It does not read the truth directly. If you face a polygraph child sexual abuse accusation in Texas, the decision deserves time and careful thought before you answer.

Why the Polygraph Question Comes Up So Early

A request to take a polygraph often arrives at a hard moment. An accusation has been made, and the person named may still be trying to understand what is being alleged. The request can come before there has been any chance to speak with a lawyer.

Many people feel pressure to answer quickly. They want to show they have nothing to hide, or they want the situation to end. That urge is understandable. It is also the reason to slow down.

This guide gives general information about how Texas child sexual abuse investigations work. It does not decide any particular case, and it does not predict how an exam or an investigation will turn out.

Time matters here. A decision made in the first days of an investigation can shape what comes after. Knowing the process first helps you decide with clear eyes.

If an accusation has been made and a polygraph has been requested, you do not have to decide alone. Common measures include breathing, heart rate, and skin conductivity, which is how well the skin carries a small electrical current.

The machine does not read thoughts. It only records changes in the body. The examiner then reviews the charts and reaches a conclusion about them. The result depends on which questions are asked, how they are worded, and how the examiner reads the charts.

Stress, fear, and confusion can all change those readings. A person frightened by an accusation can show body changes for reasons that have nothing to do with the question. Reading those changes is a judgment call, not a simple fact.

So a result does not settle what happened. The exam is only as useful as its questions. Many people think of polygraphs as simple lie detectors, but the process is more complicated than that. Understand the limits before you rely on any result.

Who Is Asking, and What They Are Investigating

The first thing to find out is which agency is asking and what allegation is under review. Two different tracks can run at the same time, and they carry different consequences.

A Child Protective Services (CPS) case is a child-safety investigation.

A criminal investigation is different. It can lead to charges under the Texas Penal Code and runs through the criminal court process. The two tracks can overlap, so a reader may face both at once. Our CPS finding versus criminal charge guide compares them in more detail.

DFPS publishes a parent’s investigation guide about its investigation process. Read any written notice carefully. Write down the investigator’s name, the agency, and the exact allegation.

Why Talking With a Lawyer Comes Before Agreeing

Talk with a lawyer before you agree to an exam, because the process starts before the test does. A polygraph exam typically includes a pre-test interview, in which the examiner asks about the allegation and the person’s background.

Statements made in that interview are part of the process, not just the test itself. A remark made before the exam begins can matter as much as a chart. That is why the timing of the decision is so important.

A lawyer can review several things before you decide:

the exact allegation and the agency asking

the questions the examiner proposes

the timing and who is conducting the exam

your own account of events, shared privately before any statement is made

Whether agreeing to an exam makes sense depends on the facts of the case. A consultation lets you ask questions and understand your options before you give any statement to anyone.

How Online Evidence and Sting Cases Change the Picture

Some child sex crime allegations in Texas begin with online conversations. In some of those cases, an officer poses as a minor. The law on online contact is specific, so the details of the messages matter.

That offense is a second-degree felony. The statute also says it is not a defense that the meeting did not occur.

Entrapment is a separate question. Under Penal Code § 8.06, entrapment is a defense when a law enforcement agent induces the conduct using persuasion or other means likely to cause persons to commit the offense. Merely giving someone an opportunity to commit an offense does not count as entrapment.

Messages, account records, and other digital evidence can become the focus of questions during an exam. The wording of any answer matters a great deal. The NCMEC online enticement resource describes how online enticement works and the tactics it often involves. Our police sting online solicitation of a minor guide explains how those investigations are built.

How Charges and Plea Discussions Relate to the Decision

Decisions made early in an investigation can matter later, during charging and negotiation. That is one reason to review each step with a lawyer.

A plea offer is a formal proposal from the prosecution. Its terms, and what each one would mean for you, should be reviewed with a lawyer before any response is given. Whether any offer fits your situation requires a review of the evidence.

Under Texas Code of Criminal Procedure art. 42A.101, except as provided by Article 42A.102(b), a judge may defer further proceedings after a guilty or nolo contendere plea and place the defendant on deferred adjudication community supervision; under Article 42A.102, eligibility is limited for certain offenses. Subsection (b) also sets further exclusions, including offenses under Penal Code Sections 21.02 and 21.03, Section 22.021 offenses punishable under subsection (f), and certain Section 19.02 offenses, subject to the exception stated there. The judge must first find that the evidence substantiates guilt and must believe that doing so serves society and the defendant. The plea offer in child sex crime cases guide covers how offers are evaluated.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Take the Next Step Before You Answer the Question

Before you agree to an exam or answer investigators’ questions, talk with a lawyer about your facts.
