A case can begin with a police report, an interview request or a warrant. This guide walks through the steps in order, from first contact to trial or plea. It explains how the process works. It does not predict how any case will end.

What Happens First When You Are Accused of a Sex Crime in Texas

The first contact can come as a report, an interview request or a warrant, and you decide how to respond. Some people learn of an investigation from a phone call or a knock at the door. Others first hear about it from a letter or a text.

The early days matter. Steps taken in the first days can shape what evidence is collected and how it is described. Messages, social media posts and contact with the other person can all become part of the record.

You have choices from the first contact. Talking without advice is a common mistake. A short answer given under stress can be repeated and used later.

The rest of this page follows the process in order. It covers investigation, arrest, bond, charging, arraignment, motions, and trial or plea.

How Law Enforcement Builds a Sex Crime Case

Investigators usually build a sex crime case from a complaint, medical and forensic records, digital evidence and witness statements. Each source tells a different part of the story, and none tells the whole story alone.

In sexual assault cases, a kit may be collected during a medical exam. Samples from a kit can be tested for DNA. A DNA result can show whether a sample matches a profile. It does not, by itself, show how a contact happened or whether it was consensual.

Medical and emergency room records show what a provider observed and wrote down at a specific time. They do not, by themselves, show how an event happened.

A probable cause affidavit is a sworn document that supports an arrest or a warrant. It sets out the investigator’s account. Its statements should be checked against the full file. A defense lawyer does that work, because the content and reliability of evidence are tested in the defense, not assumed.

Interview Requests, Search Warrants and Your Rights Before Arrest

Investigators may ask you to come in or to talk by phone. The request may sound casual, but it is a legal step with real effects.

Many people feel pressure to explain quickly and clear things up. Talking without a lawyer is one of the most common ways people hurt their own position. Ask what the request is about and whether you are a suspect. Then say you want to speak with a lawyer first.

Avoid contacting the other person to “clear things up.” Deleting messages or posting about the case can create new problems. Contact can also violate a bond condition or protective order.

Arrest, Warrants and Magistration in Texas

An arrest can happen with a warrant or without one. An arrest on a warrant means a judge has issued a document ordering it. An arrest without a warrant happens when an officer acts without one.

Magistration is the first court step after booking. Those conditions can include limits on contact with a complaining witness.

Many people arrive at this point frightened and tired. Write down the charge, the names involved and the dates as you heard them. Then ask a lawyer to review the paperwork as soon as possible.

Bail and Bond Hearings After a Sex Crime Arrest

At a bail or bond hearing, a judge decides whether the accused is released and under what conditions. Conditions are court orders that come with release.

In a family violence, sexual assault or abuse case, the Penal Code makes it a separate offense to violate a bond condition related to the safety of a victim or the community. Conduct that can violate such an order includes communicating with a protected person in a threatening or harassing manner and possessing a firearm when the order or bond condition forbids it.

Judges may weigh the charge, the history and the facts of the case. How a bond decision goes depends on the facts and the court.

Read every condition closely. Ask whether it covers contact by phone, text or social media, including contact through a third party.

Grand Jury Review, Indictment and Formal Charges

A formal charge in Texas is often an indictment or an information. Both are charging documents. Neither one is a finding of guilt.

Texas law says an indictment is “presented” when it “has been duly acted upon by the grand jury and received by the court” (Code of Criminal Procedure art. 12.06). An information is “presented” when it “has been filed by the proper officer in the proper court” (art. 12.07).

The firm handles sex crimes and assaultive offenses, including aggravated sexual assault, online sex crimes, child sex crimes, aggravated assault and family violence. Each offense has its own elements and punishment range. Small wording differences in a charge can change what the State must prove, so the exact language matters.

Arraignment and Early Court Settings

Arraignment is an early court appearance where the charge is read and the accused responds. It is the point where the formal charge becomes part of the court record for the next steps.

After arraignment, the court sets future dates. These settings can address bond, the status of evidence, and the schedule for motions and trial.

Discovery is the process of getting the State’s evidence. In practice, that means police reports, recordings, lab results and witness statements. Early requests give the defense time to review what exists.

Gather your documents early. Useful items include the charging papers, bond papers, any protective order, messages you received and a list of people who may know something about the events.

Pretrial Motions and Evidence Issues in Texas Sex Crime Cases

Pretrial motions ask the court to decide evidence questions before a trial begins. A motion is a written request to the judge.

Motions can challenge how evidence was collected, whether a statement can be used, or what a jury may hear. They can also test the basis for a search or an identification.

Consent often matters in sexual assault cases. Under Penal Code § 22.011, a sexual assault is without consent in listed situations. Those include cases where the actor compels submission by force, violence or coercion. They also include cases where the actor knows the other person is unconscious or physically unable to resist.

Intoxication can raise similar questions. Each motion turns on the evidence, the charge and the court, so the file needs close review.

Trial or Plea: Understanding Your Options

A trial means a judge or jury decides the case. A plea agreement is a deal with stated terms. Each path carries its own risks, and the decision belongs to the accused.

Punishment ranges come from the Penal Code. Under Penal Code § 12.32, a first-degree felony carries life or a term of not more than 99 years or less than 5 years. It may also carry a fine of up to $10,000.

Aggravated sexual assault is a first-degree felony under Penal Code § 22.021.

A second-degree felony carries 2 to 20 years in prison and a fine of up to $10,000. The charged degree of a sexual assault depends on the subsection alleged and the facts in the case.

When Children, CPS or Family Matters Are Involved

Cases involving a child or family member can touch both the criminal court and family matters. These tracks run separately, and what happens in one can affect the other.

Child sex crime cases can involve Child Protective Services and related family steps. Family violence charges often arise between partners, relatives or household members. A bond order may limit contact with children or other family members.

The Texas Department of Public Safety describes rights that include protection, notification and participation.

Some online cases involve federal agencies. The Internet Crimes Against Children Task Force Program investigates technology-facilitated child sexual exploitation, and federal cases can proceed alongside state charges.

Common Questions About Texas Sex Crime Charges

Each common question turns on the offense, the ages involved and the specific facts.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long does a person stay on the sex offender list in Texas?

For some sexually violent offenses, the duty to register ends at death.
