Every case turns on its own facts and its own record. What you say on one track can reach the other.

Many parents learn about the CPS track first. A caseworker may visit the home or call. A detective may reach out later, or both may move at once. Don’t assume they will move at the same pace or end the same way.

This page explains how the Texas CPS process generally works. It covers what a visit means, whether a child can be taken while a case is open, and what you can decline to discuss. It ends with how a criminal defense lawyer coordinates both tracks. The Texas DFPS investigations page describes this work.

The process starts with an intake report. DFPS assigns an investigator, who gathers information from the child, the family, and other sources. The focus is child safety. The investigator may interview people, visit the home, and talk through a safety plan.

Texas DFPS publishes report abuse guidance for the public. That difference matters. The two tracks follow different rules.

The CPS Basic Investigation Process handbook is a DFPS handbook that covers the basic investigation process. A DFPS finding is not a criminal verdict. Treat it as a separate outcome from anything a prosecutor may decide.

What Does a CPS Visit Mean?

A CPS visit means an investigation is open. It does not, by itself, mean a criminal charge has been filed.

At a visit, the investigator usually explains the allegation. They ask questions. They may want to speak with the child and with other people in the home. Some children are interviewed in a forensic interview. OJJDP guidance on child abuse investigations is one published resource on the subject.

You can ask what the allegation is and what happens next. You can also ask for a call back so you can speak with a lawyer first. That request gives you time to think before you answer detailed questions.

Answers given on the spot can be hard to take back. You may want a short pause to get advice before you reply.

Can CPS Take a Child While a Case Is Open?

Whether CPS can take a child while a case is open depends on the facts of the investigation. DFPS focuses on child safety, so the safety concerns the investigator finds and documents matter most.

An investigator may set up a safety plan that keeps the child at home. In other cases, the concerns may lead to more serious steps. The specific safety findings drive the decision, not the label on the case.

A criminal case and a CPS case can each affect where a child lives and who may see the child. Each track keeps its own record. Keep that in mind when you talk with anyone about the child’s living arrangements.

If a baby is expected or has already been born while a case is open, tell your lawyer right away. Counsel can make sure your response to CPS is coordinated with the criminal side.

What Happens If CPS Cannot Find You?

If CPS cannot reach you, the investigation does not stop. Investigators may try phone calls, letters, or visits.

You can decide how to respond to CPS contact after talking with a lawyer. You may want to review a message, a card, or a note left at your door with a lawyer.

If you learn of an attempt, respond through a lawyer when you can. Counsel can set up contact on your behalf and tell the investigator how to reach you through the lawyer.

Keep a written record of every contact attempt. Note the date, the caller, and what was said. Those notes help your lawyer plan the response.

What the Accused Can Decline to Discuss, and Why Statements Matter

A lawyer can help you understand your options before you answer questions. A lawyer can help you decide what to say and when.

Statements made on one track can matter on the other. The CPS track may ask for a written or recorded account. Treat every answer as potentially important, because it may later be read in a criminal case.

Do not sign a statement, a safety plan, or a service agreement until you understand what it says. Ask how it could be used in a criminal case before you sign.

Talking with counsel before the first substantive interview is your decision. A lawyer can help you weigh the choice against the facts of your case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How a Criminal Defense Lawyer Coordinates Overlapping Matters

A criminal defense lawyer coordinates both tracks so each response fits the other. The lawyer reviews the CPS notice, the criminal allegation, any records, and the timing of each track.

Counsel can speak with the investigator on your behalf. Counsel decides what information is given and when. Counsel also works to protect your rights in both tracks.

In the criminal case, the review looks at the evidence. That can include the child’s statements, medical findings, and any recordings. It also looks at the charge and the elements the State must prove.

Continuous sexual abuse is a separate charge. Under Texas Penal Code § 21.02, a person commits an offense if, during a period that is 30 or more days in duration, the person commits two or more acts of sexual abuse, and at the time of each act the actor is 17 years of age or older and the victim is a child younger than 14 years of age or a disabled individual. In a prosecution involving only one or more victims described by Subsection (b)(2)(A), it is an affirmative defense to prosecution under § 21.02 that the actor: (1) was not more than five years older than the victim, or than the youngest victim when more than one victim is alleged; (2) did not use duress, force, or a threat against a victim at the time of the commission of any of the acts of sexual abuse alleged as an element of the offense; and (3) at the time of the commission of any of the acts of sexual abuse alleged as an element of the offense, was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender, or was not a person who under Chapter 62 had a reportable conviction or adjudication for an offense under this section or an act of sexual abuse as described by subsection (c). It is a first-degree felony, punishable by imprisonment in the Texas Department of Criminal Justice for life, or for any term of not more than 99 years or less than 25 years.

Bring Your Questions to a Free First Consultation

If you just received a CPS visit or call, and you fear a criminal case may follow, you don’t have to sort it out alone.
