions are met.

Online solicitation of a minor is covered by § 33.021. Sexually explicit communication with a minor is generally a third-degree felony. It becomes a second-degree felony when the minor is younger than 14, or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense. Soliciting a minor to meet for sexual contact is a second-degree felony. If the offense happens during school hours and the actor knew or should have known the minor was enrolled, the punishment moves to the next higher category.

Factors that can raise or lower a sentence

Prior convictions can raise the range. Texas Penal Code § 12.46 says a conviction used for enhancement can still be used for enhancement later. The alleged victim’s age matters, too.

Weapons, injury, and threats can move a case into a higher range. Section 22.021 lists those acts, as shown above. The charging document shows which facts the state alleges.

The facts of each case decide which factors apply. A plea agreement can change what the state recommends. The judge still works within the range set by statute. No lawyer can promise how a case will end.

Prison, jail, and community supervision

Prison is the main range for first- and second-degree felonies. A state jail felony is a lower category. It generally carries confinement in a state jail for 180 days to two years, under § 12.35. It is punished as a third-degree felony instead if it is shown at trial that a deadly weapon was used or exhibited during the offense or the immediate flight after it, and the person used or exhibited it or was a party to the offense and knew a deadly weapon would be used or exhibited, or if the person has certain prior felony convictions.

For §§ 21.11, 22.011 and 22.021, a judge may place a defendant on deferred adjudication only after making an open-court finding that it is in the victim’s best interest (art. 42A.102(a)). Deferred adjudication is a separate path. Subsection (b) lists exceptions. One exception covers aggravated sexual assault punishable under the 25-year minimum. Another covers a defendant previously placed on community supervision for these offenses.

Know the conditions before you accept any order.

Sex offender registration: a separate consequence from prison time

Code of Criminal Procedure art. 62.101 sets how long the duty lasts. Subsection (a) lists offenses where, if the person has a reportable conviction or adjudication, other than an adjudication of delinquent conduct, for the offense, the duty to register ends when the person dies, except as provided by Subsection (b) and Subchapter I.

For offenses not listed in subsection (a), a different rule applies.

The length of those duties depends on the offense and how the case was resolved.

What to bring to a first conversation about the possible sentence

Bring the charging document, bond paperwork, and any bond or protective conditions. Write a timeline of events while you still remember them. Include dates, places, and who was involved. Note any contact with police or prosecutors, including who spoke and when.

A lawyer will review the evidence, the charges, the possible ranges, and your options.
