The exact charge controls the elements, the punishment range, and the bond issues.

Sexual assault is defined in Texas Penal Code § 22.011. The statute defines a child as a person younger than 17. Indecency with a child is covered by Texas Penal Code § 21.11. Indecency by sexual contact is a second-degree felony. Indecency by exposure is a third-degree felony.

Continuous sexual abuse of a young child is covered by Texas Penal Code § 21.02. It requires two or more acts of sexual abuse over a period of 30 or more days. Under Texas Penal Code § 21.02, at the time of the commission of each act of sexual abuse, the actor is 17 years of age or older and the victim is a child younger than 14 years of age, regardless of whether the actor knows the age of the victim at the time of the offense, or a disabled individual. It is a first-degree felony.

Online solicitation of a minor is covered by Texas Penal Code § 33.021. These cases involve messages and electronic contact, and the offense covers soliciting a minor to meet another person with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse. They follow a different evidence path.

Each offense has its own elements. One allegation can lead to more than one charge. If your allegation involves touching short of intercourse, our indecency-by-contact guide covers that situation in more detail.

How the Accusation Starts: Outcries, Reports, and Reporting Duties

Most child sex crime cases start when a child tells a trusted adult that something happened. That disclosure is called an outcry. The adult may report it to police, to the Texas Department of Family and Protective Services (often called CPS), or to both.

Some reports come from teachers, medical staff, coaches, or others who work with children. A single report can start two tracks at once. One is a law enforcement investigation. The other is a child protective services case.

An accusation can also reach an employer, school, or church before any charge is filed. Those organizations may open their own review, on their own schedule and under their own standards. Timing matters. Early statements, emails, and meeting notes can be used later, so it helps to understand what has been said and to whom. Our guide on speaking with parents and schools after an allegation covers this in more detail.

The Forensic Interview and the Outcry Witness

A forensic interview is a structured conversation with the child, and it is often recorded. The interviewer’s wording, the order of questions, and the follow-up prompts all matter. Those details affect how the child’s account is later read.

The outcry witness is the adult who first heard the child’s account. That person may later testify about what the child said. Texas law also makes a child’s statement admissible at a protective-order hearing in certain cases. The statement must be made by a child younger than 14 who is the victim of a listed offense, and it must describe that offense. See Texas Code of Criminal Procedure art. 7B.004.

A defense usually asks several questions about the interview. How was it conducted? Were suggestions or repeated questions used? Did the account change over time? Does the recording match the report? Our team reviews these points line by line. Our forensic interview guide and outcry witness guide go deeper on each one.

How Law Enforcement Builds the Case: Investigation and Evidence

Police build the state’s case by collecting statements and records. Then they check those pieces against each other. The main categories are interviews, medical examinations and records, school or employment records, text messages and social media, phone and computer data, and witness statements.

Digital evidence usually comes through search warrants. Investigators may extract data from a phone or computer and review message histories. Each source needs checking for completeness, timing, and context. A message thread can look very different once the full conversation is read.

Online cases often start differently. The federal Internet Crimes Against Children program investigates technology-facilitated child sexual exploitation. Tips and online activity can bring these cases to investigators before any contact with the child occurs.

Some cases involve no physical evidence at all. In those cases, statements and records carry more weight. The defense examines how each one was gathered, who gathered it, and when.

Arrest, Bond, and Bond Conditions

After an arrest, the accused is booked and brought before a magistrate. The magistrate sets bond at the first appearance. Conditions can be added at that point, and they often matter as much as the amount.

Several factors commonly affect bond in these cases. They include the charge, the alleged victim’s age, criminal history, ties to the community, and employment. The bond amount and conditions turn on the facts of the case and the court involved.

Bond conditions in child cases often include no-contact terms. Texas makes it an offense to knowingly violate a bond condition in a sexual assault or abuse case. The condition must relate to the victim’s or the community’s safety. The violation can include communicating with the protected person, except through the person’s attorney or a court-appointed person, if the order prohibits any communication with the protected person or a member of the family or household. It can also include going to or near the residence or workplace of the protected person or a family member, or to a child care facility, residence, or school where a protected child normally resides or attends, as specifically described in the order or condition of bond. See Texas Penal Code § 25.07.

A violation can create a new charge on top of the original case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Charge Selection, Indictment, and Formal Charges

The charge filed at arrest is not always the charge the case moves forward on. Prosecutors can add or drop counts as the evidence develops. A grand jury then decides whether to indict. Under Texas law, an indictment is “presented” once the grand jury has acted on it and the court has received it. See Texas Code of Criminal Procedure art. 12.06.

Each count is a separate charge. Each one has its own elements, so the defense reviews them one at a time. Continuous abuse has a specific limit. See Texas Penal Code § 21.02.

Ages also matter. In some indecency and sexual assault trials, the judge must make a special finding. That finding applies when the defendant was not more than four years older than a victim who was at least 15, and the conviction rests solely on those ages. See Texas Code of Criminal Procedure art. 42.017. The ages of both people are central to the special finding, which applies only when the conviction is based solely on the ages of the defendant and the victim at the time of the offense.

How the Defense Is Organized From the First Day

The defense starts by preserving what already exists. The accused should write down a personal timeline while memory is fresh. Witnesses should be listed, and records should be identified. Those records can include messages, calendars, and work schedules.

Next, the file is reviewed line by line. That includes the recorded forensic interview, police reports, warrants, and device extractions. The defense checks whether each report matches the recording. It also checks what each warrant allowed investigators to search.

Some cases call for outside help. A consultant may review interview technique, digital forensics, or medical records. Whether any of these reviews is needed depends on the evidence in each case.

Communication matters too. Early statements to police, family members, or an employer can shape the case. It helps to plan those conversations carefully, with the defense in mind.

Defense Issues Examined in Child Sex Crime Cases

A defense usually examines whether the child’s account is consistent. It also looks at timing and whether the account changed across interviews. Small differences can point to a larger question about how the story developed.

Recanted or retracted allegations raise separate questions. Our recantation guide covers how those situations are handled. Pressure, repetition, and suggestion during the interview process are also reviewed. The defense asks whether the recording supports what was written in the report.

Texas law also provides some affirmative defenses. For indecency with a child, one condition is that the actor was not more than three years older than the victim and of the opposite sex. The actor must also have used no duress, force, or threat. Registration status is another condition. See Texas Penal Code § 21.11.

See Texas Penal Code § 21.02.

No defense is assured. Each issue depends on the evidence in the file.

Professional Consequences: Employment, Schools, and Civil Claims

An accusation can lead to suspension, termination, or school action. These reviews happen apart from the criminal case. They can move faster or slower than the court process.

Licensing boards may also look at a professional’s license. Words spoken in a workplace or school meeting can be repeated later. They may also appear in the criminal file, so they should be planned carefully.

A civil lawsuit can arise from the same allegations. A civil claim proceeds separately from the criminal case, with its own process.

Certain professionals face a specific issue. Under Texas law, a sexual assault is without consent when the actor is an employee of a facility where the other person is a resident, unless the employee and resident are formally or informally married to each other under Chapter 2, Family Code. The exception is when the two are married. The statute defines an employee of a facility to include any person who provides services for a facility for compensation, including a contract laborer.

If you work in a school or youth activity, our educator guide and youth coach guide cover those roles.

How These Cases Resolve: Dismissal, Plea, and Trial

A case can end in several ways. The state may dismiss the charges. The parties may reach a negotiated plea. The case may also go to trial before a judge or a jury.

A plea carries its own consequences. Some offenses lead to sex offender registration. Under Texas Code of Criminal Procedure Art. 62.001, a “sexually violent offense” means any of the listed offenses committed by a person 17 years of age or older. Whether registration applies turns on the offense and the record.

Trial follows a set order. Jury selection comes first. The state then presents its witnesses. The defense cross-examines them and presents its own evidence. The stakes can be high. Continuous sexual abuse carries life or a term of 25 to 99 years under Texas Penal Code § 21.02.

No lawyer can promise how a case will end. The path a case takes depends on the evidence and the charges involved.

If a child's outcry, a call from CPS, or a possible charge has you unsure what comes next, our team can walk you through your options in a free, confidential initial consultation.
