Yes, a belief about someone’s age can matter in a Texas online solicitation case. Whether it helps depends on the exact charge and the mental state the State must prove. How Texas Penal Code Section 33.021 Frames Online Solicitation of a Minor<\/h2>\n

Section 33.021 makes certain online communications with a minor a crime. It sets different mental states for different conduct, so the subsection charged matters.<\/p>\n

Under Texas Penal Code \u00a7 33.021<\/a>, a minor is a person younger than 17, or a person the actor believes is younger than 17.<\/p>\n

That definition creates two separate questions. The first asks what the other person actually was. The second asks what the accused believed. A case can turn on either one.<\/p>\n

Subsection (b) applies to a person who is 17 years of age or older and requires intent to commit a listed offense, plus intentional sexually explicit communication or distribution. Subsection (c) requires that the person knowingly solicit a minor to meet, with intent that sexual contact, sexual intercourse or deviate sexual intercourse follow. Those mental states differ, so read the charging papers closely. The subsection cited tells you which mental state the State must prove.<\/p>\n

Penalties also depend on the subsection. Under the same section, it is no defense to subsection (c) that the meeting did not occur.<\/p>\n
