They must also prove the mental state the statute requires, such as intent or knowledge. The mental state is often the main question, and it is easy to miss.

Two people can send similar messages and still face different charges. It is general information about Texas law. Barbieri Law Firm is based in Frisco, Texas.

What the State Must Prove: Conduct Plus a Mental State

Texas online sex crime charges combine a conduct element with a required mental state. The conduct element asks what was communicated, sent, or done. The mental state asks what the accused intended or knew.

Texas Penal Code § 33.021 turns on intent. Texas Penal Code § 43.25 turns on knowing the character and content of the material or performance. Texas Penal Code § 43.26 provides that a person commits an offense if the person intentionally or knowingly possesses, or intentionally or knowingly accesses with intent to view, visual material that contains a visual depiction of a child engaging in sexual conduct, and the person knows or should have known that the depiction is of a child younger than 18 years of age at the time the image of the child was made. One label does not cover every charge.

The same conduct can also fall under more than one law. Under § 33.021(g), the actor may be prosecuted under that section, the other law, or both. Sexually explicit content is one part. Prosecutors often point to message content, tone, and sequence to argue that a purpose existed.

Subsection (c) uses different language. The State must show the person knowingly solicited a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse. Under subsection (d), it is not a defense that the meeting did not occur.

Knowledge and Belief About Age

Whether the accused knew or believed the other person was a minor is a separate question from intent. Texas handles age differently depending on the statute.

Belief counts under that definition. Subsection (e) of Texas Penal Code § 33.021 provides a defense to prosecution under this section for conduct described by Subsection (c), including when the actor was not more than three years older than the minor and the minor consented to the conduct. The actor was married to the minor. Or the actor was not more than three years older than the minor, and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

Under § 43.25(h), the offense applies whether or not the actor knows the victim’s age. Texas Penal Code § 43.25 reads: “(c) An offense under Subsection (b) is a felony of the second degree, except that the offense is a felony of the first degree if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the age of the victim at the time of the offense.” So in that statute, knowing the age is not the deciding element.

Each side will look at the messages, the profile details, and the timeline to argue what the accused knew.

Mental State in Possession and Sexual Performance Cases

Possession and performance charges use different mental-state language. The statute number alone does not tell you what the State must prove.

One element of the possession offense in Texas Penal Code § 43.26 is that the person intentionally or knowingly possesses, or intentionally or knowingly accesses with intent to view, visual material that contains a visual depiction of a child engaging in sexual conduct. Accessing that material with intent to view it also qualifies. The person must know or should have known the depiction is of a child younger than 18.

Another online statute, § 21.19, covers knowingly sending sexually explicit visual material electronically. The recipient must not have requested it or consented. That offense is a Class C misdemeanor. One device or account can raise questions under more than one of these laws.

How Prosecutors Use Messages and Devices to Show Intent

Prosecutors often prove intent with circumstantial evidence. That includes messages, timestamps, the account or device used, and the conversation around them. Context often matters as much as any single message.

The device questions are practical. Who had access to the phone or account? Can the messages be tied to the accused? A full extraction shows surrounding context, so the whole timeline matters more than one screenshot.

For possession charges, the focus shifts. Attention moves to what the accused knew and accessed.

Reports can also start investigations. The National Center for Missing & Exploited Children’s CyberTipline accepts reports of suspected online child exploitation. NCMEC reviews those tips and refers them to law enforcement for possible investigation. The Internet Crimes Against Children Task Force Program supports national work on technology-facilitated child sexual exploitation.

Defenses That Focus on Intent and Inducement

Entrapment is a separate defense that Texas law names.

Under § 8.06(a), entrapment applies when a law enforcement agent induces the charged conduct. The agent must use persuasion or other means likely to cause persons to commit the offense. Merely giving a person an opportunity to commit an offense is not entrapment. Under subsection (b), a law enforcement agent includes state, local, and federal personnel, and anyone acting on their instructions.

The line between inducement and opportunity is the key question. Who started the conversation, what was said, and how it developed all matter. Whether any defense fits depends on the facts. Defense work starts with the evidence and the timeline.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Early Steps Matter When Messages Are Under Review

Early steps matter because messages and devices often become central evidence. Their meaning depends on context that only a close review can show.

You may be reading this late at night. You may be trying to make sense of one message, one phone, or one call from police. The news may have come from someone you love, and you want to understand what it means for them.
