Route replies through your own defense lawyer first. Several people and offices can get involved at once, and anything said in the first days may be repeated later. This guide explains who may reach out, what each party can do, which replies create risk, and what to say while you get advice.

Why the Contact Is Happening Now, and Why the First Days Matter

Contact often starts before any charge is filed, so being contacted does not mean a case exists yet. A parent may call directly. A principal, supervisor or coworker may ask for a meeting. Each one plays a different role. The child’s family may be reacting personally. A school or employer may run its own review. Law enforcement may open a criminal investigation. The Texas Department of Family and Protective Services (DFPS) may run a child-safety investigation, and DFPS distinguishes that civil child-welfare work from criminal investigations (DFPS report abuse guidance). Early texts, emails and voicemails are often kept, which is why the first replies matter.

If a parent, school administrator or supervisor has contacted you about an allegation, you don't have to work out your reply alone. Anything you say can later be quoted or repeated in a criminal case, a school review or a civil matter. Whether a particular conversation is safe depends on the facts, including the exact charge, the stage of any investigation and any conditions already in place. Parents who are angry or frightened often want an answer on the spot. That pressure is normal, and it is the moment people most often say too much. Silence is not an admission. A short, consistent, documented reply is usually easier to manage than an improvised explanation. Texas school employees also have mandatory reporting duties, as the Educators guide on reporting explains, so a school may act quickly after a report.

Contact That Can Create Separate Legal Exposure

Some contact can create a new legal problem, separate from the original allegation. Court orders and bond conditions matter most. Texas Penal Code § 25.07 makes it an offense to knowingly or intentionally violate certain bond conditions or protective orders in family violence, sexual assault or abuse, indecent assault, stalking or trafficking cases. That includes knowingly communicating with a protected person in a threatening or harassing manner, and going to or near a residence, workplace or school the order describes. A protective order may also bar all communication with the applicant except through the applicant’s attorney, if the court finds good cause (protective order conditions). If the court finds from the application that there is a clear and present danger of harm to the applicant, it may issue a temporary ex parte order without notice or a hearing. For a protective order other than a temporary ex parte order, the required protective order warning says a violation may be punishable by a fine of as much as $4,000, by jail for as long as one year, or both. Messages that apologize, explain, offer money or ask a family not to pursue the matter can look like pressure, even when sent kindly. Contact with the child, through a relative, or in a shared group chat or social account is hard to undo. Contact meant to influence a witness can also create its own legal problem.

Talking With a School District or Employer

A school district or employer can ask questions long before any criminal outcome, and what you say in those settings may be written down. Districts often have their own rules for interviews, leave and reassignment. Those steps can move on a different timeline than a criminal case. Review any request for a written statement, a personnel meeting or a resignation before you sign or submit anything. Public comment carries the same risk. Remarks at a school board meeting, a community forum or an online parent group reach many people. In accusations under Texas Penal Code § 21.12, a school generally may not release an accused employee’s name to the general public until the employee is indicted. The statute lists exceptions, including reports to the Texas Education Agency or local law enforcement, and school investigations.

What to Say If Someone Reaches Out Before You Have Legal Advice

A short, neutral reply is the safest first response until you have legal advice. You might say: “I have been made aware of a concern. I am not able to discuss the details right now. I have asked an attorney to advise me, and questions can go to them.” Then stop. Do not discuss the child, the family or the details of the allegation. Do not argue the facts with someone who is upset. Do not apologize for the conduct alleged, guess who made the report or why, or make promises about future behavior. Keep a written record of every contact: the date, the time, who reached out, what was said and what you were asked to do. Preserve every text, email and voicemail. Do not delete or edit anything before getting legal advice, because deletion can create its own problems.

Practical Steps for the Next 48 Hours

In the next two days, send every question from parents, school staff, coworkers or reporters to your attorney. Let your attorney decide what, if anything, will be shared and when. Review any court papers, bond conditions and written notices from a school or employer before responding. Check whether a protective order or temporary order limits where you can go or who you can contact, and follow it exactly. Stay off social media about the allegation, the school, the child or your job. Do not comment on other people’s posts about it either. Write a private timeline of what you remember, including the people involved, and label it for your attorney. Share it with no one else.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Heather Barbieri Before You Respond

Contact from a parent, administrator or supervisor can leave you unsure whether any reply is safe.
