What an Employer-Device Online Sex Crime Case Is<\/h2>\n

An employer-device case is an online sex crime allegation tied to a work laptop, phone or tablet. The device often shows up early, and it becomes evidence once the case begins.<\/p>\n

A case can come to light in several ways. A company’s IT or security team may flag activity. A manager may report what they saw. Police may also learn of the matter through outside tips. Charges Connected to Online Activity on Work Devices<\/h2>\n

The charge depends on what was sent, who received it, and what the law requires for that conduct. Texas law covers several kinds of online conduct.<\/p>\n

Online solicitation of a minor.<\/strong> Under Texas Penal Code \u00a7 33.021<\/a>, a person 17 or older commits an offense under subsection (b) if, with intent to commit a listed offense, the person over the internet communicates in a sexually explicit manner with a minor; subsection (c) applies to any person. The offense involves communicating in a sexually explicit manner with a minor over the internet, with intent to commit a listed offense. The same section covers knowingly asking a minor to meet someone for sexual contact.<\/p>\n

The statute says it is not a defense to the meeting charge that the meeting did not occur. Penalties depend on the subsection, the minor’s age, and whether the actor committed the offense during regular public or private primary or secondary school hours and knew or reasonably should have known the minor was enrolled in school. A meeting-solicitation offense is a second-degree felony.<\/p>\n

Child sex crimes and sexual assault.<\/strong> Some cases also involve contact charges. Charges in this area can include indecency with a child or aggravated sexual assault. Aggravated sexual assault is a first-degree felony.<\/p>\n

Online solicitation of a minor.<\/strong> Texas Penal Code \u00a7 33.021<\/a> makes it an offense for a person age 17 or older, acting with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K) of the Code of Criminal Procedure, to intentionally communicate in a sexually explicit manner with a minor, or to intentionally distribute sexually explicit material to a minor, when done over the Internet, by email, text message or another electronic message service or system, or through a commercial online service.<\/p>\n

The alleged age, the platform, the words used and whether a meeting was discussed all affect which section applies.<\/p>\n
