What Counts as an Online Sex Crime Allegation in Texas?<\/h2>\n

Online sex crime allegations usually involve sexual messages, images or requests sent over the internet or a phone. The charge depends on the people involved, what was sent, and the intent alleged.<\/p>\n

Under subsection (b) of Texas Penal Code \u00a7 33.021<\/a>, a person who is 17 or older commits an offense by intentionally communicating in a sexually explicit manner with a minor, or distributing sexually explicit material to one, with intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure. Subsection (c) applies to any person who, over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service, knowingly solicits a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person.<\/p>\n

Sexually explicit material sent to a minor can also fall under \u00a7 33.021(b)(2)<\/a>, which covers distributing such material to a minor when the sender has the intent described in subsection (b). Texas Penal Code \u00a7 21.19<\/a> makes it an offense to knowingly transmit by electronic means visual material that depicts any person engaging in sexual conduct or with the person’s intimate parts exposed, or covered genitals of a male person in a discernibly turgid state, when the material is not sent at the request of or with the express consent of the recipient. That offense is a Class C misdemeanor.<\/p>\n

How Online Sex Crime Cases Usually Start<\/h2>\n

Most of these cases start with a report, a tip or a police sting. Each path looks different from the outside.<\/p>\n

A messaging app may flag an account and report it. Reports about suspected online child exploitation can go to the NCMEC CyberTipline<\/a>. The center reviews tips and refers them to law enforcement for possible investigation. For more on this path, read our messaging app report guide<\/a>.<\/p>\n

In a sting, an officer talks online with a suspect while posing as someone the suspect believes is a minor. Federal task forces also investigate these cases. The ICAC Task Force Program<\/a> describes its role in investigating technology-facilitated child sexual exploitation.<\/p>\n

A tip from another person can also start an investigation. That tip may come from a family member, a friend, or someone who saw a message.<\/p>\n

A report is not a filed charge. An account being reported does not mean charges exist. Nobody can predict how a case will end from a report alone.<\/p>\n

Is Sexting a Crime in Texas?<\/h2>\n

Sexting is not automatically a crime in Texas. The answer turns on the age of the people involved, whether the material was wanted, and what was sent.<\/p>\n

Under Texas Penal Code \u00a7 21.19<\/a>, knowingly transmitting by electronic means certain visual material to a recipient who did not request it or give express consent is an offense, when the material depicts sexual conduct, exposed intimate parts, or covered genitals of a male person in a discernibly turgid state. That offense is a Class C misdemeanor. Sexually explicit communication with a minor, or with someone the accused believed was a minor, can fall under \u00a7 33.021(b)(1)<\/a> when it is intentional and made with the intent described in subsection (b). That statute carries a felony penalty.<\/p>\n

An exchange between adults can still become part of an investigation if someone complains. That is why the messages themselves matter. A lawyer needs to read the full thread, including the timing and the context, before anyone draws conclusions.<\/p>\n

Should You Talk to Police? What You Can and Cannot Control<\/h2>\n

You can’t control what officers do next, but you control what you say.<\/p>\n

That includes casual talk, a friendly tone, or a short explanation given at the door. Statements made in the first hours can shape a case. Decide with a lawyer, not under pressure on the phone or at the door.<\/p>\n

Entrapment is a defense only in a narrow set of cases. Under Texas Penal Code \u00a7 8.06<\/a>, it is a defense to prosecution that the actor engaged in the conduct charged because he was induced to do so by a law enforcement agent using persuasion or other means likely to cause persons to commit the offense. Conduct that only gives a person an opportunity to commit an offense is not entrapment. A lawyer checks how the contact began before deciding whether that defense fits.<\/p>\n

Do not lie to officers. Treat your rights as protections you can use.<\/p>\n

Protecting Evidence, Your Accounts and Your Relationships<\/h2>\n

Don’t delete messages, close accounts, or contact the person who made the report until you have spoken with a lawyer. Deleting material can make your situation harder to explain, even when you meant well.<\/p>\n

Avoid posting about the allegation online. Social media posts can be read as admissions, and they can reach the person involved.<\/p>\n

If you are released on bond, check every condition. Texas Penal Code \u00a7 25.07<\/a> covers violating certain court orders or conditions of bond in a family violence, child abuse or neglect, sexual assault or abuse, indecent assault, stalking, or trafficking case. It applies when a person communicates with a protected individual in a way the order prohibits. A short message to a protected individual or a member of the family or household, even an apology, can create a new problem under this section if it is threatening or harassing, or if the order prohibits any communication with them.<\/p>\n
