A felony case can turn on a grand jury decision. A Texas grand jury decides whether to return an indictment, the formal charge that moves a felony case forward. Police take a person into custody, but an arrest does not mean a grand jury has acted yet. Many people confuse the two.

The grand jury stage is not a trial. No judge or jury decides guilt at that point.

The stakes are serious. Aggravated sexual assault is a first-degree felony (Penal Code § 22.021).

What a no bill means, and what it does not mean

A no bill means the grand jury did not return an indictment on the charge it considered. It is the grand jury’s decision not to indict at that stage.

A no bill is not an acquittal. No trial took place, and a no bill does not establish innocence.

A no bill also does not always end the matter. Whether it changes a particular case turns on the charge, the evidence, and what prosecutors choose to do next.

Many people assume a no bill settles everything. It may not. Talk with counsel about what the decision means for your charge and your bond conditions.

Why the county where a case is filed matters

A felony case is tied to the county where the charge is filed. Richmond sits in Fort Bend County, so a Richmond-area case is a Fort Bend County case.

Those practices apply to your case, not to a case in another county.

If your search led you to a Richmond, TX sex crime lawyer, know that the firm is based in Frisco and handles criminal defense matters across Texas. Distance from the courthouse is not a reason to delay your questions.

Ask early which county, court and charge apply to your situation. Early answers help you plan the next steps.

How online sex crime cases use digital evidence

Online sex crime cases can involve digital evidence, such as messages, account records, images and device data. That evidence often starts outside the police.

Suspected online child exploitation can be reported to the CyberTipline. The National Center for Missing & Exploited Children reviews these tips and refers them to law-enforcement agencies for possible investigation (NCMEC CyberTipline).

Texas law also reaches conduct that never leads to a meeting. Knowingly soliciting a minor online to meet, with intent for sexual contact, is a second-degree felony, and the punishment can increase to the next higher category if the offense was committed during school hours and the actor knew or should have known the minor was enrolled in school (Penal Code § 33.021). The meeting does not have to happen for the offense to apply.

Reviewing digital evidence can look at how the material was collected, what the State says it shows, and whether the messages and files are what the State claims. The firm will review the evidence in your case and explain your options. No lawyer can know how a case will end.

Deleting messages, accounts or devices can create new problems. Ask counsel before you change or discard anything.

Next steps while you wait for a grand jury decision

While you wait, keep a written record of your dates and paperwork. Write down any arrest date, bond setting, court date, and contact from investigators. Keep copies of every document you receive.

Avoid discussing the allegations with the complainant, investigators or others. Those statements can be used later.

Follow every bond condition and protective order. In a family violence, sexual assault or abuse, indecent assault, stalking or trafficking case, knowingly violating a bond condition related to the safety of a victim or the community, or a covered protective order, in a way the statute lists, such as prohibited communication or going near a protected place, can be a separate offense (Penal Code § 25.07).

Bring specific questions to your first conversation with counsel. Include the charge, the evidence, and the expected timing of the grand jury.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk with Barbieri Law Firm about your situation

Does a grand jury decide guilt?

Does an online solicitation charge require a meeting?

No. Under Penal Code § 33.021, the meeting does not have to occur for the offense to apply.

If you are waiting to learn whether a grand jury will return an indictment in your case, you do not have to sort out the process alone.
