It also explains how Barbieri Law Firm approaches these matters, so you can decide whether an educator improper relationship defense lawyer Texas is your next step.

What Texas Penal Code Article 21.12 Covers and Who It Applies To

Texas Penal Code § 21.12 makes certain sexual conduct between a school employee and a student a crime. An offense under this section is a felony of the second degree.

The statute applies to an employee of a public or private primary or secondary school. The employee commits an offense in one of these situations:

The employee engages in sexual contact, sexual intercourse, or deviate sexual intercourse with a student who is enrolled at the school where the employee works.

The employee holds a position described in Section 21.003(a) or (b), Education Code, regardless of whether the employee holds the required certificate, and engages in sexual contact, sexual intercourse, or deviate sexual intercourse with a student the employee knows is enrolled at another school. The same applies to a student participant in a school-sponsored activity where enrolled students are the main participants. This applies whether or not the employee holds the required certificate.

The employee engages in conduct described by Section 33.021 with such a student, regardless of that student’s age.

The statute defines key terms. Subsection (e) defines sexual contact for this section. It requires touching of the anus, breast or genitals with intent to arouse or gratify sexual desire. The Texas Penal Code defines sexual intercourse, deviate sexual intercourse and spouse.

A charge is an accusation, not a finding of guilt.

If a school notice or an investigator's interview request has you unsure what comes next, you don't have to face it alone; our team is ready to talk through your facts. That review is separate from any criminal case. Unprofessional conduct is a workplace concept. A criminal charge is handled by police and prosecutors under the Penal Code.

The two tracks can run at the same time. Each has its own process and its own decision-makers. What happens in one track does not change the other by itself.

Treat any school notice or meeting request as a serious step. A notice can affect your job and your career. Ask for legal review before you attend any meeting.

How Improper Relationship Cases Are Investigated

A case can start with a report. The report may come from a student, a parent, a coworker or the school itself. Investigators may then use several tools:

School review. The district may interview staff, review records and act under its own policies.

Police involvement. Officers may ask for interviews and request phones, messages and other records.

Student interviews. Investigators may use a forensic interview with a child. An outcry witness, the adult a child first told, can also become part of the case.

Digital evidence. Text messages, social media accounts, school email and phones are commonly reviewed.

Investigators may ask you for a statement. Those requests should go through counsel first.

Names are protected in specific ways. Under § 21.12(d), a student’s name may not be released to the public. Texas Penal Code § 21.12 also limits what a school can say publicly. Except as that subsection otherwise provides, a public or private primary or secondary school, or the person or entity that operates it, may not release externally to the general public the name of an employee accused of this offense until the employee is indicted. The school may release the name before an indictment only as necessary to report the accusation (including to the school’s members or community in accordance with its policies or procedures or with the religious law it observes) or to conduct an investigation of it. The listed exceptions include reporting to the Texas Education Agency or local law enforcement, and conducting an investigation.

Online messages raise a separate concern. Section 21.12(a)(3) reaches conduct described by Section 33.021, regardless of the student’s age. The National Center for Missing & Exploited Children explains online enticement and common grooming tactics.

Why What You Say and Do Early Matters

Early statements can be hard to correct later. Pause before you explain your side to a principal, a district investigator or an officer.

An unplanned answer can be written down and repeated in later reviews. Follow these steps to protect your position:

Keep records of your schedule, emails and any notices you received.

Do not delete messages, photos or posts. Keeping them is the safer choice.

Do not discuss the matter with the student or other witnesses.

Avoid posting about the matter online.

These steps protect your position. They are not admissions of anything.

Your lawyer can handle communications with school officials and investigators. You don’t have to make those decisions alone.

What the Defense Covers and What to Expect

The defense moves through four steps. Each step builds on the one before it.

First consultation. Your first step is a free initial consultation — confidential, with no obligation to continue. We review the allegation, the school’s notices and your timeline.

Record review. We review charging documents, school notices, messages and records. We review investigator reports as they become available.

Communication through counsel. We handle communications with school officials and investigators.

Options. We explain the options that fit the facts. These may include negotiation, a hearing or trial.

We also check the statute’s defenses. Subsection (b-1) of the improper educator-student relationship statute sets out affirmative defenses to prosecution under that statute. One applies if the actor was the enrolled person’s spouse at the time of the offense. The other applies if the actor was not more than three years older than the enrolled person, and their relationship began before the actor’s employment at a public or private primary or secondary school. Each applies only when its conditions are met.

The timeline varies with each stage of a case. No lawyer can promise how a case will end.

Why Barbieri Law Firm for an Educator Facing These Charges

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas.
