This guide explains what that means in practice, why talking without advice can cause problems, and what to do next.

The Short Answer: You Do Not Have to Answer Questions at the Door

Opening the door and answering questions are two separate choices.

A calm, polite line works well: “I do not want to answer questions without a lawyer. Am I free to go?” You can say it through the door or from where you stand. Keep your tone respectful. Do not argue about the messages or try to explain them on the spot.

A short refusal is usually the safest first step. Still, every contact is different. What the law requires depends on the facts of that visit. This is general information, not advice about your case.

If police came to your door about messages you sent or received, you don't have to decide what to say alone, and our free, confidential first consultation is a place to start. They may also seek records from platforms or phone companies through legal process. Officers may already have a report, screenshots or account information before they arrive. That is why a visit can feel sudden.

A visit can come before an arrest, after one, or with no arrest at all. Officers do not always say why they came.

Texas law covers several kinds of online conduct, and each has its own elements. Texas law also covers sexually explicit online communication with a minor and online solicitation of a minor to meet for sexual contact. Under Texas Penal Code § 33.021(c), a person commits an offense by knowingly soliciting a minor, over the Internet, by electronic mail, text message, other electronic message service or system, or through a commercial online service, to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person. The offense is a second-degree felony. Under Texas Penal Code § 33.021(b), a person who is 17 years of age or older commits an offense by intentionally communicating in a sexually explicit manner with a minor, or distributing sexually explicit material to a minor, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure. The offense is a third-degree felony, raised to a second-degree felony if the minor is younger than 14 years of age or is someone the actor believes to be younger than 14. Under Subsection (f-1), the punishment for either offense moves to the next higher category if the offense was committed during regular public or private primary or secondary school hours and the actor knew or reasonably should have known that the minor was enrolled in such a school.

Texas law also makes it a Class C misdemeanor to knowingly send sexually explicit images electronically to someone who did not request them or consent to receive them. The Texas Attorney General’s cyber safety page gives Texas-specific information about online solicitation of minors. A report can also reach police through the CyberTipline run by NCMEC, which reviews tips and refers them to law enforcement for possible investigation.

Why Talking Without a Lawyer Can Hurt You

Anything you say can be written down, recorded and repeated later, sometimes out of context. A casual explanation can become a statement of fact. A guess about a date, a half-remembered chat or a joke about a message can be treated as an admission.

An innocent explanation given in a rush can be hard to clarify later. It is natural to want to fix a misunderstanding right away. That urge is the reason to pause.

A lawyer can help you sort out that question before you decide what to say.

A child-abuse allegation can also bring a separate investigation. The Texas Department of Family and Protective Services parents’ guide explains the Child Protective Investigations process and the rights of parents and alleged perpetrators during an investigation.

Phones, Passcodes and Other Devices

Do not agree in the moment without advice.

Officers may ask to see a phone, computer or online account. The difference matters, and a lawyer can explain how it applies to your facts.

Whether to give a passcode or consent to a search is a decision to make with counsel. Saying yes without thinking can give officers access to more than you expected.

Do not delete messages, close accounts, reset a device or switch phones before you talk with a lawyer. Those steps can create new questions and may be misread, even when they are innocent. Keep the devices as they are. If someone else may have used your account or device, tell your lawyer early and share what you know.

What to Do Right Now, Step by Step

Write down what happened while the details are fresh. Keep your next steps small and careful.

Write down the date, the time, the number of officers, names or badge numbers, and what was said.

Keep any papers the officers left with you. Do not throw them away.

Do not contact the person who made the report, or anyone involved in the messages, about the visit.

Do not post about the situation on social media or in group chats.

If work or school may be affected, plan that conversation with a lawyer’s help before you have it.

Your notes help your lawyer. Keep them private and share them only with counsel.

Talk With a Criminal Defense Lawyer Before You Answer Questions

A criminal defense lawyer can help you decide how to respond before you say anything else.
