Not in the way many people assume. Texas law addresses the unlawful disclosure or promotion of intimate visual material, including disclosing such material without the depicted person’s consent and with intent to harm that person.

This guide explains what that statute covers, the questions that decide whether it applies, and what to do if you have been contacted or accused. It is general information, not a view on any specific situation.

The Short Answer: Private Adult Sexting and Texas Law

Sexting between adults is not, by itself, the offense of unlawful disclosure or promotion of intimate visual material.

Two adults who trade private messages and photos have not disclosed anything to anyone. The legal risk usually begins when someone forwards, posts, or sends that image to other people.

The questions that matter are who shared the image, with whom, and why.

A photo kept between two people is a different situation from one sent into a group chat, posted online, or shown to a coworker.

This guide is general information. It does not predict how any case would end.

If an image you sent is now in someone else's hands, or you've been accused of sharing one, you don't have to face it alone. Under § 21.16(b), the disclosure offense requires that the disclosure be made without that person’s effective consent and with intent to harm them.

The statute lists required elements in subsection (b). The person must disclose the material without effective consent and with intent to harm. The person must also know, or have reason to believe, at the time of the disclosure, that the image was made or obtained under circumstances where the depicted person reasonably expected it to stay private.

The disclosure must also cause harm to the depicted person. It must reveal that person’s identity in some way.

The statute defines some key words. Intimate parts means the naked genitals, pubic area, anus, buttocks, or female nipple of a person. To promote includes sending, giving, transmitting, distributing, publishing, or offering to do any of these things.

A digital file counts as visual material if it can be displayed on a screen. The offense is a state jail felony.

Consent: Sending a Photo Versus Sharing It

Under Texas Penal Code § 1.07, consent means assent in fact, whether express or apparent.

Consent is not effective if it was induced by force, threat, or fraud. That rule can matter when a sender was pressured or deceived.

Agreeing to make an image does not, by itself, cover sharing it later.

Disputes often center on whether the depicted person agreed to the disclosure that actually happened. A breakup, a group chat, or a shared phone or cloud account can change who had access and what was agreed to. That is why the facts of each exchange matter.

Keep track of what you remember about how the image was sent and who could see it. Share those details with your lawyer.

Identifiability and Intent: The Two Questions Prosecutors Look At

Identifiability is about recognition. A face, a tattoo, a username, a caption, or surrounding details can all do that.

Intent to harm is a separate element. The statute defines harm broadly as anything reasonably regarded as loss, disadvantage, or injury.

An image shared for a private, legitimate purpose is legally different from one shared to embarrass, humiliate, or punish.

Subsection (f) lists affirmative defenses. These include disclosures made while reporting unlawful activity, disclosures made in a legal proceeding where the law permits or requires them, and voluntary exposure in a public or commercial setting.

Subsection (c) covers separate conduct: threatening to disclose intimate material to obtain a benefit.

When Minors Are Involved, Different Laws Apply

Section 43.26 covers a person who intentionally or knowingly possesses, or intentionally or knowingly accesses with intent to view, visual material that contains a visual depiction of a child engaging in sexual conduct. The ages of everyone involved matter, so share them in the first conversation with a lawyer.

Federal rules also matter.

This page covers conduct between adults. Matters involving minors need their own careful review.

If You Have Been Contacted or Accused: Next Steps

Start by avoiding actions that could change the evidence. Talk with a lawyer before answering questions from police or investigators.

Don’t delete messages or images on your own, since that content may matter to the case. Don’t contact the other person about the accusation either.

Speaking with investigators without counsel can create problems. A lawyer can explain what the questions could mean before you answer.

Timelines vary with the facts of each case, so there is no single schedule to plan around.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is sexting between adults illegal in Texas?

The statute targets disclosing another person’s intimate visual material without effective consent and with intent to harm, among other required elements; under § 21.16(d), a separate offense applies when a person, knowing the character and content of the visual material, promotes material described by Subsection (b) on an Internet website or other forum for publication that is owned or operated by that person.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I be charged if the person sent the photo willingly?

Consent to receive or create an image does not cover sharing it with others.
