For a reportable conviction or adjudication for any other offense, the duty ends on a date the statute sets. The length depends on the offense and how the case ends. Barbieri Law Firm, based in Frisco, Texas, defends people accused of sex crimes and assaultive offenses. This guide explains the rules in plain terms, so you can understand what a charge could mean for years to come.

The short answer: the offense, how the case ends and statutory exceptions

Under Art. 62.101, the duty to register lasts until death for the offenses listed in Subsection (a), if the person has a reportable conviction or adjudication, other than an adjudication of delinquent conduct, for one of them and any condition attached to that offense is met, except as provided by Subsection (b) and Subchapter I. For a reportable conviction or adjudication for any other offense, the duty ends earlier, on dates the statute specifies. The length comes from statute, not from how a registrant behaves on the list or a judge’s personal view.

Art. 62.101 separates the offenses listed in Subsection (a), for which the duty to register ends when the person dies, from offenses other than those described by Subsection (a). Under Article 62.101(a), the duty to register for certain reportable convictions, including a sexually violent offense, ends only when the person dies, unless Subsection (b) or Subchapter I applies. Other reportable offenses can carry a ten-year duty to register.

The duty follows the reportable conviction or adjudication. That means the final result drives the duty. The conviction sets the length.

Two questions drive the answer for any single case. First, which group does the offense fall in? Second, when does the clock start? The next sections take each in turn.

If a loved one is facing a sex offense charge, you don't have to work out the registration rules alone. Those events are release from a penal institution, discharge of community supervision, and dismissal and discharge of the criminal proceedings. A penal institution includes a county jail, so a jail release counts, under Texas Code art. 62.001.

Another provision of Chapter 62 can change that. Under Texas Code art. 62.101, certain offenses become lifetime duties when a second reportable conviction or adjudication is part of the record. The same charge can therefore lead to different lengths.

Does deferred adjudication still require registration?

It can. The ten-year rule covers an order of deferred adjudication.

Can a registrant ever get off the list?

A ten-year registrant’s duty ends when the period runs. Lifetime duties don’t end just because time passes. The law offers a narrow route for some registrants: an exemption petition under Texas Code art. 62.301.

The petition is for a person required to register only as a result of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct. A defendant who before September 1, 2011, was convicted of or placed on deferred adjudication for an offense under Penal Code § 21.11 or 22.011 may also petition under Article 62.301(c). A juvenile adjudication does not qualify. The petition can be filed at or after sentencing, or after placement on deferred adjudication community supervision.

At a hearing, the judge may hear from the victim or a family member. After a hearing on the petition, Art. 62.301(d) allows the court to issue an order exempting the person from registration if it appears by a preponderance of the evidence (more likely than not) that the conditions listed in the statute are met. Those conditions include that the exemption does not threaten public safety and that the person’s conduct did not occur without the consent of the victim or intended victim as described by Section 22.011(b), Penal Code. The exemption must not threaten public safety. The conduct must not have occurred without consent. The exemption must serve the victim’s interests. It must also serve the interests of justice.

One example is the age-based finding under Texas Code art. 42.017. In the trial of an offense under Penal Code § 21.11 or 22.011, that finding applies when, at the time of the offense, the defendant was not more than four years older than a victim who was at least 15. The conviction must also rest only on those ages.

An exemption order does not expire. The court must withdraw it if the person later receives a reportable conviction or adjudication. This is a court process with its own requirements.

Moving, traveling and reporting while registered

A ten-year duty means ten years of reporting. A lifetime duty means reporting until that duty ends.

A move or trip out of state can raise questions under both systems.

Can a registered sex offender go on vacation?

Travel questions turn on the facts, including the offense, where the person goes and how long they stay.

How juvenile cases and age change the picture

An adjudication of delinquent conduct is a reportable adjudication that can require registration, but under Art. 62.101(a) it does not trigger the lifetime duty.

A juvenile adjudication runs on its own clock. For a juvenile adjudication, the ten-year period runs from the disposition or from completing its terms, whichever date is later.

In the trial of an offense under Penal Code § 21.11 or 22.011, a finding under art. 42.017 applies when the defendant was not more than four years older than a victim at least 15 and the conviction is based solely on their ages at the time of the offense. The birthdates in a case matter. Each charge also carries its own rules, so the offense named in the filing matters.

Talk through a pending charge or a family member’s case

If a loved one faces a sex offense charge, knowing how long you stay on the sex offender list in Texas starts with how the case ends. Early decisions can shape the duties that may follow. Each step, from the charge to the plea or verdict, can change the dates that control the duty.

You may be a parent, spouse or adult child who just learned of the charge. You’re trying to understand what registration could mean for years to come. That’s a hard place to be.

Records matter beyond the registry, too. Those records can affect background checks for jobs and professional licenses.

No lawyer can say how a case will end.
