A plea offer is the prosecutor’s proposal to resolve the charge with a guilty or no contest plea, often with stated terms. This guide explains how to review the offer, which consequences to check, and what to ask before you decide.

What a Plea Offer Is and Why It Comes With a Deadline

A plea offer is a proposal to end the case with a plea. The prosecutor names the charge, the plea and often a sentence or supervision terms. Every case is different, so we will review your options with you before you decide how to proceed.

In a plea offer child sex crime Texas case, the response date often ties to a trial setting or a court docket date. Ask whether the offer stays open past that date. Don’t assume it does.

Confirm the deadline in writing. A phone call is not enough. Ask for the date, the charge and the terms by email or letter, and keep a copy.

The offer does not decide the case alone. Under Texas deferred adjudication law, the judge decides whether to defer the case after a plea.

A written offer with a deadline leaves little time to sort out what a plea would mean, and you don't have to face that decision alone. Check whether the offer is for the original charge or a lesser one.

A conviction and deferred adjudication are different outcomes. Under Article 42A.111, if you finish supervision and the judge has not moved to adjudicate guilt, the case is dismissed and you are discharged.

Article 42A.111(b) allows a judge to dismiss the proceedings and discharge a defendant early, before deferred adjudication community supervision expires, but the judge may not do so for a defendant charged with an offense requiring the defendant to register as a sex offender under Chapter 62. Under Article 42A.111(a), if the judge has not proceeded to an adjudication of guilt, the judge must dismiss the proceedings and discharge the defendant when the supervision period expires.

Then read the terms closely. Look at supervision length, conditions such as treatment or no-contact orders, fines and restitution. Understand each waiver before you sign, including any waiver of appeal.

Consequences Beyond the Sentence

Registration and immigration are often the largest consequences. Check both before you answer the offer.

Under Article 62.001, a reportable conviction or adjudication includes a deferred adjudication for listed offenses, but not a second indecent exposure violation or certain out-of-state violations that result in a deferred adjudication. So a plea with no jail time can still require registration. For many offenses, the duty ends 10 years after the later of discharge, release or dismissal, under Article 62.101. Some listed offenses end only at death.

A judge may not dismiss early a case that requires sex offender registration, per Article 42A.111. A limited exemption exists under Article 62.301, but the court decides it. Only certain registrants may petition.

If you are not a U.S. citizen, tell us so we can review how a charge may affect your situation. Raise this question with your lawyer before any plea is entered.

Other effects vary with the charge and record. If you receive a dismissal and discharge under Article 42A.111, then under subsection (d) of that article, if you are later convicted of a subsequent offense, the fact that you previously received deferred adjudication community supervision is admissible before the court or jury for consideration on the issue of penalty. Jobs, housing, custody and firearm rules also matter. A child-protection or family court matter can run on its own track, apart from the criminal case.

Test the Evidence Before You Decide

Before you accept, learn what the State can prove. An offer is only as sound as the evidence behind the charge.

Ask for the State’s evidence and review it with your lawyer. That usually includes the allegation, any statement, forensic interview recordings, medical records and digital evidence such as messages or phone extractions.

For each element of the charge, ask what proof exists. Check whether the evidence supports the exact charge in the offer. Look for conflicts between statements, dates and records.

Don’t delete or change messages, photos or accounts tied to the case. Preserve them, and tell your lawyer what exists.

The Texas Attorney General’s crime victims’ rights guide explains them.

Weigh the Risks of Taking the Case to Trial

Turning down an offer means the case may go to trial. Every case is different, so we will review the evidence with you and explain your options.

Compare the offer to the full punishment range for the charged offense, not just the offer. For example:

Indecency with a child by sexual contact is a second-degree felony. Exposure is a third-degree felony. See Penal Code § 21.11.

Sexual assault is generally a second-degree felony. See Penal Code § 22.011.

Continuous sexual abuse of a young child is a first-degree felony. Punishment is life, or 25 to 99 years. See Penal Code § 21.02.

See Penal Code § 12.32. The Texas Attorney General offense chart lists these ranges too.

Decisions about how to resolve a case are important, and we will explain your options before you decide. The answer depends on the facts, the charge, your record and the evidence. No lawyer can predict or assure an outcome.

Questions to Bring to Your First Meeting With a Lawyer

Bring a written list of questions, the offer and every document you received. Clear questions make the offer easier to judge.

What exact charge, section and degree am I pleading to?

Is this a conviction or deferred adjudication?

Does this require sex offender registration, and for how long?

What are the immigration consequences, if I’m not a citizen?

How will this affect my job, housing, children and firearms?

What is the deadline, and can it be extended in writing?

What does the State have, and where is its case weak?

What is the plan if we go to trial?

Write the offer and the deadline down before the meeting. Your lawyer’s role includes reviewing the offer, negotiating where appropriate, and explaining your options before you decide.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Barbieri Law Firm Before the Deadline

A written offer with a date on it leaves little room to think.
