What Is an Adult Decoy Online Solicitation Charge in Texas?<\/h2>\n

Yes, the charge can apply when the accused believed the other person was a minor, even if that person was an adult. The statute defines a minor as an individual younger than 17, or an individual “whom the actor believes to be younger than 17 years of age.”<\/p>\n

That belief language is why these cases can exist with no child involved. The key question is what the accused believed and intended when the messages were sent. Who was actually behind the profile is only part of the picture.<\/p>\n

In a decoy case, an investigator, often an adult, creates a profile that presents as a young person. Someone who knowingly solicits a minor to meet another person, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse, may face a charge. The Texas Attorney General’s cyber-safety information<\/a> describes Texas rules on online solicitation of minors. Federal law can apply too. How Are Online Solicitation Charges Usually Made?<\/h2>\n

These cases often follow a clear sequence: a profile, a chat, a request, and then an arrest or warrant. The profile usually appears on a website or app. The chat may move from small talk to sexual topics, then to a request to meet or to share images.<\/p>\n

The evidence usually includes chat logs, screenshots, account records and messages sent from the accused person’s device. Investigators also look at timing. They ask when the conversation started and who first raised sexual content. Those questions often matter when a case is reviewed.<\/p>\n

The word “enticement” appears often in these cases. The NCMEC’s online enticement page<\/a> describes it as online grooming or exploitation tactics used to lure a child. Reading the full exchange matters. A single message can look very different once the whole conversation is in view.<\/p>\n

What Is the Penalty for Online Solicitation in Texas?<\/h2>\n

Online solicitation of a minor is a felony in Texas. The grade depends on which subsection the state charges. Subsection (b) covers a person 17 or older who, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, intentionally communicates in a sexually explicit manner with a minor or distributes sexually explicit material to a minor over the internet or another electronic message service. Subsection (c) covers soliciting a minor to meet.<\/p>\n

A subsection (b) offense is a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the accused believes the minor is younger than 14. A subsection (c) offense is a second-degree felony.<\/p>\n

The punishment can move up one category if the state shows the offense happened during regular school hours. The accused must also have known, or reasonably should have known, that the minor was enrolled in school. That increase is conditional, not automatic. Also, a meeting does not have to happen for a subsection (c) charge. It is not a defense that the meeting did not occur.<\/p>\n

What Must the State Prove, and What Defenses Are Examined?<\/h2>\n

The state must prove each element in the statute, and the accused person’s intent and belief are central. For subsection (b), the state must show that a person 17 years of age or older, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, intentionally communicated in a sexually explicit manner with a minor, or distributed sexually explicit material to one, over the internet or electronic messaging.<\/p>\n

For subsection (c), the state must show a knowing solicitation of a minor to meet, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. The words, timing and context of each message are examined closely.<\/p>\n

Entrapment is one defense lawyers examine. Under Texas Penal Code \u00a7 8.06<\/a>, it is a defense that a law enforcement agent induced the conduct using persuasion or other means likely to cause persons to commit the offense. Merely giving a person an opportunity to commit an offense does not count as entrapment. The statute’s definition of law enforcement agent covers state and local personnel, federal personnel, and anyone acting on their instructions.<\/p>\n

The subsection (c) defenses are in Penal Code \u00a7 33.021(e). They apply if the accused was married to the minor, or if the accused was not more than three years older than the minor and the minor consented. Texas Penal Code \u00a7 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.” Other questions include who operated the account or device, and whether the messages can be tied to the accused person.<\/p>\n

What Usually Happens After an Arrest on This Charge?<\/h2>\n

The accused person usually appears before a judge for a bond decision. The case then proceeds through formal charges and court dates.<\/p>\n

A judge may set bond conditions. A lawyer can review them quickly, so the accused person understands what is required.<\/p>\n

In some cases a judge may place a defendant on deferred adjudication community supervision. Under Article 42A.101(b), the judge must inform the defendant orally or in writing of the possible consequences of a violation of a condition of deferred adjudication community supervision. A charge is an accusation. Guilt is not decided until the court process has run its course.<\/p>\n

What About Phones, Computers and Deleted Messages?<\/h2>\n

Investigators often seize phones and computers. Forensic tools can sometimes recover messages a user believed were deleted. Recovered messages can become central evidence, so device questions matter as much as the chat itself.<\/p>\n

Common questions include how the data was pulled from the device. Another is whether the timeline of recovered messages matches the chat. Officers may also collect messages from other apps and accounts linked to the accused person. A lawyer can review what was taken and how it was collected.<\/p>\n
