Texas Penal Code \u00a7 33.021<\/a> makes certain online sexual communications and solicitations involving a minor a crime. What the State must prove for online solicitation of a minor<\/h2>\n

The defense tests each element against the evidence. Start with the definitions. Under \u00a7 33.021<\/a>, a minor is someone younger than 17, or someone the actor believes is younger than 17. The definition of “actor”<\/a> in \u00a7 1.07<\/a> names the person whose criminal responsibility is in issue.<\/p>\n

For a meeting charge under subsection (c), the State must show the person knowingly solicited a minor, online, to meet another person. The intent must be that the minor engage in sexual contact, sexual intercourse or deviate sexual intercourse. Subsection (d) says it is not a defense that the meeting did not occur. Subsection (e) lists two defenses to a subsection (c) charge: a marriage to the minor, or an age gap of not more than three years with the minor’s consent.<\/p>\n

Grading matters too. An offense under subsection (c) is a second-degree felony. Subsection (f-1) raises the punishment to the next higher category of offense if, shown at trial, the conduct happened during regular public or private primary or secondary school hours and the actor knew or reasonably should have known the minor was enrolled in a public or private primary or secondary school.<\/p>\n

The defense starts with the complete chat record, not the short quotes in an officer’s report. An affidavit often quotes only a few lines. The messages before and after those lines can change what they mean.<\/p>\n

The review covers who opened the conversation and the exact wording on both sides. It also checks timestamps, gaps in the thread, and whether any screenshot was cropped, summarized or changed. Keep the full thread as it appears on your device. Do not edit it or delete it.<\/p>\n

The defense then compares the officer’s report with the raw data the State produced. Any difference between the two is a question to explore. Small gaps in time or missing messages can matter as much as the words themselves.<\/p>\n

How the fictitious persona and the operation are examined<\/h2>\n

The defense examines the persona the officer built, including what it said about age. It reviews the stated age, the photos, the bio and the account’s history. Those details show what the other person was led to believe.<\/p>\n

The defense also looks at the operation itself. It asks what protocol the agency followed, whether written guidelines existed, and who monitored and answered the account. Supervision and training records can show how the chat was run.<\/p>\n

The sequence matters. Did age come up before any sexual topic, and who raised each one? Because \u00a7 33.021<\/a> counts a person the actor believes to be under 17, what the persona presented is central to the analysis.<\/p>\n

Device evidence, warrants and statements<\/h2>\n

Phones, computers and online accounts are often searched under a warrant. The paperwork behind that search matters. The defense reviews the affidavit, the scope of the warrant and the extraction report. It checks what was searched and what was taken.<\/p>\n

The defense also checks any statements. It asks whether they were recorded, whether the reader was told of their rights, and how the questioning was conducted. Each of these points can affect what the State may use.<\/p>\n

Entrapment and other defenses to evaluate<\/h2>\n

Entrapment is one defense a lawyer evaluates, and Texas law separates inducement from opportunity. Under \u00a7 8.06<\/a>, it is a defense if a law enforcement agent induced the conduct “using persuasion or other means likely to cause persons to commit the offense.” The same section says that merely giving a person an opportunity to commit an offense is not entrapment.<\/p>\n

The statute also covers persons acting on an agent’s instructions. The review asks who first raised the subject, what the officer said or did to move the chat along, and what the evidence shows about why the reader acted.<\/p>\n

The defense also checks the evidence of age and intent, and whether any evidence was gathered lawfully. Which defenses apply depends on the facts. No lawyer can predict how a case will end.<\/p>\n\n
