A no bill means the grand jury chose not to return an indictment. It is not a trial verdict, and it does not decide whether anyone is innocent or guilty.

This guide explains what a no bill means, what it does not mean, what can follow, and which questions to bring to a lawyer.

What a No Bill Means in a Texas Grand Jury Proceeding

A no bill is the grand jury’s decision not to return an indictment on the accusation in front of it. The opposite result is a true bill, which is an indictment that formally charges a person with a crime.

A grand jury asks a narrower question than a trial jury. It asks whether there is enough evidence to bring a formal charge. It does not ask whether the accused is guilty.

Think of the grand jury as a screening step that comes before any trial. A no bill tells you about the charging stage. It does not tell you how a trial jury would view the evidence.

Many people hear “no bill” and assume the matter is over. That is a common mix-up. The decision answers one question at one point in time, and other steps may still follow.

If a grand jury declined to charge you and you're unsure what comes next, we can review your facts and explain your options. The jurors then decide whether to return an indictment or decline to do so.

Child sex crimes carry heavy penalties, which is why the charging stage matters. Indecency with a child covers a child younger than 17. Engaging in sexual contact with a child, or causing the child to engage in sexual contact, with intent to arouse or gratify the sexual desire of any person, is a second-degree felony under Penal Code § 21.11. Exposure under the same section, meaning exposing one’s anus or genitals knowing the child is present, or causing the child to expose them, with intent to arouse or gratify the sexual desire of any person, is a third-degree felony.

Aggravated sexual assault is a first-degree felony under Penal Code § 22.021. If the victim is younger than 10, the minimum prison term rises to 25 years.

Online cases add another layer. Internet Crimes Against Children task forces investigate online child exploitation, including sexual solicitation. The Texas Attorney General ICAC program describes that work. So more than one agency may be involved.

What a No Bill Does Not Mean

A no bill is not a finding of innocence. It is also not a ruling that the accusation was false.

The grand jury decides only whether to return an indictment. Declining to indict is not the same as clearing a person’s name.

A no bill does not automatically close the matter. The investigation can stay open. Time limits for later charges are set by law, and they follow their own rules.

A common mistake is treating a no bill as the final word. Many people stop paying attention too soon. Keep reading the court papers and notices you receive, and keep them in one place.

What Can Happen Next After a No Bill

A no bill does not end the case automatically, and what follows depends on the facts. A prosecutor may bring the matter back to a grand jury, and a later indictment is possible.

Timing matters. Under Art. 12.06, an indictment counts as “presented” once the grand jury has acted on it and the court has received it. Under Art. 12.05, time while an indictment is pending does not count toward the limitation period. Pendency starts the day the indictment is filed. It ends when a trial court order finds the accusation invalid for any reason.

Arrest records can matter too. Under Art. 55A.052, a person may be entitled to expunction (removal of arrest records) if no indictment or information was presented after the arrest. The required time must also pass, unless the state’s attorney certifies that the records are not needed. For a felony arrest, that is at least three years. A state attorney’s certification that the records are not needed can also qualify.

Check the court’s written orders. They show what is still in effect.

Questions to Understand Before Your Next Decision

The right questions help you sort out what the news means for your own case. Write down the answers as you learn them.

What charge did the prosecutor ask the grand jury to consider?

Has the prosecutor said whether the matter will go back to a grand jury?

Which written orders, bond terms, or notices are still in effect?

Which arrest, filing, or court dates appear in the paperwork?

Did the accusation involve online messages or files?

Bring copies of every order and notice. Written orders show what is still in force, and the dates in them can matter for time limits. Family members often hold these papers, so keep them together.

These answers shape which options exist. They are the usual starting point for a first conversation with a criminal defense lawyer.

Talk Through Your Situation with Barbieri Law Firm in Frisco

If a grand jury declined to indict in a child sex crime matter, a Frisco criminal defense firm can review your facts with you.

Maybe you were told the grand jury did not indict, but no one has explained what happens next.
