Investigators also work through dedicated task forces. The federal Internet Crimes Against Children Task Force Program<\/a> supports investigations of technology-facilitated child sexual exploitation. NCMEC also describes online enticement<\/a> and the grooming tactics tied to it.<\/p>\n

A tip is not a charge. After a report, investigators look at what was sent, who sent it, and from which account. Each of those questions can shape what happens next.<\/p>\n

What the online solicitation statute covers<\/h2>\n

Texas Penal Code \u00a7 33.021<\/a> addresses online conduct directed at a minor, including communicating in a sexually explicit manner with a minor and knowingly soliciting a minor, over the Internet or by electronic message, to meet another person for sexual contact, sexual intercourse, or deviate sexual intercourse. Under subsection (b), a person who is 17 years of age or older commits an offense if, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, the person intentionally communicates in a sexually explicit manner with a minor or distributes sexually explicit material to a minor.<\/p>\n

Subsection (c) is a second-degree felony. Under Texas law, a third-degree felony is punishable by imprisonment for not less than 2 nor more than 10 years, and a fine not to exceed $10,000 may be added (Penal Code \u00a7 12.34<\/a>).<\/p>\n

Under Penal Code \u00a7 33.021(f-1), the punishment for an offense under this section is increased to the punishment prescribed for the next higher category of offense if it is shown on the trial of the offense that the actor committed the offense during regular public or private primary or secondary school hours and the actor knew or reasonably should have known that the minor was enrolled in a public or private primary or secondary school at the time of the offense. The Texas Attorney General’s cyber safety initiative<\/a> also provides Texas-specific information on online solicitation of minors. Whether any charge fits depends on the facts, including the ages, the messages, the dates, and the account used.<\/p>\n

How Romeo and Juliet provisions relate to age-based charges<\/h2>\n

They work differently from one another, so don’t treat them as one rule. Under subsection (e), the defense applies to conduct described by subsection (c) of Penal Code \u00a7 33.021. It covers an actor who was married to the minor. It also covers an actor who was not more than three years older than the minor, if the minor consented. Texas Penal Code \u00a7 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.” Those ages and that consent are measured at the time the conduct was committed.<\/p>\n

Subsection (b) has no consent defense in the statute’s text. Also, Penal Code \u00a7 22.011<\/a> defines a child as a person younger than 17, which is a separate rule for sexual assault.<\/p>\n

Section 33.021(e) provides a defense to prosecution under Subsection (c) if, at the time of the conduct, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct. Texas Penal Code \u00a7 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”<\/p>\n
