Someone may have been named in a report, or they may be worried about a family member who was.

Texas draws a line between a sincere concern and a deliberate lie. Those are very different situations. Two questions guide the rest of this page: what did the reporter believe, and what facts supported that belief?

Questions that often arise in these cases

In plain terms, the reporter’s state of mind is one of the facts we will review with you. Did the person know the report was untrue, or did they have no real factual basis for it? A belief that turned out to be wrong is different from a claim someone knew was invented.

This difference matters in practice. Texts, emails, earlier conversations and prior accounts can show what the person actually believed.

Consider a parent who hears a child describe something that frightens them. The parent reports it, and the investigation later finds no abuse. The earlier words, the timing and the source of the concern all become part of the picture.

Now compare that with someone who invented details or pushed a story they knew was untrue. Their position is very different. The records and statements they left behind will matter a great deal.

How a CPS report can become a criminal case against the accused

A CPS report usually starts a child-protection process run by the Texas Department of Family and Protective Services (DFPS). DFPS investigates the allegations.

Some reports also reach police. When an allegation involves possible crimes, a criminal case can follow. That case is separate from any question about the person who made the report. The accused person faces their own exposure.

The stakes can be serious. Texas Penal Code § 21.11 defines indecency with a child as an offense involving a child younger than 17. It covers engaging in sexual contact with the child or causing the child to engage in sexual contact. It also covers, when done with intent to arouse or gratify the sexual desire of any person, exposing the person’s anus or any part of the person’s genitals while knowing the child is present, or causing the child to expose the child’s anus or any part of the child’s genitals. Engaging in sexual contact is a felony of the second degree. Exposure offenses are felonies of the third degree. The statute ties sexual contact to an intent to arouse or gratify sexual desire.

Honest mistakes and good-faith reports: where the line usually falls

The difference shows up in the facts around the report. Those facts usually include the reporter’s own words, the timeline of events, and whether the reporter saw something firsthand or heard it secondhand.

Records also matter. Documents, messages or other evidence can support the account or contradict it. Each detail can point toward honest belief or toward invention.

False accusations are a documented problem in the justice system. That is one reason careful review of each fact matters.

Where a particular report falls on this line depends on the facts of each case. Good faith matters, but it does not end an investigation on its own. Can you get in trouble for false accusations to CPS? Often the answer comes down to what the reporter knew and how they came to know it.

If you were wrongly accused: practical first steps

Start by writing down what happened while your memory is fresh. Record dates, times, who was involved, and what each person said. Add every contact you have had with DFPS, investigators, schools or family members.

Next, keep the records you already have. Save texts, emails, photos, calendars, and school or medical paperwork that relates to the events. Don’t delete, edit or rearrange them. Altering a record can create new problems.

Avoid contacting the person who made the report or others about the allegations. Those conversations can be misread and may complicate the matter.

Be careful with interviews. Statements given to investigators can shape what follows, so think before any recorded interview or written statement. Stay calm, and stick to facts you can support with records or clear memory.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk with Barbieri Law Firm about your situation

If a CPS report has named you, or someone you care about, the days after it can feel confusing and urgent.
