Common options include self-defense, a dispute over intent or identity, and a challenge to the evidence. No single defense fits every case, and no lawyer can say how a case will end. This page explains how each option is tested against the facts, so you know what questions to ask.

What an Assault Charge Means Under Texas Law

An assault charge in Texas means the state claims one of three specific acts occurred. Under Texas Penal Code § 22.01, assault can mean intentionally, knowingly, or recklessly causing bodily injury, intentionally or knowingly threatening another with imminent bodily injury, or intentionally or knowingly causing physical contact that the person knows or should reasonably believe the other will regard as offensive or provocative.

Each version has a mental-state requirement. Causing bodily injury can be intentional, knowing, or reckless. Threats and physical contact must be intentional or knowing. The statute sets those lines, so the first question is which version the state claims.

Bodily injury has a broad meaning. Texas Penal Code § 1.07 defines bodily injury as physical pain, illness, or any impairment of physical condition. The charge can rise when the facts show more. Texas Penal Code § 22.02 covers aggravated assault, which requires an assault plus either serious bodily injury or using or exhibiting a deadly weapon during the assault.

A charge is only an accusation. Reviewing a charge often means looking at each part of the alleged conduct and the evidence offered for it.

If you're facing an assault accusation or worried about a family member who has been charged, we can review the facts with you in a free, confidential first consultation. The key questions are simple to state. Who made the first physical move? What threat was present at that moment? Did the response match the threat, or did it go further than needed?

A lawyer looks at each step in order, because the order of events often shapes how the response is judged. Questions about the amount of force used are often part of an assault review. Video, witness accounts, and the timing of each act usually answer these questions. A self-defense claim needs support from the timeline and the other evidence. Notes from the day, texts, and photos can help fill gaps in memory.

In a family setting, the family violence definition in Texas Family Code § 71.004 excludes defensive measures to protect oneself. So a self-defense account can also bear on whether the act counts as family violence in the same incident.

Disputed Intent, Identity, and Accidental Contact

Intent and identity are often the two central questions in a disputed assault case. Intent matters because the statute requires a culpable mental state. Assault in Texas can involve bodily injury caused intentionally, knowingly, or recklessly, and threats or offensive physical contact committed intentionally or knowingly.

A contact that was truly accidental may not match those words. Reckless conduct still counts for bodily injury, so an accident argument needs a close look at what happened. Tell your lawyer what you remember about the moment of contact, even if it’s unclear. The records can then be checked against it.

Identity is a separate question. If witnesses did not clearly see who acted, or a recording is unclear, a lawyer tests whether the state can connect the accused to the conduct. That test depends on the exact evidence in the file. These arguments are not automatic. Each part of the alleged conduct is reviewed alongside the evidence offered for it.

The Evidence That Usually Decides the Case

The evidence that matters most is usually the timeline and the records that fix it. Common sources include 911 recordings, body-camera or doorbell video, photographs of injuries, medical records, text messages, and witness statements.

A lawyer lines these up in time order. Then the lawyer compares each account with the documents. Differences between the complainant, witnesses, and records can matter. They often show up only when everything sits side by side.

Medical records can show when an injury was documented and how it was described. That can matter when an account changes. Photos taken soon after the event show the condition at that time. Each item is checked for its date, its source, and who had access to it.

Missing pieces matter as well. A gap in the timeline can be as important as a conflict in the statements. Your own account matters too. Tell your lawyer what you remember, including details that seem small. Early, careful notes help the facts get reviewed accurately from the start.

Family Violence Allegations and Bond Conditions

A family violence allegation can change bond conditions, protective orders, and how long those orders last. A household is a unit of persons living together in the same dwelling, whether or not they are related, as defined in Texas Family Code § 71.005.

Bond conditions matter from the first day. Texas Penal Code § 25.07 makes it an offense to knowingly or intentionally violate a bond condition or protective order in a family violence, sexual assault or abuse, indecent assault, stalking, or trafficking case, when the condition is related to the safety of a victim or the safety of the community, by doing certain listed acts such as threatening or harassing contact with a protected person. Contacting a protected person in a threatening or harassing way is one example.

Protective orders can last a long time. Under Texas Family Code § 85.025, an order against a person charged with a criminal offense involving family violence under Title 5 of the Penal Code or an offense under Section 25.11 of the Penal Code is effective until the second anniversary of the date of the final disposition of the criminal case.

Firearms can also be affected. Texas Penal Code § 46.04 bars possession after a conviction for a Class A misdemeanor assault involving a family or household member, until the fifth anniversary of the later of release from confinement or release from community supervision. Follow every bond condition while the case is pending. A violation can create a new charge.

Talking Through Your Own Situation with Barbieri Law Firm

If you’ve been charged, or you’re worried about someone who has, you don’t have to sort out the options alone.
